A. Roll Call Present: Council Member Mordo, Council Member Radford, Mayor Larsen, Vice Mayor Waldeck, Council Member Summit Absent: None Staff. City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Debbie Pedro, City Engineer/Public Works Director Richard Chiu, Administrative Services Director Yulia Rasulova, Consultant Planner Cynthia Richardson, City Clerk Deborah Padovan B. Pledge Of Allegiance The Pinewood Second Grade Girl Scouts Troop 61984 led the pledge of allegiance. 1. AGENDA REVIEW There were no changes to the agenda. 2. PRESENTATIONS AND APPOINTMENTS The Presentation of the Cities Association was heard first. B. Presentation by the Cities Association of Santa Clara County Raania Mohsen, Executive Director Raania Mohsen, Executive Director of the Cities Association, provided an overview of the history, background and priorities of the Cities Association. C. Presentation by Foothill -De Anza Community College District Betsy Bechtel, Trustee Betsy Bechtel, Trustee, Foothill De-Anza Board of Trustees, introduced guests 440, and presented an overview of the District's latest initiatives and projects. City Council Regular Meeting Minutes October 18, 2012 A. Presentation by Applied Materials for the "Silicon Valley Turkey Trot" Aditi Goel, Silicon Valley Leadership Group, invited participation in a community event on November 22, 2012, the Eighth Annual Applied Materials Silicon Valley Turkey Trot. D. Community Relations Committee Annual Report Roger Burnell presented the Community Relations Committee Annual Report. The Council now considered item 10.A. 10. A. Consideration of a Motion Confirming Support of No on Measure M (Mayor Larsen Mayor Larsen requested Raania Mohsen to summarize the Cities Association's position on current measures. Raania Mohsen, Executive Director of the Santa Clara County Cities Association, stated the Cities Association supported local Measure B, opposed local Measure M, and supported Proposition 39. Mayor Larsen began the discussion regarding Measure M. Gary Kalbach, El Camino Hospital Governance Committee, stated there are no endorsements supporting Measure M. Council discussion ensued. MOTION SECONDED AND CARRIED: Moved by Council Member Radford, seconded by Council Member Mordo and passed unanimously to state that the Los Altos Hills City Council supports a No vote on Measure M. 3. CONSENT CALENDAR MOTION MADE AND SECONDED: Moved by Vice Mayor Waldeck, seconded by Council Member Mordo and passed unanimously to approve the CONSENT CALENDAR Items 3.A through 3.G specifically: A. Approval of Meeting Minutes: City Council Special Meeting - September 20, 2012 B. Approval of Meeting Minutes: City Council Regular Meeting - September 20, 2012 2 City Council Regular Meeting Minutes October 18, 2012 C. Review of Disbursements: September 1, 2012 -September 30, 2012 $674,726.73 D. Resolution 60-12 Accepting Grant Open Space Easement; LANDS OF MAD MANOR II, LLC; 27641 Purissima Road (Staff: D. Pedro) E. Notification of Fast Track Approval: LANDS OF EAGLE; 12230 Windsor Court: File #137-12-ZP-SD; A request for a Site Development Permit for a 29 square foot single story addition (Maximum height 23') and major interior remodel. CEQA review: Categorical Exemption per Section 15303(a) (Staff: D. Pedro) F. Adoption (Second Reading) of Ordinance 542 Amending Title 2, Chapter 6 - Conflict of Interest - of the Los Altos Hills Municipal Code (Staff: D. Padovan) G. Approving the Wild Plum Lane Sewer Force Main Extension Project and Sewer Reimbursement Agreement (Staff. R. Chiu) 4. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subject not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the Citv Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a_Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. There were no presentations from the floor. 5. ONGOING BUSINESS A. Town Goals 2012 - Personal and Public Safety for All Residents 1. Public Safety Resort by Captain Kenneth Binder Rick Sung, Lieutenant, Santa Clara County Sheriffs Office, introduced himself to the City Council and informed the Council that Captain Kenneth Binder will make a presentation at the City Council meeting of November 15. Council discussion ensued. No action was taken. City Council Regular Meeting Minutes October 18, 2012 6. PUBLIC HEARING A. MORA DRIVE ANNEXATION• Hearing to Consider Adoption of a Resolution to Approve Annexation for the Unincorporated Mora Drive Area Consisting of approximately 24 unincorporated parcels Bounded by the Town of Los Altos Hills to the West Encompassing (Assessor Parcel Numbers: 331-14-063, 331-15-014, 331-15015 331-15-016 331-15-023 331-15-036 331-15-043 331-15-044 331- 15-046 331-15-047 331-15-050 331-15-051 331-15-055 331-15-056 331-15- 057 331-15-060, 331-15-061 331-15-062 331-15-021, 331-16-101 331-17-043, 331-17-056, 331-17-057 and 331-17-085). (Staff. D. Pedro) Mayor Larsen stated that the annexation area is within 500 feet of his property. He then recused himself and stepped down from the dais. Council recess 7:25 p.m. Council reconvened at 7:30 p.m. Ex Parte Communications. Council Member Radford said that he had no contact with the neighborhood. Council Member Summit stated that she drove up and down the street to get a better perspective and she spoke with Mr. Klein; Council Member Mordo had no contact with the neighborhood; Vice Mayor Waldeck reported that he had a request to meet, but did not do so. Vice Mayor Waldeck outlined the process for public comment and allowed for equal time on different points of view. City Attorney Steve Mattas asked if there was anyone in the audience in favor of the annexation that desires more than two minutes to make a presentation. No member of the audience requested more time. Consultant Planner Cynthia Richardson presented the staff report. Vice Mayor Waldeck opened the PUBLIC HEARING. Forrest Linebarger, Unincorporated Santa Clara County, made a presentation and responded to questions from the City Council. Vice Mayor Waldeck opened the PUBLIC HEARING to comments in favor of the annexation. Rob Fagan, Unincorporated Santa Clara County, spoke in support of the annexation. Peter McSweeney, San Antonio Hills Homeowners Association, Los Altos, spoke in support of the complete, as proposed annexation of this area to the Town City Council Regular Meeting Minutes October 18, 2012 of Los Altos Hills, provided the zoning enforcement remains and results in status quo density. Hal Feeney, Unincorporated Santa Clara County, urged the Council to make decisions to protect the integrity of the neighborhood. Esther John, Unincorporated Santa Clara County, spoke in support of the annexation to preserve the rural character of the neighborhood. David Kehlet, Unincorporated Santa Clara County, urged the Council to move forward with the annexation. Joseph Vanden Wymelengerg, Unincorporated Santa Clara County, spoke in support of the annexation. Enrique Klein, Unincorporated Santa Clara County, said that he and his wife vigorously support the annexation. Edward Cristal, Unincorporated Santa Clara County, spoke in support of the annexation. David Crockett, Unincorporated Santa Clara County, spoke in support of the annexation. Aart De Geus, Unincorporated Santa Clara County, spoke in favor of the annexation. Jitze Couperus, Los Altos Hills, spoke about the rules of merging parcels not conforming to minimum standards. Vice Mayor Waldeck closed the PUBLIC HEARING. Council recessed at 8:45 p.m. Council reconvened at 8:57 p.m. Council discussion ensued. City Attorney Steve Mattas requested more time to review the issues raised and the agreements referenced, and suggested continuing the public hearing to a date certain. MOTION MADE AND SECONDED: Council Member Mordo moved to continue the Public Hearing to Wednesday October 24 2012 at 4:00 p.m. The motion was seconded by Council Member Radford. Vice Mayor Waldeck announced that the Protest Hearing will take place on November 30 at 3 p.m. in the City Council Chambers. Mayor Larsen returned to the dais. 7. NEW BUSINESS A. Resolution to Reclassify Maintenance Superintendent to FLSA-Exempt, Amend Salary Schedule for Maintenance Superintendent and Amend Personnel Rules and Regulations to Reflect FLSA-Exempt Status (Staff. Y. Rasulova) Administrative Services Director Yulia Rasulova presented the staff report. Council discussion ensued. MOTION SECONDED AND CARRIED: Moved by Council Member Mordo, seconded by Council Member Summit and passed unanimously to adopt Resolution ^61 12 Revising Job Class Specification for the Maintenance Superintendent Position and Amend the Town's Classification and Compensation Plan and Personnel Rules to Reflect the New Salary Range and FLSA Executive Exemption. B. Resolution to Amend the Town's Classification and Compensation Plan, Senior Engineer Job Class Specification (Staff: Y. Rasulova) Administrative Services Director Yulia Rasulova presented the staff report. Council discussion ensued. MOTION MADE AND SECONDED: Moved by Council Member Mordo, seconded by Vice Mayor Waldeck and passed unanimously to adopt Resolution 62- 12 Revising the Salary Schedule for the Senior Engineer Job Class to Reflect the Current Market for Similar Positions. 8. REPORTS FROM COMMITTEES SUB -COMMITTEES AND COUNCIL + MEMBERS ON OUTSIDE AGENCIES City Council Regular Meeting Minutes October 18, 2012 Vice Mayor Waldeck provided an update on the activities of the Open Space Committee. Council Member Summit updated the City Council on the activities of the History Committee. She encouraged sending nominations to the Joint Volunteer Awards Committee as the nomination period is now open. Mayor Larsen received a request from Los Altos Village Association to present to the City Council their plans for promoting the downtown area of Los Altos. 9. STAFF REPORTS A. City Manager B. City Attorney C. City Clerk D. Planning Director No reports were presented. 10. COUNCIL INITIATED ITEMS B. Consider Donating Pedestrian Crosswalk Signs (Mayor Larsen) Mayor Larsen explained that the Town had a very well -lit pedestrian crosswalk sign that was taken down at the request of the neighbors. He suggested donating the surplus pedestrian crosswalk sign to another agency. MOTION MADE AND SECONDED: Moved by Council Member Radford, seconded by Vice Mayor Waldeck and passed unanimously to donate the pedestrian crosswalk sign to another agency. C. Consideration of the LASD Request to Participate on the Superintendent's Enrollment Growth Task Force (Council Member Radford Council Member Radford presented the item. Courtenay Corrigan, Council Member -Elect, Los Altos Hills, stated that she would be happy to work with Council Member Radford to suggest some names for the Task Force. DIRECTION: Delegate the selection of a resident to Mayor Larsen and Council Member Radford. Council Member Radford provided an update of the Los Altos School District Cross - Complaint and the Education Committee, respectively. 7 City Council Regular Meeting Minutes October 18, 2012 MOTION MADE: Moved by Council Member Mordo to reconsider and not appoint anyone to the Los Altos Hills School District Task Force. Motion failed due to lack of a second. DIRECTION: Council Member Radford will continue to make a recommendation regarding the Task Force. However, the appointment, and whether the Council moves forward, will be discussed at the regular City Council meeting on November 15, 2012. Additionally, the future of the Education Committee will be heard at the City Council meeting of November 15, 2012. 11.
