Roll Call Present: Mayor Waldeck, Vice Mayor Radford, Councilmember Corrigan, Councilmember Harpootlian, Councilmember Larsen Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Debbie Pedro, City Engineer/Public Works Director Richard Chiu, Administrative Services Director Yulia Rasulova, Associate Planner Brian Froelich, City Clerk Deborah Padovan B. Pledge of Allegiance — Girl Scouts Troop 60089 presented the colors and led the pledge of allegiance. 1. AGENDA REVIEW 2. PRESENTATIONS AND APPOINTMENTS A. Recognition of the Los Altos Hills Horseman's Association 2013 Art and Essay Awards Finalists Jolon Wagner, Los Altos Hills Horseman's Association, explained the contest and presented the finalists. The Los Altos Hills City Council recognized the Art and Essay finalists. B. Presentation by Los Altos Mayor Jarrett Fishpaw on Crossing Guards at Foothill Expressway and W. Edith Avenue 1 City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) Los Altos Mayor Fishpaw was unable to attend the City Council meeting. C. Presentation by Mike Sanders on the Activities of CERT and the Los Altos Hills County Fire District and the Swearing -In of new CERT Members Mike Sanders, Los Altos Hills County Fire District, introduced the current class of CERT members. Deborah Padovan, City Clerk, administered the oath of office to the CERT members. D. Presentation by Bill Almon Regarding the Status on Lehigh Quarry Bill Almon provided an update on the progress of reduction of air emissions and water quality at the Lehigh Quarry. Council discussion ensued. No action was taken. E. Oven Space Committee Annual Report Roger Spreen, Chair of the Los Altos Hills Open Space Committee, presented the annual report on the activities of the committee. Councilmember Larsen said that he would like to see the Open Space Committee come up with a plan for the O'Keefe Preserve. Further Council discussion. No action was taken. F. Reappointment to the Environmental Initiatives Committee MOTION MADE AND SECONDED: Moved by Vice Mayor Radford, seconded by Councilmember Harpootlian and passed unanimously to reappoint Peter Evans to the Environmental Initiatives Committee for a four-year term. At this point the City Council now returned to item 2.13. B. Presentation by Los Altos Mayor Jarrett Fishpaw on Crossing Guards at Foothill Expressway and W. Edith Avenue Mayor Waldeck outlined the request from Los Altos Mayor Fishpaw and stated that the presentation would be rescheduled. Heather Rose, Chair of the Los Altos Hills Education Committee, provided an overview of the intersection. 2 City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) Jim Abraham, Los Altos Hills, stated that "this is a solution really begging for a problem." He did not support the proposal to hire crossing guards at the intersection. Val Carpenter, Los Altos Councilmember, stated that Los Altos requested a joint meeting and this topic will be discussed. Steve Thomas, Los Altos, stated that he has a first grader at Gardner Bullis School and the crossing at Edith and University makes him very nervous. Council discussion. No action was taken as the topic would be rescheduled. 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Val Carpenter, Los Altos City Councilmember, requested a financial contribution of $2,500 from the Town to assist in paying for reusable bags. DIRECTION: The Council directed staff to put an item on the June 20, 2013 City Council meeting agenda to discuss Los Altos Councilmember Carpenter's request. Nancy Couperus, Los Altos Hills, talked about Westwind Barn. Bill Klein, Los Altos Hills, commented on public and private roads matter and stated that "the draft ordinance is not likely to have much of an effect." 4. REPORTS FROM COMMITTEES, SUB -COMMITTEES AND COUNCIL MEMBERS ON OUTSIDE AGENCIES A. Report from the Community Relations Committee on Public Art Policy to the Town (Community Relations Committee Chair Barbara Waldeck) Barbara Waldeck, Chair of the Los Altos Hills Community Relations Committee, presented the draft Art in Public Places Policy for approval. Council discussion ensued. DIRECTION: The policy should apply only to pieces that are donated and loaned and only if it does not increase expenses of the Town. There is no need to organize a 5016. Those changes should be made and the policy brought back to Council. City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) 5. PUBLIC HEARINGS A. LANDS OF BOCK, 12403 Hilltop Drive; File #276-12-ZP-SD-GD; Appeal of the Planning Commission's decision to approve a Site Development Permit for a new 5,592 square foot two story residence with an attached four (4) car garage 3,425 square foot basement with an attached secondary dwelling unit and a 1,200 square foot swimming pool. (Maximum building height: 27') CEQA Review: Categorical Exemption per Section 15303 (a)&(e) (Staff: D. Pedro) Ex Parte Communications. Mayor Waldeck reported that he had a conversation with both Mr. Bock and Ms. Gorzynski. Councilmember Corrigan reported that she met with both neighbors. She further stated that both her children and Bock's children all attend the same school, but they are not close friends. Vice Mayor Radford reported that he met with both Mr. Bock and Ms. Gorzynski. Councilmember Larsen reported that he did not meet with either neighbor, but visited both properties and received emails from the Bocks and Ms. Gorzynski. Councilmember Harpootlian reported that he met with both Ms. Gorzynski and the Bocks. Associate Planner Brian Froelich presented the staff report. Council discussion ensued. Mayor Waldeck opened the Public Hearing. Appellant Donna Gorzynski, Los Altos Hills, presented her case to the City Council. She requested that the Council reject the Bock Family application. Roger Kohler, Architect for Ms. Gorzynski, stated that he came to the Town and looked at the plans. He found that there was no architectural site plan that showed the windows on the new house and how it relates to the rest of the property. Council asked questions of the applicant. Joanne Morris, Los Altos Hills, thought the new house could be angled differently so it wouldn't take up a view. Anka Margaretic, Los Altos Hills, stated she would be upset if someone built a house and blocked her view. She felt it was unfair if people are allowed to build a house that blocks another's view Mr. Kohler requested that the house be moved. Laszlo Bock, Los Altos, stated that they followed all of the Town's codes, were sensitive to the environment and tried to work with Ms. Gorzynski. At this point, they are ready to move forward and are willing to address any suggestions that were City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) raised. He respectfully asked that the recommendation of Town staff and the Planning Commission be upheld. Gerri Bock, Los Altos, thanked the Council and staff for their time and consideration. She stated their family is looking forward to becoming full and active members of the community. Council asked questions of Mr. and Mrs. Bock. Brian Peters, Architect for the Bocks, stated that if the second floor were to be shifted over, it would exceed the Town's height limit requirements. Council continued to ask questions of Mr. Bock. Mr. Bock addressed the request that the house be moved over 15 feet to the south. He stated that they looked at moving the house 10 feet and the following issues would occur: the basement wall would fall out of compliance; grading exceptions would be needed as the back of the envelope would go over the cubic yardage for the house; it would encroach on the water retention system and the pool would have to be redesigned; and the pathways and retaining walls would need to be redesigned. Further, he stated that the neighbor on the south side would be furious as he wants to build on the setback. Further Council discussion. Vice Mayor Radford reminded that a public hearing is going on, not a discussion. He proposed that the public be heard. Steve Bristow, Los Altos Hills, spoke in support of the project. He just wanted to make sure during construction, that the workers park their vehicles properly and that they are aware of the construction times. Eric Boyenga, Los Altos Hills, spoke in favor of the project stating that he was happy to have someone revitalize the property. Ben Gikis, Los Altos Hills, spoke in support the project. He stated the applicants did a fantastic job with outreach and design. Nador Saudi, stated that owned the land previously and sold it to the Bock family. As an owner he decided that developing the land would be too complicated and expensive. He spoke in support of the project, stating "they followed every single rule the Town gave them." Bruce Dockery, Alain Pinel Realtors, Unincorporated Santa Clara County, stated that when potential buyers are considering purchasing, advice should be given to understand to the policies and practices of the Town. He stated his support for the project. City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) Jim Abraham, Planning Commissioner, Los Altos Hills, stated that four members of the Planning Commission were absolutely taken with the design. He visited the lands of Gorzynski and saw her views and looked around the backyard and the only part where the story poles could be seen really didn't block anything, except a very distant view of the hills. Jitze Couperus, Planning Commissioner, Los Altos Hills, said he gave this project a lot of thought. He expressed that this is a really tough lot to build upon and due to extenuating issues, moving the house becomes impossible. Richard Partridge, Planning Commissioner, Los Altos Hills, voted against the project because he felt it could have been improved by moving or lowering the house. Adjustments could be made that make a difference for the neighbors. He believed that something could have been done to help the neighbors. He voted against it, but it could have addressed the neighbors' issues. Ms. Gorzynski provided a closing statement. She agreed that the new house will be an improvement over what is currently there, she just would like it not to block her view. Further she stated that her architect would be willing to work with Mr. Bock's architect. Mayor Waldeck closed the Public Hearing. Council discussion ensued. Councilmember Harpootlian requested clarification from staff on whether the Council could specify what they could ask for, such as dropping the house two feet. Planning Director Debbie Pedro said that if revised plans are submitted, they would need to be routed back to engineering and the fire department. After their review, it would go back to the Planning Commission for public review. City Attorney Steve Mattas, said the Council is dealing in an area where ultimately the Council can make the decision on what these ordinances require. The language of the ordinance provisions do provide the council with leeway. It is up to the discretion of the Council to balance the issues and come up with a decision that is appropriate and consistent with the code. Councilmember Larsen had questions on the obstructed view ordinance. He said it was clear that there is an intrusion in front of Ms. Gorzynski's house and new construction needs to be unobtrusive. He further stated that many residents would "go crazy" if someone built a house and blocked their views. He requested that it be looked at again to try to make it a win for both parties. Councilmember Corrigan stated that this is a project that meets all the Town's guidelines. The homeowners have worked diligently with staff and neighbors to come up with something that matches exactly what was requested. Ms. Gorzynski's property will give up some view, however, she has other places to enjoy a view such as the backyard and sideyard. She expressed that if the Bocks were to move the house, it would be a matter of time, before a tree grew and blocked a view. She 6 City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) stated that she was ready to support the project as it is and allow them to get busy to build the house that follows Town guidelines. Vice Mayor Radford questioned the unobstructed view by whose standards. If a homeowner is allowed to pick any part of the property and then say "that is the view that I need to protect" even when that might not be the best view, maybe we will open ourselves to more appeals. He said he has to be careful about trying to protect all the views on the property. He said if the Planning Commission was unable to come up with compromise suggestions, then there is little chance of it being done at this time. With the Planning Commission voting 4 to 1, he believed there was no other alternative than to build the house. He stated that he would support the project as everything was done right. Mayor Waldeck stated that this is "clearly a difficult decision." The Bocks have done everything they can do by looking at it from different perspectives. The project meets all the criteria and he visited both properties. He walked around Ms. Gorzynski's property and felt there were a lot of other opportunities there. Any house that is put on that site, she is going to see. If a six foot fence is placed there, he was not convinced that she would still continue to have her view. Councilmember Harpootlian stated that all possibilities should be looked at and provide mitigation by having the Planning Commission take a look at the project one more time. MOTION MADE AND SECONDED: Council Member Harpootlian moved that the project be returned to the Planning Commission with three suggested areas of change by the applicant to see if they can improve on mitigating the obtrusiveness of the property. The motion was seconded by Councilmember Larsen. AYES: Harpootlian, Larsen NOES: Waldeck, Radford, Corrigan ABSENT: None ABSTAIN: None MOTION FAILED. MOTION MADE AND SECONDED: Councilmember Corrigan moved to uphold the Planning Commission's decision to approve a Site Development Permit for a new 5,592 square foot two story residence with an attached four (4) car garage, 3,425 square foot basement with an attached secondary dwelling unit, and a 1,200 square foot swimming pool based on the conditions of approval. B. AMENDMENT TO THE ZONING ORDINANCE WITH REGARD TO THE DEFINITION OF "FAMILY" (Section 10-1.202 of the Los Altos Hills Municipal Code) In accordance with Fair Housing Law, amendment of the definition of "family" is necessary so that there is no distinguishing between related and unrelated individuals and does not impose a numerical limit on the number of persons in a family. The proposed ordinance amendment has been deemed to be exempt from California Environmental Quality Act (CEQA) pursuant to 15061(b)(3) of the CEQA Guidelines (Staff: D. Pedro). Associate Planner Brian Froelich presented the staff report. Council discussion ensued. City Manager Carl Cahill stated that state law is requiring this wording be put into place. In the last housing element update it was found to be deficient. If the Town has provisions that are not compliant, it opens the Town up to a challenge. Councilmember Harpootlian asked about Poor Clares and how they exist with this ordinance. City Manager Cahill stated that Poor Clares has a conditional use permit and they are not viewed as a single family residence, but as an institutional use. Mayor Waldeck opened the Public Hearing. Seeing no one wishing to speak, Mayor Waldeck closed the Public Hearing. MOTION SECONDED AND CARRIED: Moved by Councilmember Corrigan, seconded by Councilmember Larsen and passed unanimously to Waive reading and introduce the ordinance amending Section 10-1.202 of the Los Altos Hills Municipal Code; AMENDMENT TO THE ZONING ORDINANCE WITH REGARD TO THE DEFINITION OF "FAMILY". C. AMENDMENT TO THE ZONING ORDINANCE TO INCLUDE TRANSITIONAL AND SUPPORTIVE HOUSING IN THE R -A (RESIDENTIAL - AGRICULTURAL) ZONING DISTRICT AS AN ACCESSORY USE (Section 10-1.702 of the Los Altos Hills Municipal Code) In City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) accordance with Senate Bill 2 jurisdictions are required to regulate transitional and supportive housing as a type of residential use subject only to those restrictions that apply to that type of residential use in the same zone. Transitional and supportive housing, of up to six 6 persons per parcel would be a permitted accessory use in the R -A zone The proposed ordinance amendment has been deemed to be exempt from California Environmental Quality Act (CEQA) pursuant to 15301 and 15303(a) of the CEQA Guidelines (Staff: D. Pedro) Associate Planner Brian Froelich presented the staff report. City Attorney Steve Mattas said that a senate bill is driving the change as a State law requirement. The ordinance before the Council does not violate the Town's zoning ordinance. It allows unrelated adults to live together in the same house. The courts have said that the cities can articulate between related and unrelated adults. One example where this might be seen is in a retirement home arrangement. The ordinance does change zoning. However, the Town does not lose any of the rights of our zoning ordinance. Mayor Waldeck opened the Public Hearing. Carol Gottlieb, Los Altos Hills, asked if the Town could self -certify. She reported what happened in Los Altos with 6 family dwellings. 4W Jim Jim Abraham, Planning Commissioner, Los Altos Hills, stated that he initially found the topic distasteful, but then after having a conversation with the Planning Director, it occurred that if the item was not passed, we could be painting a target on our back and probably lose in court. Mayor Waldeck closed the Public Hearing. MOTION SECONDED AND CARRIED: Moved by Councilmember Corrigan, seconded by Councilmember Harpootlian and passed unanimously to waive reading and introduce the ordinance amending Section 10-1.702 of the Los Altos Hills Municipal Code; AMENDMENT TO THE ZONING ORDINANCE TO INCLUDE TANSITIONAL AND SUPPORTIVE HOUSING IN THE R -A (RESIDENTIAL — AGRICULTURAL) ZONING DISTIRCT AS AN ACCESSORY USE. 7. NEW BUSINESS A. Consideration of the November and December 2013 Meeting Schedules (Staff. D. Padovan City Clerk Deborah Padovan presented the staff report. City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) Mayor Waldeck stated he will be out of the country from November 9 through the 29. MOTION SECONDED AND CARRIED: Moved by Mayor Waldeck, seconded by Councilmember Larsen and passed unanimously to cancel the November 21, 2013 and December 19, 2013 regular City Council meetings and schedule special meetings on November 7, 2013 and December 12, 2013. B. Consideration of Ordinance Regulating Private to Public Road Conversion (Staff. R. Chiu Public Works Director Richard Chiu presented the staff report and outlined the requirements in the proposed ordinance. Councilmember Larsen clarified that the expectation would be that the property owners on a private road would bring the road up to the standards outlined. If they improve the road, offer it and it is accepted it would cost approximately $27,000 per centerline mile to maintain. Vice Mayor Radford questioned, if 130 streets are private, how many streets that are private right now would qualify? Director Chiu replied, "very few." Further, Vice Mayor Radford questioned, if Todd Lane was paved, would it qualify to become a public street? Director Chiu stated that the culvert pipes that would need to be brought up to standard and would require more work than simply paving the road. Vice Mayor Radford questioned, are we setting up a standard that makes it impossible to comply without a lot of investment? Director Chiu stated that regarding the geometry and pavement width, there are exceptions that property owners could request that would be up to the determination of the Council. Councilmember Corrigan questioned, why are we demanding these pullouts and are we making exceptions for narrower streets? Director Chiu replied that the pullout requirement is a direct requirement from the fire department. Councilmember Harpootlian stated that width would be an issue for some roads and there should there be a process with a prequalification step. Mayor Waldeck stated that a specific process should be outlined. Director Chiu explained that the ordinance does contain a process that states very clearly that property owners would need to consult with the Town prior to the work being done. If the City Council approves the plan, the property owners would spend the money and fix the road. Jim Abraham, Los Altos Hills, stated that people who purchased property on a public road have already paid a premium for being on that road. He said that he doesn't think the Town should be accepting a road as a public road with something that does not comply with all the standards. MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by Councilmember Corrigan and passed unanimously to prepare an ordinance for approval. The ordinance shall include design review by the Planning 10 City Council Special Meeting Minutes May 20, 2013 (6:00 p.m.) Commission. The final decision to accept a private road as a public road will be determined by the City Council. C. Memorandum from the Planning Director Regarding a Town -wide Informational Meeting on the Circulation and Scenic Roadways Element Update (Staff: D. Pedro Planning Director Debbie Pedro, presented the report and explained that a Town - wide meeting will be held on June 13, 2013 to receive comments on the draft circulation element. Council discussion ensued. No action was taken. 6. ONGOING BUSINESS A. Discussion on Amending Resolution 71-12, Establishing Standing Committees and Adopting General and Specific Rules Pertaining Thereto to Add a Section Regarding Committee Site Visits (Staff. D. Padovan) This item was not heard and continued to the next City Council meeting of Wednesday, May 22, 2013. B. Report on Formation of a 501(c)(3) Nonprofit Organization (Staff: S. Mattas) This item was not heard. C. Update on Private Road Maintenance and Consideration of Draft Ayreements (Staff: S. Mattas) City Attorney Steve Mattas presented the report along with two draft agreements that could be made available for public use. The agreements are for the property owners to get together and bring a private road to Town standards. He explained that it is similar to the sewer reimbursement agreement in that it is voluntary, which means all of the parties will have to sign in the beginning. After it is signed, any changes that may be made would require a two-thirds vote. The agreement would be binding and apply to any successors. He explained, so that everyone was aware of the structure of the agreement, that the idea behind this is that private property owners would get together and designate someone to actually serve as a road maintenance agreement agent and that person would be responsible for making sure that improvements are done by a majority of owners. It allows for an emergency repair fund so that the road agent could expend the emergency funds right away. The documents shall be made available on the Town's website. 8. Discussion on the Proposed I-280/Page Mill Road Signalization Project (Councilmember Larsen) Councilmember Larsen stated the Traffic Safety Committee has been working on the I280-signalization project. The committee will work with staff to coordinate a meeting with CalTrans, Palo Alto and the County. B. Discussion of Potentially Supporting AB 416 Creating a Local Emission Reduction Program (Mayor Waldeck) This item was not discussed as the deadline to respond was prior to the Council meeting. 11.
