ACTION: That the minutes of March 3rd, 1958 be adopted as corrected. REPORTS: 1. �City Engineer McCandieas --Joint .Engineer's Meeting re: Road mi—provemen . City Engineer Charles Be McCandless reported that a meeting was held March 102 with Colin Peters, Attorney, John Riley, Engineer representing Fremont Hills, Eugene Mastin, Engineer representing Mr. Cusack. Mr. McCandless stated that Mr. Mastin was in agreement to building whatever drainage facilities necessary to carry excessive run-off from the property to the nearest water course. The same reaction was gained from the Fremont Hills Engineer, who was present, and agreed that'Fremont Hills is willing to construct in -tract and off -tract drainage facilities to carry run-off from their property. It was reported that Fremont Hills is agreeable to paving 34 a road contiguous to or perimeter roads surrounding their subdivisions to the standards set by the Town. They will not object to paving the full width of a road, for a lesser distance, where it is necessary. Mr. McCandless stated that it seems to be the wish of the subdivider that if money is deposited to be used on roads contiguous to their subdivision --it is not to be used elsewhere. Mr. Riley was asked if Fremont Hills will improve Concepcion Avenue. The question was answered that: theyw 11 improve )z of all rodds contiguous to their subdivision. ACTION: That the City Council accept the report of the City Engineer and that it be deferred for further study -by the Council. 3.12-58 _,2 - MOTION: Councilman Bledsoe; SECOND: Councilnan Hoefler; ROLL C�ML: AYES: `Councilmen Bledsoe, l+owle, Hoefler, Mayor Treat NOES: None ABSENT: Councilman Rothwell CORRESPONDENCE: 1. Los Altos Hills Association - Letter dated March 102, 1958 and signed by Thomas -B.`l sch e, presented the list of newly elected officers of the Los l;ltos Hills Association. The policy and aims of the organization were stated. The Mayor welcomed Mr. Zischke, who was present, and asked that he - convey to the Los Altos Hills Association the gratitude of the -Town for all.the good work they have done and also wishes for sucbess. NEW BUSINESS: 1. Divisions of Land: a. Valle Vista Subdivision (Elena Hills)- (74-57) 8 lots. %gr. Wolff. #proval recommends by_Panning Commission Aug. 1,1957. The City Clerk reported that all agency approvals have been received. ACTION: That the City Council approve Valle Vista Subdivision (74-57), Tract 2024,.8 lots. Nolte. Approval recommended BF-PTRCommission January 181b, 1958. The City Clerk reported that all agency approvals have been received. It was pointed out by Chairman Williams, of the Planning Com. mission, and Councilman Hoefler that the roads in this subdiv- sion are the type that the Town has been striving for, with berms on both sides to prevent the shoulders from being washed away. This ,subdivision shows a fine example of roads and paths. ACTION: the That,,subdivision of Heine Schmidt (102-58) Tract #1532, 2 lots, be approved. MOTION: Councilman Bledsoe; SECOND: Councilman Fowle; ROLL 0,, -LL: AYES: Councilnan Bledsoe, Fowle, Hoefler, Mayor Treat NOES: None ABSENT: Councilman Rothwell The Mayor commented on the rapidity with which this Subdivision was processed. The time consumed was thirty days. 2, Resolution #6611* Abandonment of portion of Ascunsion Avenue, The Resolution was read in its entirety by the City Clerk. ACTION: That Resolution #61 be adopted as read. MOTION: Councilman Bledsoe; SECOND: Councilman Hoefler; ROLL CALL: AYES: Councilmen Bledsoe, Hoefler, Mayor Treat NOES: None ABSTAINED: Councilman Fowle ABSENT: Councilman Rothwell 3. Assessments of Agricultural Areas Contiguous to New Subdivisions. Councilman Bledsoe opened the discussion of the high assessments, made by the County, of property used for agriculture which is con- tiguous to new residential areas. 3-12-58 r- -4 - Mr. C. A. Maurer, 26170 W. Fremont -.ve., who has been a farmer in Los Altos Hills for the past 13 years, spoke regarding the high 4 assessments. He stated that it is not his intention, at the pre - Sent time, to subdivide, but that in the event that his property is assessed 200% or 300.0 higher because of new subdivisionhe ay have to consider subdividing. He stated that he voiced the opinion of other farmers and fruit growers in the area. The possibility of having certain areas declared "greenbelt" in order to lower assessments was discussed. It was pointed out that once an area has been declared such, it must remain so, or in the event that it ever zoned differently, certain back assessments would have to be paid. Councilman Bledsoe recommended that the City Attorney be authorized to draft a resolution for adoption by the City Council re'questirig the State Legislature to take some aetton in the matter of assess- ments by the County and expressing the views of the Town in regard to the situation. The City Clerk was instructed to notify the City Attorney to pro- ceed with the drafting of a resolution as recon -mended. 4. Fre - Report by Mayor Treat. The Mayor reported. that he and Councilman Fowle had attended a Freeway Study Session held by the County B omd of Supervisors, at which.a discussion was held regarding the possible widening of Fremont Avenue to a four or six lane highway to parallel the S. P. tracks and running to the Stanford Industrial Park. It was pointed out that slow traffic on six lanes would be worse than the Freeway. No definite decision was reached at this meeting. 5+ Warrants - Bills in the amount of ,2,634.24 were presented for payment. ACTION: That the Council approve payment of bills as presented and that the City Clerk be authorized appropriate warrants for payment. MOTION: Councilman Fowle; SECOITD! Zonin Ordinance - Ordinance #44. - Chairman Williams, of the Planning Commission, explained the 'mechanical' procedure followed before final adoption of an ord- inance, stating that the first draft is the product of joint Com- mittees of the Council and Planning Commission followed by numerous study sessions,'and a Public Hearing held by the-Pl1inning Con ission 3-12-58 -5 - at which tir=e cor.-ents and. questions fr. ;r the public are invited. The proposed draft is then submitted to the Council, acconpanied'by comments and suggested revisions. From this draft,,the Council works jointly with tho Planning Commission and the City Attorney towards the finished draft. Many study sessions are necessary be- fore the Council holds its Public Hearing, where again the public is welcomed to make suggestions and comments. In reference to the letter circulated by the Citizens Committee re- garding the Zoning Ordinance, Chairman Williams pointed out thht most of the Sections mentioned in the letter were noted by the Planning Commission as requiring further study and revision in the letter of transmittal to the City Council. Commissioner Daum explained that for many months the Zoning Ord- inance has been in the bsuds of the Planning Commission. It was the wish of the majority of the Commission, in order to expedite it, to pass the Ordinance on to the Council along with the comments* and suggestions noted at the Public Hearing. Opinions were expressed with regard to the Zoning Ordinance, by Mr. Fred Gutt, Mr. Robert Doak, the City Engineer, and Councilman. 7. Ordinance + - emending Ordinance #,45. First Reading. The Ordinance was read in its entirety by the City Attorney. Discussion as to whether this Ordinance should be an emergency ordinance ended with the decision to pass it as a regular ordinance since no subdivider would be adversely affected. ACTION: That Section II of Ordinance #/+71 as read, be deleted. MOTION: Councilman Towle; SECOND: Councilman Hoefler; ROLL CALL: AYES: Councilmen Bledsoe, Fowle, Hoefler, Mayor Treat NOES: None ABSENT; Councilman Rothwell ACTION: That Section III of Ordinance #47, as read, be deleted.
