Easton Rothwell, at 7:45 P.M., at the Town Hall, 26379 West Fremont, Los Altos Hills, on May 20, 1957• - ROLL CALL: FRSENT: Acting Mayor Rothwell, Councilmen Hoefler, Bledsoe, Fowle. ABSENT: Mayor Treat MIYUTES: Approval of May 13, 1057 minutes deferred until next meeting. CORRESrONDENc 41 : 1. IrviDE L. Atkinson, Mayor, City of Los Altos - May 17, 1957• There will 'be a meeting for-s30-T.M., 7rid.ay, May 241 1957, in the Conference Room at the Stanford University Business Office, Encina Hall, Stanford, to consider location of the Junipero Serra Freeway. 1 Representatives of the Division of Highways will meet with Mayors, Chairmen of Planning Commissions and City Managers of the cities in this area. Councilman Fogle, Councilman Rothwell, and Commissioner Mellquist are requested to be official, Town representatives at this meeting. 2. John M.R. Hope, Chief Administrative Officer, City oT7os Altos - May 16,`1957. Miss'Uladys Snyder, Recreation Specialist of the State of California will present a report by the State Recreation Commission on a clan of development for recreation services in the Los Altos Area on Thursday, May 23, 1957, at 8:00 P.PT. in Rm 5, San. Antonio Administration Building. Fr. Hope requested in his letter to be informed if the Town of Los Altos Hills would be represented. The City Council appointed Mrs. Hal Williams, Planning Commissioner, to be the official Toi,,m representative at .this meeting. 3. Proposed City Count Study of Major hway S s�temms submitted by Supervisor 'leslgy L. Hubbard; Supervisor Ed Levin; Supervisor Arthur W. Brown; Mayor Law- rence Anderson; Mayor Noel rorter, F.A.; Vice -Mayor Louis Solari, S.J.; City 1,1'anager Jerry Keithley, F.A.; City Manager A. Hamann, S.J. - March 26, 1957• -2 - This report requested the Torn of Los Altos Hills share in a proposed City -County study of the major highway system as it affects both the cities and the %W unincorporated. areGs of Santa Clara County. Attached financing plan estimated according; to population. Los Altos Hills' share would be .55% of total cost of $180,000.00, with the State contributing $60,000,00 or 1/3, whichever is greater. ACTION: 4, Move the Town of Los Altos Hills participate in the City -County Study of Major Highway Systems as proposed, and the Town's share of the cost not to exceed ;1,000.00. Motion: Fowle; Second: Bledsoe; Vote: Passed ROLL CALL: AYES: Acting Mayor Rothwell., Councilmen Bledsoe, Fowle, Hoefler. NOES: None. ABSENT: Mayor Treat. City Clerk, H.G. Paulman, will address a letter to the committee in charge of this study stating the Council's action. AGENDA: 1. Resolution4444 - Arpointment of Paul W. Salfen as Deputy City Clerk. ACTION: Move adoption of Resolution #44 appointing Paul W. Salfen, Deputy City Clerk in case of City Clerk's absence or illness. Motion: Rothwell; second: Bledsoe;Vote: Passed. 2. Re ort from Road Committee on Condition of Magdalena - Petition Pending for T11ree-Ton Limit on Magdalena. Don T. Hibner, Road Commissioner, gave a report outlining the reasons for the poor condition of the road on Magdalena. The road base and surface are inadequate as the road was built on non-absorbant soil. Poor drainage facilities and storm waters crossing road are not properly channeled. Mr. Hibner's opinion is that if truck traffic continues on this road, it will continues rapidly to break up. -2- r, -3- Report from Gardner Pulli.s, Town kttorney Letter submitted by7 Attorney Ru.L is regarding petition for twenty-two residents .for a Three -Ton Limit on Magdalena, represented by Attorney James C. Wilson. This petition was presented to the Council meeting of May 13, 1957• In Mr. Bullis' opinion the Council is restrained - from instituting such a petition under the Injunction Order in the case of Neary vs Town of Los Altos Hills ,r from any ordinance placing a 3 -ton limit for trucks on Magdalena. However, if the Road Commission determines damage is immediately being done, the Town can petition the Superior Court for relief under this restraining order and the enactment of such an ordinance. This will require time, effort, expense, and obtaining maps and affadavits by witnesses and residents. Councilman Bledsoe brought up the fact that if truck traffic were limited. on Magdalena, Stonebrook would have to carry this traffic. The Road Commissioner stated Stonebrook was in better condition to handle this extra load. ACTION: Instruct Town Attorney, Gardner Bullis, to petition the Superior Court for a relief under the Restraining Order to limit traffic on Magdalena to a 3 -ton limit. Motion: Hoefler; Second: Bledsoe; Vote: Passed. W.R. Aiken,'Magdalena, pointed out the urgency of doing something about this road, as trucks go on the wrong side to get around. a bad portion, which is a blind corner.-,_lso, flying pieves of the surface has damaged cars parched on Magdalena. Don Hibner, Road Commissioner, explained Magdalena has not been repaired because the sub -grade has not dried out and any repair would not hold. Mr. James Wilson, Magdalena, suggested that DANGER signs be erected to notify motorists that the road is in bad condition. Mr. Gutt, Summerhill, suggested that the Town should be willing to spend a few hundred dollars to fix the bad holes temporarily.- 4W emporarily. 4W _3_ -4 - ACTION: Ask the Town Attorney to obtain the identification of trucking concerns using Magdalena and look to them for any payments for continued use of the road. names of these concerns will have to be obtained from residents on Magdalena. Motion: Bledsoe; Second: Hoefler; Vote: Passed 3. Free_aV Committee Report - Councilman J.M. Fowle. There will be a meeting on the proposed freeway, 14ed.nesday, May 23, 1957, at 8:00 P.M., Town Hall, 26379 West Fremont, Los Altos Hills. Two representatives from the Engineering Division and one Right -of -Tway Agent from the State Division of Highways will be present. Mr. Fowle reported on a meeting held May 15, 1957, at the Town Hall, which was held to discuss the proposed freeway. Present were Council and Commission members, Traffic Study Committee, Freeway Committee, Road Com mission, Representatives of Official Town Paper, Rep- resentatives of Los Altos Hills Association, Represen- tatives of Los Altos Citizens' Committee, Cedric Macabee, and a State Engineer. The meeting was held under the auspices of the Freeway Committee. ACTION: Move the adoption of Resolution #45, requesting the State Highway Dapartment to make an engineering and cost study of another more westerly route and also the railroad right-of-way route. Motion: Fowle; Amended: Hoefler, Rothwell; Second: Rothwell; Vote: Passed. 4. Further Discussion of iolicies and Procedures - Council and Commission. Submitted by Richard Bullis, Chairman of Planning Commission. Mr. Bullis submitted a copy of Procedure for Filing a Map of Land Division in the Town of Los Altos Hills, which outlines the provisions of ordinances and the order in which maps are to be submitted for approval to the Planning Commission. Also, Mr. Bullis submitted a copy of a letter addressed to all engineers iii San Mateo and Santa Clara Counties who may be engaged for map preparation in the Town of Los Altos Hills. A copy of the above-named Procedure to be enclosed, and also a clarification of other stipulations necessary for approval. It is hoped that this letter with the attached copy of Procedure for Filing Maps will avoid future dalays and redundant effort. -4- ACTION: Adopt Resolution presenting maps Town of Los Alto Final Maps.) Colin Peters AT.pea.l Since Mr. Peter's appeal was a technical problem that must be resolved with the Planning Commission, the Council felt it could not at this time consider this appeal. 6. Hugh Monoha.n Appeal Since Mr. Monohan's appeal was a technical problem that must be resolved with the Planning Commission, the Council felt it could not at this time consider this appeal. 7. Report by Mr. Cusack - representative from Los Altos to work with City of hos Altos on proposed sewer connection from Fremont bills Subdivision to City of Los Altos facilities. �r Mr. Cusack stated he had met with Mr. Hope, Chief fir'` Administrator, City of Los Altos. The original facilities were planned with the intent of eventually serving all of Los Altos Hills. The only charges .for this sewer connection would be to the Fremont Hills Development Corporation for their initial proportionate share of putting in the lines. Anyone else in Los Altos Hills desiring extension of the sewer facilities would have to pay the sewer connecting fees. Recompense to the City of Los Altos is only through the monthly charges. At the present time, the only point of difference is that Fremont Hills wants the City of Los Altos to pay the expense of bringing -the line to ]Los Altos Hills, rather than Fremont Hills picking up the line where it now exists in Los Altos. The Council requested that Mr. Cusack present a formal written report. 8. Subdivision Ordinance #�- presentation by Richard Bullis, Chairman of Planning Commission. Mr. Bullis gave a brief outline of the history of this Ordinance, and explained that it is the result of six months study, in conjunction with the Town Engineer, Planning Commission, Road Commission, Town Attorney, Town Clerk, and Building Inspector. There have been many clarifications, and objections previously found in the Ordinance eliminated. Of particular importance -5- I. is the clarification of drainage requirements and improvements to existing roads. A flat fee will be assessed per building site, to establish an equitable basis for compati.ng costs. The next meeting of the Conncill will be a study session on the Subdivision Ordinance X35. '9. Liscensing Ordinance - Councilman nledsoe A memorandum will be submitted to the Town Attorney outlining the general ideas of the committee studying this Ordinance. 10. Ordinance #36 - Regulating the Cutting of Pavement. Attorney Gardner Bullis suggested the following a0l.ditions be made to this Ordinance: Section 1, after the word "shall" in the second line, the phrase "make any cut into or interfere with or re- move the surface of any public way or..." Section 2, line 8, after word "thereof" add a semi -colon and provided that no permit or bond shall be required from a public agency or public utility entity operating in the Town of Los Altos Hills under a franchise granted by the Town of Los :'altos Hills or from any district or entity for which express authority to lay mains without permit is specifically given by law. However, such agency, public utility or district shall be required to give at least 24 hours notice before undertaking any operations thereon. The provisions as to operations snd the obligations for restoration as hereinafter provided shall arply to such agency, public, utility or district as is setforth for other users."
