Roll Call Present: Council Member Mordo, Council Member Radford, Vice Mayor Waldeck, and Council Member Summit; Mayor Larsen (joined the meeting at 3:20 p.m.) Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Debbie Pedro, City Engineer/Public Works Director Richard Chiu, and City Clerk Deborah Padovan; Consultant Planner Cynthia Richardson (joined the meeting during the open session) CLOSED SESSION A. CLOSED SESSION: CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Pursuant to Government Code Section 54956.9(a)) Existing Litigation: Linebarger v. Town of Los Altos Hills ADJOURN TO CLOSED SESSION REPORT OUT OF CLOSED SESSION City Attorney Steve Mattas conveyed that there was no reportable action. 3:00 PM RECONVENE PUBLIC SESSION Council first considered Presentations from the Floor. 2. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the ap-enda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the aEenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for City Council Special Meeting Minutes November 30, 2012 appropriate action, which may include placement on the next available agenda. There were no presentations from the floor. 3. PUBLIC HEARING A. MORA DRIVE ANNEXATION• Hearin¢ to Consider Protests Against Annexation of Territory Designated as Mora Drive Consisting of 24 Parcels on 27.5 Acres of Residential Land in Unincorporated Santa Clara County Encompassing (Assessor Parcel Numbers: 331-14-063 331-15-014 331-15015, 331-15-016 331-15-023 331-15-036 331-15-043, 331-15-044 331-15-046, 331- 15-047 331-15-050 331-15-051 331-15-055 331-15-056, 331-15-057, 331-15- 060 331-15-061 331-15-062 331-15-021 331-16-101, 331-17-043, 331-17-056, 331-17-057 and 331-17-085); and Consider Resolution in Relation to Protests. (File No #186-12-MISC) (Staff- D. Pedro) Vice Mayor Waldeck opened the PUBLIC HEARING and called for written protests. Forrest Linebarger, Unincorporated Santa Clara County, delivered written protests. Consultant Planner Cynthia Richardson presented the staff report. Vice Mayor Waldeck again called for written protests to be presented. Vice Mayor Waldeck closed the PUBLIC HEARING. While the results were beingtabulated the Council considered the CONSENT CALENDAR. 5. CONSENT CALENDAR A. Hearing Date Regarding Appeal of Notice of Revocation of Dangerous Animal Permit DAP-2-10/Order to Remove Java from the Town of Los Altos Hills (Staff: D. Padovan) City Attorney Steve Mattas recommended that the item be removed from Consent for discussion. Council discussion ensued. MOTION MADE AND SECONDED: Council Member Radford moved to set the hearing on the appeal of the Notice of Revocation of Dangerous Animal Permit DAP-2-10/Order to remove Java from the Town of Los Altos Hills to Thursday, January 24 2012 at 5.30 p.m. (a later motion and vote changed the start time for the meeting to 5.00 p.m.) The motion was seconded by Council Member Mordo. City Council Special Meering Minutes November 30, 2012 AYES: Vice Mayor Waldeck Council Member Mordo, Council Member Radford and Council Member Summit NOES: None ABSENT: Mayor Larsen ABSTAIN: None MOTION CARRIED. The Council now returned to Item 3.A. Planning Director Debbie Pedro read the results of the protest. 7.5% of the voters and 8.33% of the land owners owning 4.86% of the assessed land value submitted protests. The protests fell below the 25% threshold. MOTION MADE AND SECONDED: Council Member Mordo moved Resolution 66-12 Ordering the Reorganization of Territory Designated "Mora Drive" Without Election as amended in Section 1 to include that five (5) written protests to the reorganization proceedings were received and the value of those protest(s) submitted Prior to the close of the protest hearing constitute 7.5% of the registered voters and 8.33% of the property owners owning 4.86% of the assessed value in the affected territory. The motion was seconded by Council Member Summit. AYES: Vice Mayor Waldeck Council Member Mordo Council Member Radford Council Member Summit NOES: None ABSENT/RECUSE: Mayor Larsen ABSTAIN: None MOTION CARRIED. Council recessed at 3:15 p.m. Council reconvened at 3:20 p.m. Mayor Larsen joined the meeting at 3:20 p.m. M City Council Special Meeting Minutes November 30, 2012 1. AGENDA REVIEW Council Member Radford questioned whether or not to move forward with making an appointment to the Planning Commission. Council discussion ensued. MOTION MADE: Council Member Radford moved to delay appointing a replacement for John Harpootlian until after the new Council has been sworn in on December 12, 2012. Motion failed due to lack of a second. 4. PRESENTATIONS AND APPOINTMENTS B. Appointment to the Planning Commission (one vacancy) Eric Clow, Los Altos Hills, stated his desire to be appointed to the Planning Commission. Kavita Tankha, Los Altos Hills, introduced herself to City Council. Council Member Radford left the meeting at 3:37 p.m. City Clerk Deborah Padovan collected the ballots and announced that Kavita Tankha received the majority of the votes. MOTION MADE AND SECONDED: Moved by Council Member Mordo to appoint Kavita Tankha to the Planning Commission for a term beginning December 2 2012 and ending June 30 2014 The motion was seconded by Vice Mayor Waldeck. AYES: Council Member Mordo Mayor Larsen Vice Mayor Waldeck, Council Member Summit NOES: None ABSENT: Council Member Radford ABSTAIN: None MOTION CARRIED. A. Appointment to the Education Committee Karen Schuster, Los Altos Hills, introduced herself to the City Council. 4 City Council Special Meeting Minutes November 30, 2012 0q MOTION MADE AND SECONDED: Vice Mayor Waldeck moved to appoint Karen Schuster to the Education Committee for a four-year term. The motion was seconded by Council Member Summit. AYES: Council Member Mordo Mayor Larsen Council Member Summer Vice Mayor Waldeck NOES: None ABSENT: Council Member Radford ABSTAIN: None MOTION CARRIED. The Council return to the CONSENT CALENDAR to amend the original motion of Item 5.A. MOTION MADE AND SECONDED: Vice Mayor Waldeck moved to amend the motion to set the hearing of the appeal of the Notice of Revocation of Dangerous Animal Permit DAP -2- 10/ Order to remove Java from the Town of Los Altos Hills to Thursday January 24, 2012 at 5:00 p.m. (an earlier motion and vote set the time as 5.30 p.m.). The motion was seconded by Mayor Larsen. AYES: Council Member Mordo Mayor Larsen Council Member Summit, Vice Mayor Waldeck NOES: None ABSENT: Council Member Radford ABSTAIN: None MOTION CARRIED. 6. COUNCIL INITIATED ITEMS A. Discussion of an Opt -in Email List for Residents to Receive Notices Regarding Various Town Meetings or Events (Vice Mayor Waldeck) Vice Mayor Waldeck presented the item. DIRECTION: Staff to prepare, for Council review and approval, a written policy for an opt -in email system and a calendar system that would be of general interest to the community. City Council Special Meeting Minutes November 30, 2012 Heather Rose, Chair of the Education Committee, Los Altos Hills, stated that she uses a Constant Contact email list for the local school. Council Member Mordo suggested bringing back to the Council at the December 12, 2012 meeting, an item regarding closing Town hall between Christmas and New Year's Day. 7. ADJOURNMENT MOTION MADE AND SECONDED: Council Member Mordo moved to adjourn. The motion was seconded by Council Member Summit.
