HomeMy WebLinkAbout10/29/1956CITY COUNCIL TOWN OF LOS ALTOS HILLS MINUTES OF ADJOURNED MEETING OCTOBER 29, 1956 The meeting was called to order at 8 otclock P. M., Monday., at Purissima School. ROLL CALL: Present - Councilmen Bledsoe, Dungan, Fowle, Rothwell Absent - Mayor Treat The maps of Roy Gover, Mr. Hannibal, Mr. Weege were rejected not being complete. ORDINANCE N0. 211, abandoning San Antonio Avenue, was presented for its second reading. Upon motion of Councilman Bledsoe, seconded by Councilman Rothwell, was carried by voice vote that further reading of this ordinance be waived. Ordinance No. 24 was moved for adoption by Councilman Bledsoe, seconded by Councilman Fowle and passed by the following vote: AYES: Councilmen Bledsoe, Dungan, Fowle, Rothwell NOES: None ABSENT: Mayor Treat The Council set the hearing on the abandoning of San Antonio Avenue on December 1, 1956, at 9:30 A. M., and instructed the clerk to post the necessary notices. Councilman Rothwell reported that the Library Board would appear before the Council at its December lst meeting. Ord. #2 - Abandon- ing San Antonio Avenue. Councilman Rothwell reported on the change of name Report on Name of Los Altos Hills and asked for a larger committee; Change of Town was instructed by the Vice Mayor and the Council to pick his own committee. 09 City Clerk Paulman reported to the Referendum Petition Committee consisting of Councilmen Bledsoe, Fowle and Rothwell reading a letter from Registrar of Voters Tarleton. Also stated t1m t he could not certify the names as he had not checked them personally. Mr. Tarleton advised that he allowed no one but employees to check the records. Councilman Rothwell read sections of the Election Code where it stated that it was the responsibility of the City Clerk to check all names personally and said that he feels it is not compulsory for the City Clerk to certify the names on the petition. Councilman 1'owle suggested that the Council act on the petition at once and that he was not looking for technicalities. Councilman Bledsoo read Chapter 1.709 of the Election Code and commented that the law is clear. Vice Mayor Dungan suggested that they read the Code to the Registrar of Voters, Mr. Tarleton, and ask him to allow the City Clerk to check the referendum petition against the no -ries in the affidavit books. Vice Mayor Dungan asked City Clerk Paulman if he would certify the validity of the names on the referendum petition, but was advised that he had not seen the records so he could not certify the validity of the signatures. It was moved by Councilman Bledsoe, seconded by Councilman Fowle that the Council accept the referen- dum petition against Ordinance No. 19. After con- siderable discussion from the floor, Mr. Wilson, quoting Chapter 1709, suggested that the petition should not be filed. He also claimed that a techni- cality cannot be waived and the burden should be placed on the people who brought in the petition rather than the Council proving it was invalid. Councilman Bledsoe asked to withdraw his motion and Councilman Fowle asked to withdraw his second. Vice Mayor Dungan asked for authority to contact Mr. Tarleton to get the City Clerk access to the records. It was moved by Councilman Rothwell, seconded by Councilman Bledsoe and carried by voice vote granting this authority. Council Minutes - 2 - 10-29-56 A letter from the Fremont Development Company asking permission to erect sales offices was referred to the Planning Commission. A report from Chief of Police McKenna was made stating that he has eight (8) signs ready to put up and that the Auto Club representative will be in Los Altos Hills Thursday morning, November 8th. A report from Councilman Rothwell in regard to amend- ments to Ordinance No. 17 will probably be ready at the next meeting. Vice Mayor Dungan asked Chief of Police McKenna to have Sheriff Hawley appear at the next meeting and present his Firearms Ordinance. There being no further business, the meeting was ad- journe d.
