Mayor Radford called the meeting to order at 6:00 p.m. A. Roll Call Present: Mayor Radford, Vice Mayor Corrigan, Councilmember Harpootlian, Councilmember Larsen (participated via teleconference from the Intercontinental Hotel in Berlin, Germany), Councilmember Waldeck Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Interim Planning Director Suzanne Avila, Public Works Director/City Engineer Richard Chiu, Administrative Services Director Yulia Carter, Consultant Planner Cynthia Richardson, City Clerk Deborah Padovan B. Pledge of Allegiance The Loyola Fifth Grade Girl Scout Troop 61083 led the Pledge of Allegiance. 1. AGENDA REVIEW There were no changes to the agenda. 2. PRESENTATIONS AND APPOINTMENTS A. Presentation from the Santa Clara County Sheriffs Office on Property Crime Prevention Santa Clara County Sheriff s Office Captain Kenneth Binder presented a report on the recent burglaries in Town to the City Council. Council discussion ensued. City Council Regular Meeting Minutes August 21, 2014 Steve Bowling, Los Altos Hills, requested a pattern as to the days of the week or kor time of day that the burglaries normally occur in order to be more sensitive at that time. Martha Bowden, Los Altos Hills, said her neighborhood comprises of three streets and they had three break-ins in the last seven weeks. For ten years, there has been an unoccupied home because it is going through a remodel, she suggested that for any unoccupied long term projects there should be a requirement for security cameras. Joe, a resident of Los Altos Hills, explained how he was a victim in a recent attack. Gary Sawka, Los Altos Hills, said that people need to be more aware because neighborhoods change and cameras may be a good idea. A resident of Los Altos Hills requested that residents organize so that they can share photos and information. Rajiv Bhateja, Los Altos Hills, suggested the Town consider adopting Twitter handles so information can be quickly disseminated. Kay Lloyd, Los Altos Hills, asked that individuals send suspicious photos to the sheriffs office immediately. Ms. Young, Los Altos Hills, suggested a Facebook group page to post pictures. Heather Rose, Los Altos Hills, agreed with stepping up enforcement, but cautioned to be careful about privacy and civil rights. Mayor Radford thanked all the residents and reiterated the assistance measures available. B. Appointment of an Associate Member to the Environmental Design and Protection Committee City Clerk Deborah Padovan presented the staff report. Neela Shukla, Sunnyvale, introduced herself to the Council and expressed why she wanted to continue to serve on the Environmental Design and Protection Committee as an associate member. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to appoint Neela Shukla as an associate member to the Environmental Design and 2 City Council Regular Meeting Minutes August 21, 2014 Protection Committee; the Committee will set the term of service, not to exceed four years. The motion was seconded by Councilmember Harpootlian. Presentation from Victoria Dye on the Status of the Westwind Community Barn Victoria Dye provided a six month report on the status of the Westwind Community Barn. Administrative Services Director Yulia Carter presented the Town's current financial position at Westwind Community Barn. Council discussion ensued. No action was taken. 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Ray Collins, Administrative Manager and District Secretary for the Purissima Hills Water District, provided statistics on water usage in Town. Ernest Solomon, Vice President, Purissima Hills Water District, stated that at the last Board meeting, the District adopted Resolution 2014-7, which implemented the State Water Resources Control Board's Emergency Water Conservation Regulations restricting outdoor usage. Joan Gates, Los Altos Hills, explained about a telephone scam relating to a PayPal Green Dot Money Pak. Carol Gottlieb, Los Altos Hills History Committee, invited the City Council to the September 21St presentation by two daughters of the Packard family. City Council Regular Meeting Minutes August 21, 2014 4. PUBLIC HEARINGS A. Resolution Approving the Issuance of Notes by the California Statewide Communities Development Authority (CSCDA) on Behalf of the Daughters of Charity Health Systems (Staff. C. Cahill) Annie Melikian, Chief Financial Officer for the Daughters of Charity Health System, stated the first series that closed was successful and they are now requesting approval another $15 million for reserves. Council discussion ensued. City Attorney Steve Mattas said that Meyers Nave bond counsel have reviewed the documents and they are appropriate. Brandon Dias, Orrick, Herrington & Sutcliffe, LLP, said "you have no liability whatsoever on the bonds." Mayor Radford opened the Public Hearing. Seeing no one wishing to speak, Mayor Radford closed the Public Hearing. MOTION MADE AND SECONDED: Vice Mayor Corrigan moved to adopt Resolution 53-14 approving the issuance of tax-exempt notes by the California Statewide Communities Development Authority on behalf of the Daughters of Charity Health Systems. The motion was seconded by Councilmember Larsen. Lands of Fremont Hills Country Club; 12889 Viscaino Place; FILE# 11-13-MISC; The proposed project includes amendment to Title 10, Zoning and Site Development Code, to allow tennis court lighting on properties with the General Plan Designation of RA -PR (Private Recreation Area). This is the only property in Town with the RA -PR land use designation. The project includes amendments to the Outdoor Lighting Policy to be consistent with the Zoning Ordinance and amendments to the Fremont Hills Country Club Conditional Use Permit to allow the use of tennis court lighting on five existing tennis courts. CEQA Review: 4 City Council Regular Meeting Minutes August 21, 2014 Mitigated Negative Declaration (,Staff. S. Avila) Ex Parte Contact Disclosures: Vice Mayor Corrigan disclosed that she was a previous member of Fremont Hills Country Club and sold their membership about two years ago, in the last couple of years she knows many of the members socially and have had a few conversations about the lighting project, but nothing of significance; specifically she did speak with Scott Donnie for about 10 minutes while on a site visit; Councilmember Harpootlian spoke with Scott Donnie, Bart Carey and Jack Caffey; Councilmember Larsen stated that he was a former member of the club and thinks the club provides an excellent park and recreation benefit to the community; he has several good friends that belong to the club and has spoken with some of them recently; Councilmember Waldeck recused himself as he lives within 500 feet of the club, he then stepped down from the dais; Mayor Radford stated he was a former member of the club and has spoken with numerous people including Bart Carey. Consultant Planner Cynthia Richardson presented the staff report. Council discussion ensued. Scott Domnie, General Manager and Chief Operating Officer of Fremont Hills Country Club, thanked Town staff and introduced members of his staff including Bart Carey. Bart Carey, Representative of the Fremont Hills Country Club, presented the tennis court lighting project. Further Council discussion ensued. James Benya, with Benya Burnett Consultancy, stated that the lighting and the controls can automatically adjust for sunset all year long. Mayor Radford opened the Public Hearing. Jack Caffey, Los Altos Hills, was not in favor of the lighting project. Maria Caffey, Los Altos Hills, was not in favor of the lighting project. Samuel Broydo, Los Altos Hills, asked why is it necessary to change zoning law instead of granting a variance to the club. City Attorney Mattas said that the general plan designation applicable to Fremont Hills Country Club is unique to that facility and the zoning amendment only allows potential lighted tennis courts in that general plan designation. If a request was made elsewhere in Town, the property would have to amend the general plan designation for the other property. 5 City Council Regular Meeting Minutes August 21, 2014 Michael Bateman, Los Altos Hills, spoke in support of the lighting project. Andy Drexler, Los Altos Hills, spoke in support of the lighting project. Chris Vargas, Los Altos Hills, spoke in support of the lighting project. Mark Mihonovic, Los Altos Hills, spoke in support of the lighting project. Bob Kamangar, Los Altos Hills, spoke in support of the lighting project. Rich Beyer, Los Altos Hills, spoke in support of the lighting project. A resident of Los Altos Hills, spoke in support of the lighting project. Larry Russell, Los Altos Hills, spoke in support of the lighting project. Jim Abraham, Los Altos Hills, stated his opposition to the lighting project. Jitze Couperus, Los Altos Hills, explained his vote at the Planning Commission meeting. Mayor Radford closed the Public Hearing. Council discussion ensued. Councilmember Larsen asked if Planning Commissioner Couperus voted in favor of the project. Commissioner Couperus stated that he was in favor of letting the people speak. Mayor Radford asked about variances and use permits. City Attorney Mattas explained that the project before the council, a use variance would not be appropriate. The project should be regulated through the general plan and zoning code. Conditional Use Permits run with the land. Once a conditional use permit has been granted, as long as the property owner complies with the permit, it is a vested right and owner can continue to operate as long as the activity does not rise to the level of a nuisance. He advised that if the Council wanted to have the flexibility to reduce the hours of operation of the tennis courts, that it is better to put it in the conditions right now and then have a determination later whether or not to extend it. City Council Regular Meeting Minutes August 21, 2014 City Attorney Mattas read amended condition #12 into the record as follows, "all tennis court lighting on the five courts authorized to have lights, shall be timer controlled and shall have overriding time clocks which shut lights off automatically after fifteen minutes if the courts are not in use; there shall also be a master time clock which prevents lights from being turned on prior to 15 minutes before sunset or after 10:00 p.m. One year after commencement of use of the lights, the 10:00 p.m. time limit for operation of the lights shall be modified to 9:00 p.m. unless the City Council approves extending the 10:00 p.m. time period." The condition as stated includes modifications. Mr. Domnie stated that the condition as modified was acceptable. MOTION MADE AND SECONDED: Vice Mayor Corrigan moved to approve Resolution 54-14 Making_ Findings and Adopting the Initial Study and Mitigated Negative Declaration for the Fremont Hills Country Club Project 411-13 MISC. The motion was seconded by Councilmember Harpootlian. Jitze Couperus, Los Altos Hills Planning Commissioner, explained his rationale for reducing the development area bonus to 400 feet. Further council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to waive reading and introduce an ordinance amendment of Los Altos Hills Municipal Code 10-1.502(B)(6) and (6)(viii) - Development Area Bonus with the standard remaining at 500 feet The motion was seconded by Vice Mayor Corrigan. Chiu) Public Works Director Richard Chiu presented the staff report. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to approve awarding a contract to Nelson/Nygaard Consulting to Prepare a Townwide Sign Review Study in Order to Eliminate Unnecessary Signs. The motion was seconded by Councilmember Larsen. Review of the Community Services Grant Distribution Process (Staff: Y. Carter) Administrative Services Director Yulia Carter presented the staff report. Council discussion ensued. DIRECTION: Add to the September City Council meeting an item to distribute grants; the Council shall choose three or four organizations to divide the $30,000 budgeted for such purpose. Staff will contact groups from the prior year's list to determine if they want to be included again. C. Update on Stanford's Response to the Coyote Hill Parking Proposal (Staff: C. Cahill) City Manager Carl Cahill provided an update on the status of the Coyote Hill parking issue. Council discussion ensued. Chiu) Director Chiu presented the staff report. Council discussion ensued. Nancy Couperus, Los Altos Hills, confirmed that adding signs is a safety issue. Sue Welch, Los Altos Hills, said that run-ins with bicycles is not just a single incident, it happens continually. MOTION MADE AND SECONDED: Councilmember Waldeck moved to approve the installation of proposed bicycle yield signs for Byrne Preserve. The motion was seconded by Mayor Radford. Review Options for Gardner Bullis School Crosswalk Improvements and if Appropriate Approve a Resolution Authorizing the City Manager to Award a Contract to Implement (Staff: R. Chiu) Director Chiu presented the staff report. Heather Rose, Los Altos Hills Education Committee Chair, said the new location would be beneficial as it has better visibility and less shade. Council discussion ensued. MOTION MADE AND SECONDED: Mayor Radford moved to accept the recommendation to move the sidewalk and install flashing crosswalk signs to include anyone coming from Fremont Pines.
