Treat. ROLL CALL: PRESENT: Mayor Treat, Councilmen Fowle, Hoefler, Bledsoe. ABSENT: Councilman Rothwell. MINUTES: June 3,. IM. Paul Myer, Attorney for Lloyd Copenhaver, appeared challenging a statement under "ACTION" of Council's approval. ACTION: Move correction of the minutes of June 3, 1957, under Lloyd Copenhaver, Page 5, second sentence under "ACTION" after word 'Planning Commission' - add: "and letter from Town Engineer dated May 23, 191-711. Delete rest of paragraph. Motion: Fowle; Second: Hoefler; Vote: Not Passed ROLI, CALL: AYES: Councilmen Fowle, Hoefler NOES: None ABSTAIN: Mayor Treat, Bledsoe ABSENT: Councilman Rothwell Motion failed for lack of ^� Approval of minutes deferred until Tuesday evening, June 11, 8:00 P.M., Town Hall, to which time the Council meeting adjourns. Correction to Resolution 6: Page 2, end of first paragraph, add: "Now therefore be it resolved;" CORRESPONDENCE: 1. Gardner Bullis - June 6, 1957. Re: Request for subscription on behalf of the Town of ., Los Altos Hills to the National Institute of Municipal Law Officers. Cost is $62.50 for purpose of obtaining resource material. -2 - ACTION: Approve the request of the ToV►n Attorney. Motion: Bledsoe; Second: Mayor Treat; Vote: Passed 2. L. F. Wilson - June 7, 1957• Request position of Town on complaints regarding excavation business being conducted on O'Keefe Lane. A copy of the Town Attorney's letter (see below) will be sent to Mr. Wilson. Letter referred to Town Attorney. 3. Gardner Bullis - June 9, 1957. Re: Alleged violation of Zoning on O'Keefe Lane in Town of Los Altos Hills. Copy of a letter addressed to Kenneth A. Johnson, attorney, in regard to his client, Mr. Richard B. Melton. Town Attorney Bullis had not received an answer to a letter in which he requested a remedy to the abuse and claimed violation on this property. If such is not forthcoming, court action will be brought. 4. Clark L. Bt theradley - June 7, 1957. Assemblyman Bradley ssstated thareferral of ACR 184 to an interim committee on Conservation, Planning, and Public Works was just a polite way of killing the resolution. This resolution now places further consideration for location of the Junipero Serra Freeway back on the local level. 5. Joseph Salameda, Executive Secretary, Los Altos Historica ssociation - June 6, 1957. Mr. Salameda enclosed a copy of the first Annual Report of the Los Altos Historical Association, and requested whether Los Altos Hills was interested in becoming a member. ACTION: Town of Los Altos Hills take out a Life Membership in the Los Altos Historical Association in the amount of $25.00. Direct Deputy City Clerk to inform Mr. Salameda of the Council's action. Motion: Mayor Treat; Second: Fowle; Vote: Passed. NEW BUSINESS: 1. Harry J. Goett - June 4, 1957, directed a letter to The ounci regarding the basis for assessment in proposed South E1 Monte Assessment District. Mr. Goett suggested that the assessment district be calculated on an acreage basis rather than a front -foot basis, since benefits from such an improved road would benefit the entire area and not just the property owners abutting said road. Mr. Goett believes this method would more properly distribute the cost in proportion to the benefits. -2. -3 - Mr. McCandless, Town Enfineer, represented ]a Mr Mclure; RK Mcg ure outlinel the various lega�1 acts whit can be used to create an assessment district, particularly Improvement Act of 1911. Copies of Mr.McClure's report regarding assessment districts will be sent to all Council and Commission members for consideration. Richard S. Bullis Chairman of Planning Commission, sppm ng on rte. Goett's letter, stated that the- Commission heCommission endorses such an assessment district and recommended same in a resolution. Such a method is more desirable than charging a flat fee per lot of new subdivisions for road improvement because on a fee basis there would not be sufficient funds to improve the road properly. 2. Hugh Monohan. ADPeal. ACTION: Move the Council defer action on the Monohan appeal until Tuesday, June 11, 1957• Motion: Bledsoe; Second: Hoefler; Vote: Passed 3, Alan Cranston (61-57) Revised Tentative Map dated MayY 771:— 5 lots on Hilltop Drive. Engineer: Nolte Final approval given subdivision map at Planning Commission meeting of June 1, 1957• ACTION: Move that the subdivision of five lots for Alan Cranston on Hilltop Drive be approved with the recommendations of the Planning Commission as outlined in their letter of June 1, 1957• 4, Final_ Reading ACTION: - Ordinance 6. Ordinance #36, introduced on the 27th day of May, 1957, for consideration and first reading. Introduced for second reading on June 3, 1957• Introduced for final reading this date, 10th day of June, 1957. On motion duly made by Councilman Bledsoe, seconded by Councilman Fowle, and unanimously carried, that after title had been read, further reading of the ordinance be waived. , ROLL CALL: AYES: NOES: ABSENT: Mayor Treat, Councilmen Bledsoe, Fowles Hoefler. None Councilman Rothwell. -3- -4- 5. Adoption_ of Ordinance 36. ACTION: Move the adoption of Ordinance #36 .. Motion: Bledsoe; Second: Hoefler; Vote: Passed, ROLL, CALL: AYES: Mayor Treat, Councilmen Bledsoe, Fowle, Hoefler NOES: None ABSENT: Councilman Rothwell C. Discussion of Resolution pertaining to N„eary Suarry. Resolution directing attention of the Board of Supervisors to the Neary Quarry and requesting the Board to investigate this alleged non -conforming use extension and to compel the cessesation if such extension was established. Councilman Bledsoe read a letter from Attorney Jerry Feeley stating that since the quarry was in operation at time of incorporation of the Town of Los Altos Hills, a Use Permit is not required and this operation is not a non -conforming use. ACTION: Refer this Resolution back to Gardner Bullis, Town Attorney, and Mr. Hoefler, for clarification. Motion: Fowle; Second: Bledsoe; Vote: Passed. 7. Approval of Bills: Total - $549.45 ACTION: Move the approval of these bills and authorize the Deputy City Clerk to issue the appropriate warrants for payment. Motion: Fowle; Second: Mayor Treat; Vote: Passed ROLL CALL: AYES: Mayor Treat, Councilmen Fowle, Hoefler, Bledsoe. NOES: None. ABSENT: Councilman Rothwell. 8. Announcement of Meeti with Board of Supervisors for consideration of unipero Serra�'reewa . Councilman Fowle stated a meeting will be held at 2:45 P.M. on Monday, June 17, 1957, with the Board of Supervisors. Mr. Fowle will appoint a representa- tive for the Town if he is unable to attend and present Resolution /#I6 stating the Council's action in regard to the location of the Freeway. -4- -5— MEETING ADJOURNED TO: Tuesday,, June 11, 3.957, 8:00 P.M.
