Easton Rothwell, at 7:45 F.M., Monday, March 18, 1957, at the Town Hall, 26379 gest Fremont, Los Altos Hills. ROLL CALL: PRESLfitT: Vice -Mayor Rothwell, Councilmen Fowle, Hoefler. R ABSENT: Sidney W. Treat, Leighton Bledsoe CORRESPONDENCE: 1. A letter was received from the Los Altos Hills Association stating the general purposes of the Association and its desire to serve the best interests of the Town of Los Altos Hills. The letter was signed by Richard S. Dawson, Interim Chairman. 2. Another letter was read from the General Committee r of the Los Altos Hills Association extending their greetings to the Town Council. The letter stated the Associations goal in preserving the rural - residential nature of the Town; to do this they have organized themselves into eleven natural neighborhoods. The Council acknowledged with gratefullness the receipt of these letters and the Association's goals of furthering the Town's welfare. 3. A letter was received from Fred E. Gutt referring to the petition for referendum against Ordinance No. 19 filed on October 11, 1956 and certified to be sufficient by the City Clerk on November 21, 1956. In Mr. Gutt's letter he demanded that either said Ordinance be repealed'or an election be called as required by the Provisions of Section No. 1772 of the Elections Code of the State of California. 4. In response to Mr. Fred Gutt's letter, another letter addressed to Mayor Treat was read from the City Attorney, Gardner Bullis. It is the legal opinion of Attorney Bullis that a subdivision ordinance is not under California Law and Constitution susceptible to the process of Referendum, inasmuch as the passing of such an ordinance is made mandatory by the Trap Act of California. Therefore, Attorney Bullis suggested no steps be taken under the Referendum Petition filed upon Ordinance No. 19. The City Couna:Jl was willing to abide by the City Attorney's resommen- dation. -2- v 5. A letter was read from J.H. Stedman, Planning Commissioner requesting the Council to grant a leave of absence until September 1, 195`. RECOMMENDATION: That the City Council grant a leave of absence to Mr. Stedman from Itarch 11, 1957 to September 1, 1957 from the Planning Ccmmission. Carried voice vote. I -lotion: Fowle; Second: Hoefler; Vote: Passed 6. A letter was received from N.B. Hulden, 12415 Hilltop Drive, protesting the over -use of a narrow road into his property to provide access to the Tuttle sub- division on Hilltop Drive. Since Mr. Tuttle already has received Council and Commission approval and the final map is a mr.tter of record, the City Council is unable to do anything about this complaint. 7. A memorandum was received from Charles S. McCandless, City Engineer, stating that his office is in the process of making standard drawings for the Town showing all Town standards, and the written standards now in force will be revixed to conform with the approved drawings after adoption by the Planning Commission, City Council, and Road Commission. Also, the City Engineer.brought up the subject of the drainage study needed. The Council has authorized the City Engineer to investigate the costs of making such a study and to investigate the problem of how to raise funds to pay for it. Accordingly, various Federal and State grants and loans to cities which can be used for this purpose are under investigation. AGENDA: 1. Appointment to successor to William Simrell on the Planning Commission. The City Council will hold a Personnel Meeting shortly and a selection will be made, and then reported back to the City Council 2. Payment to S_pohr - $1,87' . . Rr,COI.U' DATI ON : Move the approval of the final payment to Holger Spohr for the final 10'1 due on the Town Hall in the sum of $1,873.53, and the City Clerk be authorized to issue the necessary warrant for payment. 3. Bills - $477.80 RECOMMENDATION: -2- Im -3 - Move the approval of these expenditures and authorize the City Clerk to issue warrants for payment. Carried voice vote. Motion: Powle; Second: Hoefler; Vote: Passed RECORD OF SURVEY MAPS: 1. Don Clark (54-56) 4 -Tu ding sites. Engineer: McKay & Somps After considerable discussion by Chairman of the Planning Commission, Richard Bullis, Fire Chief Bassett, and property owner, Don Clark, and after reading letters from City Attorney, Gardner Bullis and City Engineer, Charles McCandless, acting Mayor Rothwell made the following observation: There are several issues involved here: 1. Problem of sufficiency of the water system which is available to this land, and adequacy of the fire hydrants. 2. Mr. Clark's appeal to the Planning Commission action at its March 13th meeting, which action is not yet official because the minutes have not been approved. 3. Attorney for Mr. Clark, Mr. Frank Crist, sent a letter to the Council stating his willing- ness to have the matter referred back to the Planning Commission. Therefore, the Dori Clark Record of Survey was referred back to the Planning Commission for further study. 2. Louis Caine (51-56) Engineer: McKay & Somps vision of' one lot into four. Note was taken that this map does not have the approval of the Board of Health or the Fire Chief. The City Council is unable to take action on this map until approval has been given to the Don Clark map. Therefore, action was deferred pending action on the Clark map. 3. Don B. Harris - V-2-57- Variance RECOMMENDATION: Move that the Variance as submitted by Don Harris be granted. Carried voice vote. Motion: Hoefler; Second: Powle; Vote: Passed. 4. Reservations are still being taken for the League of California Cities dinner meeting at Rickey's on Thrusday, March 21, 19573 -at 7:30. 0 -4- RECOIZEMTDATIOPT : That the Mayor be requested to attend the League of California Cities dinner meeting at Rickey's. This matter has just been brought to the attention of the City Council. Carried voice vote. Motion: Hoefler; Second: Towle; Vote: Passed. ?. Amendments to Ordinace1. ORDIPtAPICE n # The following amendments to Ordinance §31 AMENDMENTS were presented by the City Attorney, Gardner Bullis: a)Introduction to read: An Ordinance of the Town of Los Altos Hills providi:g for the licensing for Revenue of all business, as defined therein, within the City and establishing procedures for the collection thereof and authorizing legal action for collection when necessary. b)Section 13-2 c Delete City Clerk and add City inspector of Buildings and Public Works. e)Section to read: Every erson shall, except as otherwise provided in this Ordinance before engaging in, conducting, transacting or carrying on any business with the Town of Los Altos Hills, pay a fee for revenue only to said City and receive a receipt and license for such business. No person use any vehicle, premise, -4- -5 - device or machinery in connection with business without such fee and license. Any such license must be kept in effect in conformity with this ordinance and such license shall not be connected with regulation but the fee thereof imposed for revenue only and collection processed by court action in event of non-payment. d)Sec_ tion 13 12: Delete (b) and (c). e)Sec_ tion 13___-20_: to read: There has been heretofore established in the Town of Los Altos Hills the position of Building Inspector. The Building Inspector of the Town of Los Altos Hills shall be responsible for the enforcement of this . ordinance And shall issue all permits as provided. REC0HMMATI ON : Move the adoption of the amendments just reviewed and recorded to Ordinance x`31. The above recommendation was moved by Councilman Fowles seconded by Councilman 11oefler, and kw carried by the following vote: ROLL CALL: AYES: Councilmen Fowles Hoefler, Acting -Mayor Rothwell.
