City Council Special Meeting Minutes
Tuesday, January 14, 2014

CALL TO ORDER (6:00 P.M.)
Mayor Radford called the meeting to order at 6:00 p.m.
A. Roll Call
Present: Mayor Radford, Vice Mayor Corrigan, Councilmember Harpootlian,
Councilmember Larsen, Councilmember Waldeck
Absent: None
Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Community
Development Director Debbie Pedro, City Engineer/Public Works
Director Richard Chiu, Administrative Services Director Yulia Carter,
City Clerk Deborah Padovan
B. Pledge of Allegiance
Christian Foley with BSA Eagle Troop 31 led the pledge of allegiance.
1. AGENDA REVIEW
There were no changes to the agenda.
2. PRESENTATIONS AND APPOINTMENTS
A. Reappointment to the Environmental Design and Protection Committee
Pat Ley, Los Altos Hills, expressed her desire to continue to serve on the
Environmental Design and Protection Committee.
MOTION SECONDED AND CARRIED: Moved by Vice Mayor Corrigan,
seconded by Councilmember Larsen and passed unanimously to reappoint Pat Lev
to the Environmental Design and Protection Committee for an additional four-year
term.
B. Reappointment to the Education Committee

MOTION SECONDED AND CARRIED: Moved by Councilmember
Harpootlian seconded by Councilmember Waldeck and passed unanimously to
reappoint Jennifer Carlstrom to the Education Committee for an additional four-
year term.
C. Reappointment to the Water Conservation Committee
MOTION SECONDED AND CARRIED: Moved by Councilmember
Harpootlian seconded by Vice Mayor Corrigan and passed unanimously to
reappoint Kit Gordon to the Water Conservation Committee for an additional four-
year term.
3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council
on any subiect not on the agenda may do so now. Please complete a Speaker Card
located on the back table of the Council Chambers and submit it to the City Clerk.
Comments are limited to two (2) minutes per speaker. California law prohibits the
Council from acting on items that do not appear on the agenda. Under a Resolution
previously adopted by the Council, such items can be referred to staff for
appropriate action, which may include placement on the next available agenda.
Peter Biffer, Los Altos Hills, asked about the I-280/Page Mill Road signalization project.
Captain Ken Binder, Santa Clara County Sheriffs Office, provided an update on the
crimes that have occurred in 2013 and the status on the prosecution of suspects.
4. ONGOING BUSINESS
A. Selection and Award of Westwind Community Barn Concessionaire Contract
(Staff: D. Pedro)
Mayor Radford outlined the procedure for the discussion of this agenda item.
Community Development Director Debbie Pedro introduced the report and
provided a PowerPoint Presentation.
Council discussion ensued including questions of ad hoc committee member Allan
Epstein.
Laura Stevens with Heather Hill Riding Center delivered her PowerPoint
Presentation to the City Council.
The City Council asked questions of Ms. Stevens and received her responses.
Victoria Dye with Victoria Dye Equestrian delivered her PowerPoint presentation
to the City Council.

Ms. Dye provided a rebuttal.
Ms. Stevens provided a rebuttal.
Mayor Radford opened up the discussion for public comments.
Linda Renaud, Cupertino, spoke in support of Victoria Dye.
Kishore Kagiolanu, Los Altos Hills, spoke in support of Victoria Dye.
Emma Cummings, Mountain View, spoke in support of Victoria Dye.
Suzie Bruch, Woodside, spoke in support of Laura Stevens.
Bruce Martin, Los Altos Hills, spoke in support of Victoria Dye.
Tara Swan, Los Altos Hills, stated that she loves Westwind Barn and would like to
see supportive management that allows the community to grow.
Nicole von Kaenel, Los Altos Hills, spoke in support of Victoria Dye.
Marianne Marczak, Los Gatos, spoke in support of Victoria Dye.
Amy Back, Sunnyvale, spoke in support of Victoria Dye.
Kathy Swartz, Mountain View, spoke in support of Victoria Dye.
Julie Brown, Los Altos, spoke in support of Victoria Dye.
Margaret Mock, Los Altos Hills, wants to see good management at the barn.
Suma Singh, Sunnyvale, spoke in support of Victoria Dye.
Sharon Wormhoudt, Loma Mar, stated that she didn't understand how the
expenses could be the same for the two different vendors and further, the lower
arena maintenance will be a big expense.
Rohini Vashist, Los Altos Hills, spoke in support of Victoria Dye.
Deborah McCarley, Palo Alto, asked the Council to consider a limit on the size of
the riding program so that other stakeholders at the barn can still exist.
Elaine Nelson, Los Altos Hills, spoke in support of the individual that wants to
maintain a working barn.

Jitze Couperus, Los Altos Hills, spoke about management style and maturity.
Nancy Couperus, Westwind 4H, Los Altos Hills, said that experience is very
important as management is not an easy task.
Jeanne Foley, Los Altos Hills, said that Torie (Victoria Dye) has the energy, but
Laura (Stevens) has the experience.
Council recess at 8:22 p.m.
Council reconvened at 8:27 p.m.
Council discussion ensued, including Councilmembers expressing opinions on the
management options before them.
The City Clerk distributed voting ballots to the City Council.
City Clerk Padovan collected the ballots and read the results as follows:
Councilmember Larsen voted for Victoria Dye Equestrian
Mayor Radford voted for Victoria Dye Equestrian
Vice Mayor Corrigan voted for Victoria Dye Equestrian
Councilmember Waldeck voted for Heather Hill Riding Center
Councilmember Harpootlian voted for Heather Hill Riding Center
The City Clerk tallied the votes and announced that Victoria Dye Equestrian
received the majority of votes.
B. Consideration of a Resolution Awarding the Contract for the Westwind Barn
Lower Arena Base and Footing Renovation Project to Robison Construction
(Staff. R. Chiu)
Public Works Director Richard Chiu presented the staff report.
Council discussion ensued.
Nancy Couperus, Los Altos Hills, said the three businesses that provided a
proposal don't normally work on arenas as they are construction companies.
Deborah McCarley, Palo Alto, asked about the type of footing, the fiber material
and what kind of sand would be used.
Further Council discussion followed.

Sharon Wormhoudt, Loma Mar, said that the arena base is critical and sand is
very important.
MOTION SECONDED AND CARRIED: Moved by Councilmember Waldeck,
seconded by Councilmember Larsen and passed unanimously to approve
Resolution 1-14 awarding the project for the Westwind Barn Lower Arena Base
and Footing Renovation to Robison Construction for an amount of $114,500.00
with a contingency fund not to exceed $12,000.00 and subject to meeting with
experts including Victoria Dye The motion further stipulates that the sand choice
shall be consistent with the vendor's recommendation provide an estimate on the
cost of lower arena maintenance annually, and present an update at the February
City Council meeting; the final decision regarding the sand will be made by the
City Engineer.
C. Update Regarding Formation of a 501(c)(3) Nonprofit Corporation (Staff. S.
Mattas
City Attorney Steve Mattas presented the staff report.
Council discussion ensued.
Duffy Price, Los Altos Hills, expressed concerns that the report did not provide
cost estimates for directors, officers and insurance and that the proposed name is in
direct conflict with Hills 2000.
MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen,
seconded by Councilmember Harnootlian and passed unanimously to table the
discussion on the draft documents regarding the formation of a 501(c)(3) nonprofit
corporation.
At this point the Council agreed to continue past 10:00 p.m.
MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded by
Councilmember Waldeck and passed unanimously to continue the City Council meeting until 11
p.m.
D. Consideration of a Revised Art in Public Places Policy (Staff: D. Padovan)
City Clerk Deborah Padovan presented the report.
Council discussion ensued.
MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen,
seconded by Vice Mayor Corrigan and passed unanimously to incorporate
amendments recommended by staff,• the comments made by Councilmember
Larsen and Vice Mayor Corrigan to include additional wording that the Town

reserves the richt to terminate a relationship with a piece of art either by selling it,
4W donating or some other means; that the committee should review all art donations to
make sure the art is appropriate for display in Los Altos Hills,• that the committee
should review the proposed changes at their next meeting-, and place revised the Art
in Public Places Policy on the Consent Calendar at the regular City Council meeting
in February.
5. REPORTS FROM COMMITTEES, SUB -COMMITTEES, AND
COUNCILMEMBERS ON OUTSIDE AGENCIES
A. Request from the Art in Public Places Committee Seeking City Council Approval
for Two Proposed Sculpture Donations
Vice Mayor Corrigan introduced the two proposed donations.
Karen Druker, Chair of the Los Altos Hills Art in Public Places Committee,
presented two art sculptures for the Council's consideration.
Council discussion ensued.
MOTION SECONDED AND CARRIED: Moved by Vice Mayor Corrigan,
seconded by Councilmember Larsen and passed unanimously to accept the
"Tribute to Our Ohlone Roots" art sculpture to be placed in the corner of the
courtyard of Town Hall.
MOTION SECONDED AND CARRIED: Moved by Vice Mayor Corritian,
seconded by Councilmember Larsen and passed unanimously to accept "Star
Gazer" art sculpture the location of which to be determined at a future date.
Ms. Druker encouraged the City Council to provide input in public art.
Further Council discussion ensued regarding soliciting vs. accepting donations of
public art.
The Council now considered Item 8.C.
8. COUNCIL INITIATED ITEMS
C. Discussion on the Lehigh Quarry Mining Problem (Councilmember Waldeck)
Councilmember Waldeck presented the item.
Bill Almon, Los Altos Hills, spoke about Lehigh running weekly, increasing
mining blasts, causing an 2.4 earthquake. He requested assurance to the public that
there is no possibility that the blasting hastens or triggers or a local earthquake.

Council discussion followed.
DIRECTION: Councilmember Waldeck to draft a letter to the County Board of
Supervisors requesting in depth information and analysis. The City Clerk shall
provide a draft letter to the City Council prior to the Mayor signing the letter.
Rhoda Fry, Cupertino, said that she felt an earthquake and then learned it was a
quarry blast.
Jitze Couperus, Los Altos Hills, stated that the Council should consider drafting a
letter to state politicians in addition to the local County Board of Supervisors.
The Council now considered the CONSENT CALENDAR.
6. CONSENT CALENDAR
MOTION SECONDED AND CARRIED: Moved by Councilmember Larsen, seconded
by Vice Mayor Corrigan and passed unanimously to approve the CONSENT
CALENDAR, specifically:
A. Approval of Meeting Minutes: City Council Special Meeting - December 12, 2013
B. Review of Disbursements: December 1, 2013 - December 31, 2013 $339,704.74
C. Resolution 2-14 Acknowledging, but Rejecting the Offer of Dedication of Right -of -
Way; Lands of Ramgopal; 14085 Seven Acres Lane (Staff. R. Chiu)
D. Consideration of a Resolution 4-14 Accepting the Offer of Dedication and
Acceptance of Dawnridge Drive (Previously Dawnridge Road) into the Town's
Street System, Tract No. 1288 Crestwood (Staff. R. Chiu) (Resolution 3-14
Accepting the 50 Foot Dedication of Offer for Dawnridge Drive)
E. Resolution 5-14 Amending the Town's Classification and Compensation Plan for
the Finance Manager Job Class Specification (Staff. Y. Carter)

The Council now considered Item 8.A.
A. Council Appointments to Committees and Outside Agencies (Mayor Radford)
Mayor Radford tabled the appointments for next month with the Councilmembers
continuing in their current assignments for one more month and Vice Mayor
Corrigan agreeing to serve as the liaison to the Pathways Committee.
B. Consideration of Potentially Rescheduling the March 2014 Regular City Council
Meeting (Vice Mayor Corrie
Vice Mayor Corrigan proposed moving the meeting regular March City Council
meeting to an alternate date.
MOTION SECONDED AND CARRIED: Moved by Vice Mayor Corrigan
seconded by Councilmember Larsen and passed unanimously to cancel the March
20, 2014 regular City Council meeting and schedule a special City Council meeting
for Wednesday, March 19, 2014.
