Easton Rothwell, Monday, January 20b, 1958 at 7:52 P. M. at the Town Hall, 26379 Vest Fremont, Los Altos Hills. ROLL CALL: PRESENT: Councilmen Bledsoe, Fowle, Deputy Payor Rothwell ABSENT: Councilman Hoefler, Mayor Treat MINUTES: Januar ACTION: Approve minutes of January 60, 1958 as presented. CORRESPONDENCE: - 1. Mrs. Louis Corbetta and Mrs. Leo Shanafelt. Letter, dated January MT, X95$; sorting th-e-Touncil s..avor in the organization of a Welcome Club for newcomers to the Town of Los Altos Hills. Deputy Mayor Rothwell stated that the Council has no objections to such an organization, and directed the City Clerk to so advise Mrs. Corbetta and Mss. Shanafelt, and also to extend the Council's wish for success in their venture. 2. Chief Bassett, Los Altos Fire Protection•District. 'Copy of letter sent to James Going�rm ian of To n Hills Water Company, dated January 120, 1958, regarding improvement of facilities of the system, requested that the issuance of building permits be -withheld, by the Town, in the area being served by the system. Deferred to New Business. 3. TTo-yoon Hills Water Com . Letter, dated'January 86, 1958 and signed-iy L C. Reed�;�retary, requested the Town of Los Altos is to withhold the issuance of building permits in the area served by the Toyon Hills Water Company, unless first approved by the water company. Deferred to New Business. 4. ,Cit of Los Altos. Letter of January 1700 1958, signed by John Hope, -7h '7e A ma.nistrative Officer regarding the plan for the development of recreational facilities in the Los Altos area, stated the proposals that were made at the meeting of January 152, 1958. The letter stated that another meeting will be held at the Los Altos City Hall on Wednesday, January 22nd, 1958 at 2 P. M. to discuss the financing of such a program. -2 - Commissioner Williams, of the Manning Commission, represented the Town at the meeting of January 150, 1958, but was not present to report. Further discussion was deferred. REPORTS: 1. West Fremont Traffic Survey - City Clerk. The City Clerk stated that the traffic survey report of West Fre- mont Avenue had not been received from Mr. Kellogg, of the Calif. State Automobile Association. The report will be given at the next meeting. 2. Branch Post Office - City Clerk. The City Clerk reported that before a complete report can be given, further information will have to be secured from the Regional Post- al Office in San Francisco. The report will be given at the next meeting. 3. In Lieu Tax - City Clerk. It was reported that the In Lieu Tax and the Gas Tax are both based specifically upon the population. It was suggested by Deputy Mayor Rothwell that an investigation should be made regarding the cost of having a census taken in the Town of Los Altos Hills. Mrs. Sugden reported that the Los altos Hills Association was in- vestigating the feasability of a special census. 4. Automobile Registration - City Clerk. It was reported that the Motor Vehicle Department has no objection to the residents of the Town giving "Los Altos Hills" as their address on Automobile Registrations. 5. Road and Drainage Fees - Committee. The report of the meeting of January 132, 1958 of the Road and Drainage Fees Committee, and its recommendations were read by Councilman Fowle. ACTION: That the report of the Road and Drainage Fee Committee meeting of January 13t, 1958 be accepted. MOTION: Fowle; SrCOT?D: Bledsoe; VOTr: Passed unanimously It was decided that each of the three (3) recommendations should be considered independently. -3— Recommendation A: ACTION: That the Town inform Fremont Hills Development Company that as part of the conditions of arproval for Fremont Hills Unit #59 the corporation be required to post a performance bond to insure faithful completion of improvements relating Unita #19 2, and 3. MOTION: Fowle; SECOND: Bledsoe; VOTE: Passed unanimously Recommendation. L2. It was decided that action on Recommendation ,Y2 be deferred, and that the Town will consider an offer from the Fremont Hills Development Company, regarding peripheral road improvements in Units 4#4, 5, and 6, in lieu of the 1300 per lot fee, if made before the next meeting of the Council. Recommendation_ ,'#3: Attorney Bullis was asked to draft an appropriate amendment to Ordinance „39 which would give the Council the privilege of considering alternative arrangements or agreements with Sub- dividers for improvement of peripheral roads, in lieu of the 3300 per lot fee. ' 6. Assessment of Agricultural Lands. Councilman Bledsoe. Councilman Bledsoe reported that when an area thet is zoDe(� f.3r agriculture is surrounded by, or -'is contiguous to a newly developed residential area, its market value is enhanced by the adjoining development and assessments are increased accordingly.. Councilman Bledsoe suggested -that the Council make inquiry into the situation, and take some action against such, assepsments. The City Attorney was asked to further investigate this situation, and if he deems it necessary, he was asked to draft a resolution indicating the Town's objection to such increased assessments. NEW BUSINESS: 1. Publie Meeting - To be held Monday, January 27tb, 1958 at 8 F. M. at'the own all. Deputy Mayor Rothwell announced that a Public Meeting will be heldt at which time progress reports will be given outlining the accbm-- plishments of the Town during the two years of incorporation. The Planning Commission will report on its activities during the past two years. Ap All citizens of the Town of Los Altos Hills are welcome to the Meeting. 'questions concerning the Town will be welcomed. . -4- 2. Variances: George R. Kirkpatrick_ (V-21-57) Reduction of rear setback to 251. ACTION: That the Council approve the variance of 25' rear setback of George R. Kirkpatrick (V-21-57) as recommended by the Planning Commission at its meeting of January 92, 1958. MOTION: Bledsoe; SECOND: Fowle; VOTE: Passed unanimously 3. Subdivisions: John H. Junor - (99-57) 2 lots. Engr. Nolte. ACTION: That the Council approve the subdivision map of John H. Junor (99-57) 2 lots, as recommended by the Planning Commission at its meeting of January 9b, 1958• MOTION: Bledsoe; SECOND: Fowle; VOTE: Passed unanimously 4 To on Hills Mater Company - Regarding correspondence which was e erree `to New Bus nese e In reference to the letters from Fire Chief Bassett and the Toyon Hills Water Companyrequesting that further issuance of building permits in the area be withheld, the City Attorney stated that the Council has the power to withhold permits in any area where fire protection is substandard. ACTION: Resolution #58: Resolfved that the Council endorse the recommendations of Fire Chief Bassett in regard to future home site development in the area served by the Toyon Hills Water Company, and that the City Clerk so advise the Boars: of Directors of the said water company, and also'advise all indivieual property owners served by the Company that building permits will be withheld until the fac- ilties of the system be brought up to standards satisfactory to the Los Altos Fire Protection District. MOTION: Fowle; SECOND: Rothwell; VOTE: Passed unanimously The Hugh Monahan subdivision which is in the area served by the Toyon Hills 'dater Company, was approved by the Council, but has not been signed by the City Engineer because of the inadequacy of fire protection due to the lack of water facilities in the area. This has prevented the Monahan's from being able to record the Final Map of the subdivision. Mrs. Monahan requested that the City Engineer be asked to sign the Final Subdivision Map as all other requirements have been complied with. -5 - ACTION: That the Town .Engineer be instructed to sign the Hugh Monahan subdivision Map, rnract 2043; subject to the conditions of Resolution Y58. MOTION: Fowle; SECOND: Bledsoe; VOTE: Passed unanimously ORDINANCES: 1. Ordinance - Subdivision Ordinance. First Reading. The City Clerk read the Title of Ordinance #35. ACTION: That further reading of Ordinance #35 be waived. MOTION: Bledsoe; Lotion lost for lack of Second. Attorney Bullis suggested that the following addition be made to the Title: and repealing Ordinance #19 as amended by Ordinance #25 and any Ordinance or portion of an Ordinance in conflict therewith." The City Clerk re -read the Title. ACTION: That further reading of Ordinance #35 be waived. MOTION: Bledsoe; SECOND: Towle; ROLL CALL: AYES: Bledsoe, Towle, Deputy Mayor Rothwell NOES: None ABSENT: Hoefler, Mayor Treat 2. Ordinance #42 - Billboard and Sign Ordinance. First reading. The City Clerk read the Title of Ordinance #42. ACTION: That further reading of Ordinance #42 be waived. ACTION: That the Council approve for payment, bills in the anount of $1,567.74, and that t$e City Clerk be authorized to draw the ap- propriate warrants.
