Roll Call B. Pledge of Allegiance A. CLOSED SESSION: CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Pursuant to Government Code Section 54956.9(a)) Linebarger v. Town of Los Altos Hills Councilmember Larsen recused himself and left the room during the Closed Session. PUBLIC SESSION - (6:00 P.M.) Present: Council Member Harpootlian, Council Member Larsen, Mayor Waldeck, Vice Mayor Radford, Council Member Corrigan Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Debbie Pedro, City Engineer/Public Works Director Richard Chiu, Administrative Services Director Yulia Rasulova, Consultant Planner Cynthia Richardson, City Clerk Deborah Padovan REPORT OUT OF CLOSED SESSION City Attorney Steve Mattas reported that the Council provided direction, but there was no reportable action. 1. AGENDA REVIEW Councilmember Larsen requested moving item 2.1) in front of 2.C. Mayor Waldeck stated that item 3.13 has been resolved by the Los Altos City Council and will not be heard tonight. Item 9.A will be moved to the March 2013 meeting. 2. PRESENTATIONS AND APPOINTMENTS A. Appointment to the Los Altos/Los Altos Hills Senior Commission City Council Special Meeting Minutes February 28, 2013 MOTION SECONDED AND CARRIED: Moved by Councilmember Corrigan, seconded by Councilmember Larsen and passed unanimously to appoint Ginger Summit to the Los Altos/Los Altos Hills Senior Commission for a four-year term. B. Appointments to the Los Altos/Los Altos Hills Joint Community Volunteer Service Awards Committee MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by Councilmember Corrigan and passed unanimously to appoint Ginger Summit to the Los Altos/Los Altos Hills Joint Community Volunteer Service Awards Committee for a four-year term. MOTION SECONDED AND CARRIED: Moved by Mayor Waldeck, seconded by Councilmember Corrigan and passed unanimously to appoint Benjamin Gilds to the Los Altos/Los Altos Hills Joint Community Volunteer Service Awards Committee for a four-year term. D. Environmental Initiatives Committee Annual Report Peter Evans, Chair of the Environmental Initiatives Committee, provided an annual report on the activities of the committee. Council discussion ensued. Councilmember Corrigan provided a challenge to the Environmental Initiatives Committee, the Environmental Design and Protection Committee and the Water Conservation Committee. She requested that the committees review the current guidelines for artificial turf and propose new recommendations. C. Presentation by GreenWaste regarding the Town's Recycling Rates Emily Hanson, GreenWaste, San Jose, provided a presentation on the managing of waste in Los Altos Hills. Council discussion ensued. No action was taken. Breene Kerr, Los Altos Hills, stated that as one looks around the country, there are benchmark cities, bandwagon cities and backwater cities. He encouraged Los Altos Hills to continue to be a benchmark city in the area of energy and sustainability. City Council Special Meeting Minutes February 28, 2013 E. Presentation by the Community Health Awareness Council Monique Kane, Executive Director of the Community Health Awareness Council, presented a report to the Council on the benefits of CHAC to the community. Carrie Carsten, Public Relations/Marketing Manager for CHAC, informed the Council on the services and programs available to Los Altos Hills residents. No action was taken. F. Presentation by the Open Space Committee regarding CEOA Roger Spreen, Chair of the Open Space Committee, presented a report on the potential legislative changes to the California Environmental Quality Act. Council discussion ensued. No action was taken. G. Finance and Investment Committee Annual Report Jean Mordo, Chair of the Los Altos Hills Finance and Investment Committee, provided an annual report on the activities of the committee. Council discussion ensued. DIRECTION: Schedule a study session with the City Council and Finance and Investment Committee (FIC) to discuss current and future topics/projects for the FIC. Council recessed at 8:08 p.m. Council reconvened to Open Session at 8:17 p.m. 3. COUNCIL INITIATED ITEMS A. Discussion on the Composition of the Finance and Investment Committee (Councilmember Harpootlian) Councilmember Harpootlian presented the item. Jean Mordo, Chair of the Los Altos Hills Finance and Investment Committee, stated that there is nothing dire in the Town's financial well-being, and the Town is in good shape. The FIC is made of up highly qualified individuals who understand the numbers and will inform the Council if there are any concerns regarding the Town's finances. Council discussion ensued. City Council Special Meeting Minutes February 28, 2013 Allen Epstein, Vice Chair of the Los Altos Hills Finance and Investment Committee, commented on the structure of the committee. Kjell Karlsson, Member of the Los Altos Hills Finance and Investment Committee, commented on the composition of the committee. DIRECTION: Defer the decision of the number of Councilmembers on the Finance and Investment Committee until after the joint study session to discuss current and future projects. This item was removed from the agenda. C. Discussion of Town Committees Regarding Residency and Terms (Councilmember Corrigan) Councilmember Corrigan requested that all members serving on a committee update their status once a year; including address and phone number to ensure that committee members are all still residents of the Town and qualified to serve. Additionally, she requested that attendance be recorded at each meeting. She also requested that the Town establish a running annual policy where every committee member's contact information is updated and confirmed that he/she still lives in Town and the attendance record is reviewed. DIRECTION: The City Clerk shall alert all committee chairs to inform committee members to update their information and affirm that they are still qualified to serve on the committee. Additionally, the secretary of each committee shall produce minutes that reflect absences that will be tallied throughout the course of the year. 4. CONSENT CALENDAR MOTION SECONDED AND CARRIED: Moved by Councilmember Harpootlian, seconded by Vice Mayor Radford and passed unanimously to approve the CONSENT CALENDAR items 4.A through 4.I specifically: A. Approval of Meeting Minutes: City Council Special Meeting - January 24, 2013 B. Review of Disbursements: January 1, 2013 -January 31, 2013 $746,238.43 C. Resolution Authorizing an Agreement with Willdan Financial Services for a Comprehensive Rate and Fee Study and Overhead Cost Allocation (Staff. Y. Rasulova) 4 City Council Special Meeting Minutes February 28, 2013 D. Resolution Accepting the Town of Los Altos Hills Financial Statements for Fiscal Year Ended June 30, 2012 (Staff Y. Rasulova) E. Approval of Amendment No. 1 to the Sanitary Sewer Reimbursement Agreement Dated March 18, 2010, by and between the Town of Los Altos Hills and Behrooz Mohazzabi (Staff: R. Chiu) F. Resolution Approving the Sanitary Sewer Reimbursement Agreement Between the Town of Los Altos Hills and Zahava and Yoram Cedar (Staff: R. Chiu) G. Resolution Awarding Contract for Construction of Westwind Community Barn Loft Floor Repair Project (Staff: R. Chiu) H. Notification of Fast Track Approval: LANDS OF KAVEH; 12815 Viscaino Road; File #150 -12 -AP -SD -GD; A request for a Site Development Permit for a new 4,990 square foot two story residence (Maximum height 2T) with a 2,496 square foot basement, a 450 square foot swimming pool, and a new property line fence. PRESENTATIONS FROM THE FLOOR Nancy Couperus, Los Altos Hills, reminded that Sunday, March 3, 2013, the League of Women Voters is having a "meet your local officials forum" from 1:00 to 3:00 p.m. at the Youth Center on San Antonio Road in Los Altos. Margo Sidener, President and CEO of Breathe California of the Bay Area, thanked the City Council for their support of the Leigh Cement Plant Study. Maureen Jones, San Jose, spoke about health concerns of fluoride in drinking water. 6. PUBLIC HEARINGS A. LANDS OF WALLACE Stonebrook Drive APN# 336-23-020 & 021, (File#: 137-11 MISC) Approval of a Final Map Amendment to Show a Corrected Geologic Fault Trace The property is zoned R -A (Residential-Amcultural). CEQA Review: Class 5 Exemption (section 15305) (ASESSOR PARCEL NUMBERS 336-23-020 & 021)• File #137-11 MISC. (Staff: D. Pedro) Consulting Planner Cynthia Richardson presented the staff report. Council discussion ensued. City Council Special Meeting Minutes February 28, 2013 4W Ted Sayer, Cotton Shires & Associates, Town Geologist, stated that the recent study was done by a geologist that has been in practice for more than 20 years and does work in the Town. Mr. Sayer reviewed his work and confirmed his findings. He also noted that the previous geologist that identified the original fault trace lost his license and the firm is no longer in business. Mayor Waldeck opened the PUBLIC HEARING. Glenn Wilkerson, Los Altos Hills, stated that the fault line could not be moved on his property until they dig and have it reviewed by a geologist. Planning Director Debbie Pedro responded to the public comment and said that if Mr. Wilkerson would like to remove the fault easement on his property, he would need to submit an application and provide the geotechnical information. It would then be reviewed and subject to the public hearing process. Mayor Waldeck closed the PUBLIC HEARING. MOTION MADE AND SECONDED: Vice Mayor Radford moved to approve the Final M p Amendment to Show a Corrected Geologic Fault Trace for the LANDS OF WALLACE Stonebrook Drive APN# 336-23-020 & 021, (File#: 137- 11 MISC) (ASESSOR PARCEL NUMBERS 336-23-020 & 021). The motion_ was seconded by Mayor Waldeck. AYES: Councilmember HgpootlianMayor Waldeck Vice Mayor Radford, Councilmember Corrigan NOES: Councilmember Larsen ABSENT: None ABSTAIN: None MOTION CARRIED. Vice Mayor Radford suggested a motion be made to extend the meeting past 10:00 p.m. MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by Councilmember Haruootlian and passed unanimously to approve extending the City Council meeting past 10:00 p.m. The Council now considered Item 7.C. 29 City Council Special Meeting Minutes February 28, 2013 7. ONGOING BUSINESS C. Consideration of Amendment to Resolution 71-12 Establishing Standing Committees and Adopting General and Specific Rules Pertaining Thereto to Include Increasing the Membership of the Pathways Committee; Pathways Committee Site Review Process; Consideration of Appointment to the Pathways Committee (Staff. D. Padovan) Mayor Waldeck stated that this discussion was held over from the January City Council meeting and he opened it for public comment. Eileen Gibbons, Chair of the Pathways Committee, stated she was not in favor of increasing the size of the committee. Glenn Wilkerson, Los Altos Hills, spoke in support of his application. Council discussion ensued. Mayor Waldeck said he would entertain a motion to increase the number of members on the Pathways Committee to twelve. No motion was made and the item was tabled. Councilmember Corrigan stated that she would like to agendize for a future meeting how the Pathways Committee currently reviews properties on their "Saturday Morning Walks." The Council now considered Item 7.A. A. Town Goals 1. Public Safety No report. 2. Emergency Preparedness Mayor Waldeck shared the emergency preparedness calendar. 3. Conservation Issues No report. 4. Roads (Study Session on Private Roads - March 14) - Define Agenda for the Study Session on Private Roads Scheduled for March 14 2013 at 2:30 p.m. (Vice Mayor Radford 7 City Council Special Meeting Minutes February 28, 2013 Mayor Waldeck reported that Vice Mayor Radford had a conflict and he 6W suggested rescheduling the study session to Thursday, March 21, 2013 at 4:00 p.m. There was consensus for the revised date and time. Vice Mayor Radford outlined the agenda for the study session on roads. B. Organizational Changes to the Joint Los Altos/Los Altos Hills Senior Commission (Staff: D. Padovan) City Clerk Deborah Padovan presented the staff report. MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by Councilmember Corrigan and passed unanimously to approve a change in the membership of the Joint Senior Commission from three Los Altos Hills members to two members. 8. NEW BUSINESS A. Designation of a Councilmember Representative to Assist Staff in Renegotiating the Year Round Riding Contract (Staff: D. Pedro) Planning Director Debbie Pedro presented the staff report. Council discussion ensued. Vice Mayor Radford volunteered to assist in contract negotiations. B. Review of City Council Summer Meeting Schedule (Staff. D. Padovanl City Clerk Deborah Padovan presented the staff report. Council discussion ensued. MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by Councilmember Corrigan and passed unanimously to cancel the regularly scheduled City Council meeting of July 18, 2013. C. Consideration of a Request for a Legal Opinion from a Tax Attorney (Staff: S. Mattas Mayor Waldeck presented the item. City Attorney Steve Mattas recommended seeking the advice of a tax attorney on whether the issues of a mandatory payment obligation can be converted to a charitable donation. The motion was seconded by Councilmember Harpootlian. Update of Proclamations Guidelines (Staff: D. Padovan) City Clerk Deborah Padovan presented the staff report. Council discussion ensued. DIRECTION: A Proclamation shall be considered and voted on at the same Council meeting. MOTION SECONDED AND CARRIED: Moved by Councilmember Corrigan seconded by Councilmember Larsen and passed unanimously to amend the Proclamation policy to state that the Mayor should determine at a meeting of the City Council if the City Council is in favor of presenting the Proclamation. E. Proclamation Designating the Week of March 11-15, 2013 as "Science Fair Week" (Staff: D. Padovan) City Clerk Deborah Padovan presented the proclamation. MOTION SECONDED AND CARRIED: Moved by Councilmember Corrigan, seconded by Vice Mayor Radford and passed unanimously to Approve the Proclamation Designating the Week of March 11-15, 2013 as "Science Fair Week." 9. REPORTS FROM COMMITTEES SUB -COMMITTEES AND COUNCIL MEMBERS ON OUTSIDE AGENCIES City Council Special Meeting Minutes February 28, 2013 This item was removed from the agenda and will be considered at the March regular City Council meeting. 10. STAFF REPORTS A. City Manager City Manager Carl Cahill reported that on March 15 he will be making a presentation to the League of Women Voters in Los Altos. B. City Attorney No report. C. City Clerk City Clerk Deborah Padovan reported that the opt -in email list sign up will be available on the Town's website as of Friday, March 1. D. Public Works Director - Status Update on Sewer Agreement with Los Altos Public Works Director Richard Chiu provided an update on the sewer agreement with Los Altos. Council discussion ensued. No action was taken. Council returned to Item 9 — R orts from Committees Sub -Committees and Councilmembers on Outside Agencies. _ Councilmember Harpootlian provided an update on his attendance at a water district meeting. Councilmember Rich Larsen provided an update on the activities of the Silicon Valley Bicycle Coalition and requested that the Sheriff provide the Council with a quarterly report on public safety. Councilmember Corrigan reported that the parcel tax that the County Library JPA would like to renew will not happen this year, but will be on the ballot next spring.
