CALL TO ORDER (7:00 P.M.) A. Pledge Of Allegiance 1. AGENDA REVIEW There were no changes to the agenda. 2. PRESENTATIONS AND APPOINTMENTS A. Los Altos Library Commission Report, by David Struthers and Cathie Perga Cathie Perga and David Struthers, Members of the Los Altos Library Commission provided an annual report to the City Council. B. Presentation by the Los Altos Rotary Regarding Child AIDS Prevention, an Initiative of the Los Altos Rotary AIDS Project featured in the May 2012 Rotarian Magazine, by Bill Balson Bill Balson, Member of the Los Altos Rotary Club, provided a presentation regarding child AIDS prevention. 1 City Council Regular Meeting Minutes May 17, 2012 C. History Committee Annual Report Jitze Couperus, Member of the History Committee, provided the City Council with a report on the activities of the committee. Council discussion ensued. No action was taken. D. Open Space Committee Annual Report Roger Spreen, Chair of the Open Space Committee, provided the City Council with a report on the activities of the committee. At this point the City Council heard Public Hearing Item 6.B. 6. PUBLIC HEARING B. INITIAL STUDY AND NEGATIVE DECLARATION FOR THE ARASTRADERO TRAIL IMPROVEMENT PROJECT; FILE # 269-11 -MISC. Project includes the restoration of existing_ pathways, construction of new pathways and bike lane striping. The project area begins at the intersection of Arastradero Road and Purissima Road; continue along Arastradero Road under the I-280 freeway to Page Mill Road; continue along Page Mill Road to the intersection of Baleri Ranch Road/Arastradero Road; and ends at the Los Altos Hills Town boundary on Arastradero Road west of Tracy Court. CEOA Review: Mitigated Negative Declaration (Staff. D. Pedro). Planning Director Debbie Pedro and City Engineer/Public Works Director Richard Chiu jointly presented the staff report. Council discussion ensued. Mayor Larsen opened the PUBLIC HEARING. Breene Kerr, Los Altos Hills, spoke in favor of the project and hopes that the committee, staff and Council can move on to other pathway projects. Kyle Matthys, Los Altos Hills, said that everyone in his home is thankful for this project and the bike path. Skyla Deeter, Los Altos Hills, stated that she wanted the bike path as it would be "really cool" to bike to places. 2 City Council Regular Meeting Minutes May 17, 2012 Logan Deeter, Los Altos Hills, stated that he plays baseball at Purissima Park and it would "be cool to bike to Purissima." Bailey Deeter, Los Altos Hills, told Council that having a bike path would make riding to school much easier. Robert Chao, Los Altos Hills, stated that he is a frequent user of Arastradero Road and spoke about concerns relating to graffiti and the thought that most people won't use the bike path as many bicyclists use the road. Dru Anderson, Los Altos Hills, spoke in favor of the project. Martha Bowden, Los Altos Hills, said she would like to applaud the Planning Commission in their creative approach in suggesting that staff move the road to minimize the height of the wall. Edwina Cioffi, Los Altos Hills, stated that the people do appreciate the work that is being done. Ron Cioffi, Los Altos Hills, expressed concerns about the back up of cars on Page Mill and Baleri Ranch Road. Richard Steinberg, Los Altos Hills, stated that this project should be moved forward. Mayor Larsen closed the PUBLIC HEARING. Further Council discussion ensued. Jim Inglis, Stanford, stated that the project has been a moving target and Stanford hasn't prepared an updated budget. They do have additional work on Arastradero to complete due to lane configuration. CEQA Review: Mitigated Negative Declaration. City Council Regular Meeting Minutes May 17, 2012 The Council now heard Item 2.E. 2. PRESENTATIONS AND APPOINTMENTS E. Appointment of Council Liaison to the Los Altos Hills County Fire District Vice Mayor Waldeck nominated Council Member Mordo as the liaison to the Los Altos Hills County Fire District. Council Member Mordo requested that the record state that he has not nominated himself; however, he accepted the nomination. MOTION SECONDED AND CARRIED: Moved by Vice Mayor Waldeck, seconded by Council Member Radford and passed unanimously to appoint Council Member Mordo as the Council Liaison to the Los Altos Hills County Fire District. 3. CONSENT CALENDAR MOTION MADE AND SECONDED: Moved by Council Member Summit, seconded by Vice Mayor Waldeck and passed unanimously to approve the CONSENT CALENDAR Items 3.A through 3.L specifically: ow A. Approval of Meeting Minutes: City Council Regular Meeting - April 19, 2012 B. Review of Disbursements: April 1, 2012 - April 30, 2012 $363,102.33 C. Resolution No. 17-12 Authorizing Agreement with William Avery & Associates, Inc. for Recruiting Services and Project Management (Staff. C. Cahill) D. Resolution No. 18-12 Authorizing Agreement with MRG Consultants for Municipal Financial Services and Project Management (Staff: C. Cahill) E. Adoption (Second Reading) of Ordinance 538 Repealing Article 5 of Title III. Chapter 3, of the Los Altos Hills Municipal Code, Titled "Roadway Impact Fee Fund." (Staff. R. Lee) I. Resolution No. 20-12 Accepting Dedication of Right -of -Way; Lands of Zeev 26493 Weston Drive (Staff. R. Chiu) J. Resolution No. 21-12 Awarding Contract to American Asphalt, Inc. to Construct Asphalt Concrete Ramps along both Purissima and Robleda Roads (Staff. R. Chiu) K. Notification of Planning Commission Approval: LANDS OF MORGAN; 13209 West Sunset Drive; File #59-11-ZP-SD-GD; A request for a Site Development Permit for a 3,885 square foot two story new residence with a 2,143 square foot basement (maximum height 24'6"), a 999 square foot single story detached secondary dwelling unit with a 999 square foot basement (maximum height 16'), and the removal of one (1) 26.4" heritage oak tree located along the south side of the driveway/backup area. Notification of Planning Commission Approval: LANDS OF SHARP AND HARRIS, 26958 Dezahara Way; File #283-11-ZP-SD-GD; Appeal of a Site Development approval of a 4,981 square foot two-story new residence with a 2,035 square foot basement (Maximum height 268") and a 592 square foot swimming pool. CEQA Review: Categorical Exemption per Section 15303 (a)&(e) (Staff -Brian Froelich). 4. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Nancy Couperus, Los Altos Hills, reminded everyone of two events coming up: the SOD Blitz on May 26 and the Silicon Valley Watershed Summit on September 22. Bill Behn, Los Altos Hills, stated that he is an immediate neighbor of Mr. Scher and Ms. Stark who hold two dangerous animals under Town dangerous animals permits despite 15 months of permit violations. Kathy Evans, Los Altos Hills, reminded everyone that the Town picnic is on June 3. Council Recess 9:00 p.m. Council Reconvened to Open Session at 9:10 p.m. 5 City Council Regular Meeting Minutes May 17, 2012 At this point the Council heard Item 6.A. 6. PUBLIC HEARING A. Consideration of Proposed Amendments to the Lighting Policy; File # 302-11- MISC; the proposal would update and remove outdated language in the policy concerning Design Guidelines and the Fast Track Guide and include requirements for sports courts and swimming pools. CEOA Review: Exempt per Section 15061(b)(3) (Staff: D. Pedro) Planning Director Debbie Pedro presented the staff report. Mayor Larsen opened the PUBLIC HEARING. Nick Dunckel, Los Altos Hills, stated that most houses in Los Altos Hills are tastefully lighted. However, there are some whose lighting stands out. He hoped the amendment had "more teeth" and not just recommendations. Dru Anderson, Los Altos Hills, stated that the fire and police would like to be able to see the house numbers at night. At this point, the Council heard Item 10.A. 10. COUNCIL INITIATED ITEMS A. Request from Hidden Villa for Funds to Support 2012 Community Events (Council Member Radford) Marc Sidel, Associate Director at Hidden Villa, Mountain View, thanked the Council for the generous support of Hidden Villa over the past six years and requested additional funds for the programs this year. Council discussion ensued. City Council Regular Meeting Minutes May 17, 2012 MOTION MADE AND CARRIED: Moved by Council Member Radford, seconded by Council Member Summit to approve the request from Hidden Villa for $10,000 to Support 2012 Community Events. DIRECTION: Council directed Hidden Villa to return in July in order to be placed on the regular community services grant schedule. B. Discussion on the Formation of an Ad Hoc Committee to Review Purissima Hills Water District (Council Member Summit) Council Member Summit introduced the discussion of forming an ad hoc committee to review Purissima Hills Water District to fully address the residents' concerns. John Harpootlian, Los Altos Hills, stated that he liked the direction of the discussion and found it to be productive. Ernest Solomon, Director of Purissima Hills Water District, Los Altos Hills, explained the difference between Purissima Hills Water District and Cal Water. Brian Holtz, President of the Purissima Water District, Los Altos Hills, echoed that an information exchange is positive. Gary Kremen, Director of Purissima Hills Water District, Los Altos Hills, stated that he is personally supportive of an ad hoc committee. DIRECTION: Council Member Radford and Vice Mayor Waldeck to meet to discuss what the goals and structure of the water ad hoc committee would be and return to the City Council in June to share the findings. C. Discussion on Merits of Term Limits for the Planning Commission (Council Member Mordo) Council Member Mordo presented the discussion of term limits for the Planning Commission. John Harpootlian, Los Altos Hills, stated that when he was first appointed to the Planning Commission, the incumbent was not reappointed. Further he expressed that the Council does have the ability not to reappoint an incumbent. Eric Clow, Los Altos Hills, stated that when he was last reappointed to the Planning Commission, it was a unanimous decision by the City Council. Eric Ramberg, Los Altos Hills, stated that the fundamental problem is not commissioners serving too many terms — the problem is attracting qualified applicants. 7 City Council Regular Meeting Minutes May 17, 2012 IM Kjell Karlsson, Los Altos Hills, informed the Council that in the last two years he has been to all the Planning Commission meetings gavel to gavel and that the amount of work that the commissioners put in is "amazing." Richard Partridge, Los Altos Hills, noted that he has no problem with term limits on the Planning Commission, but asked for clarification on what happens when a planning commissioner takes over mid-term. Council discussion ensued. DIRECTION: Agendize for a future meeting to have a formal discussion for term limits. For the upcoming appointments in June 2012, the Council will give preference to new applicants. At this point the Council returned to Item S.A. 5. UNFINISHED BUSINESS A. Town Goals 2012 - Personal and Public Safety for All Residents 1. Update on the Fremont Bike Path/Safe Routes to School (VERBS) (Staff. R. Chiu) Public Works Director Richard Chiu provided an update on the Fremont Bike Path Project. 2. Silicon Valley Bicycle Coalition with a Focus on Share the Road (Council Member Summit Mayor Larsen provided an update of the Silicon Valley Bicycle Coalition activities. 3. Ongoing CERT Programs (Vice Mayor Waldeck) Vice Mayor Gary Waldeck provided an update on the CERT program. 4. Buena Vista Intersection (Staff: R. Chiu) Public Works Director Richard Chiu provided an update on the Buena Vista Intersection. Eric Ramberg, Los Altos Hills, stated that the mirror is a temporary fix and encouraged Council to focus on fixing the embankment. 8 City Council Regular Meeting Minutes May 17, 2012 At this point the Council returned to Item 7.A. 7. NEW BUSINESS A. Town Newsletter Editorial and Production Services (Staff: D. Padovan) City Clerk Deborah Padovan presented the staff report. Council discussion ensued. Duffy Price, Los Altos Hills, brought out that there is a lot of volunteer effort that goes into the Newsletter and the Council should continue having Alex prepare the Newsletter. Alexander Atkins, Los Altos Hills, stated that it has been a privilege to step into the shoes that Duffy wore for sixteen years. Further, he said that the editor of "Our Town" is an ambassador to the Town. Further Council discussion ensued. MOTION SECONDED AND CARRIED: Moved by Council Member Radford, seconded by Vice Mayor Waldeck and passed unanimously to approve one additional newsletter to be completed by Alexander Atkins Design and concurrently procure additional bids for comparison The bids shall include editorial services, editing services and printing services The results of the bids will return to Council for review. B. Formation of an Ad Hoc Committee to Develop a Comprehensive Policy with Regard to Private Street Maintenance (Staff: R. Chiu) Public Works Director Richard Chiu presented the staff report. Council discussion ensued. DIRECTION: Council Members Ginger Summit and Jean Mordo along with Kjell Karlsson will form an ad hoc committee in order to develop a comprehensive policy regarding private street maintenance. 8. REPORTS FROM COMMITTEES, SUB -COMMITTEES, AND COUNCIL MEMBERS ON OUTSIDE AGENCIES Council Member Radford provided a report on meeting with two members of the Los Altos School Board. 9.
