A. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Pursuant to Government Code Section 54956.9) Linebarger v. Town of Los Altos Hills Mayor Corrigan called the meeting to order at 5:33 p.m. CALL TO ORDER (5:30 P.M.) A. Roll Call Present: Mayor Corrigan, Mayor Pro Tem Harpootlian, Councilmember Radford, Councilmember Spreen (joined the meeting after taking the Oath of Office), Councilmember Waldeck Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Suzanne Avila, Public Works Director/City Engineer Richard Chiu, Administrative Services Director Pak Lin, Senior Engineer Tina Tseng, City Clerk Deborah Padovan B. Pledge of Allegiance City Attorney Steve Mattas said there was no reportable action in the Closed Session. 1. SPECIAL ITEMS A. Administration of Oath of Office and Seating of Councilmember Appointee -Elect Roger Spreen City Clerk Deborah Padovan administered the Oath of Office to Councilmember- Appointee-Elect Roger Spreen. AGENDA REVIEW There were no changes to the agenda. 3. PRESENTATIONS AND APPOINTMENTS A. Presentation on "What El Camino Hospital is Building and Why"; by Ken King, Vice President of Administrative Services for El Camino Hospital Ken King, Vice President of Administrative Services for El Camino Hospital, informed the Council on the hospital projects that are currently underway. Council discussion ensued. Council asked questions of Mr. King and received his responses. No action was taken. B. Presentation by the Silicon Valley Leadership Group Inviting the Council to Participate in the 2015 Turkey Trot Katia Kamangar Executive Vice President/Managing Director of Summerhill Homes, encouraged the City Council to participate in the Turkey Trot this year. No action was taken. C. Annual Presentation by the Youth Commission Members of the Youth Commission (Aj Uppal, Aliesa Bahri, Arjun Sandev, Anna Garverick, Adam Colman and Tim Liu) provided an update on the activities of the Youth Commission. The council thanked the Youth Commission for all of their hard work this past year. No action was taken. D. Appointments to the Los Altos Hills Youth Commission Mayor Corrigan reported that the two Youth Commission applicants were unable to attend tonight and provided background information on both young men. Hu, Los Altos Hills, introduced himself to the City Council. MOTION MADE AND SECONDED: Councilmember Waldeck moved to appoint Hung (Ben) L Hu to the Los Altos Hills Emergency Communications Committee for a four-year term The motion was seconded by Mayor Pro Tem Harpootlian. Motion Carried 5 to 0: AYES: Councilmember Radford Councilmember Spreen, Councilmember Waldeck Mayor Pro Tem Harpootlian, Mayor Corrigan NOES: None ABSENT: None ABSTAIN: None Reappointment to the Los Altos Hills Open Space Committee MOTION MADE AND SECONDED: Councilmember Spreen moved to reappoint Nancy Couperus to the Los Altos Hills Open Space Committee for a fourth four-year term The motion was seconded by Councilmember Waldeck. Supervisor Simitian congratulated Councilmember Spreen on his appointment to the City Council and said he looked forward to working with him. G. Reappointment to the Los Altos Hills History Committee MOTION MADE AND SECONDED: Mayor Corrigan moved to reappoint Maryann Malcolm to the Los Altos Hills History Committee, for a second, four- year term The motion was seconded by Councilmember Waldeck. Motion Carried 5 to 0: AYES: Councilmember Radford Councilmember Spreen, Councilmember Waldeck Mayor Pro Tem Harpootlian, Mayor Corrigan NOES: None ABSENT: None ABSTAIN: None H. Update on Los Altos Hills 60th Anniversary Celebration Scheduled for January 2016 by the Community Relations Committee and Request for Approval of a Proposed Budget Roger Burnell, Chair of the Community Relations Committee, presented the item to the City Council. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Radford moved to approve the following: 1. the ticket price shall be set at $125; 2 the Town stipend/contribution of $17,500; 3 the projected expense for the Los Altos Golf & Country Club of $31,309; 4 all the indirect expenses, printing historical project etc. 5 the thematic expenses require two additional steps including a visit to the counter club and working on the proposed entertainment; then the Council will approve up to the amount that is being requested; if contributions are donated, those funds will reimburse the Town's general fund. The motion was seconded by Councilmember Waldeck. Presentation for Sewer Collection System Update by V.W. Housen and Associates and West Bay Sanitation District Public Works Director Richard Chiu introduced Senior Engineer Tina Tseng, who presented an update of the sewer collection system. Ms. Tseng provided background and history regarding the consultants. Consultant Vivian Housen provided a status report to the City Council on the Town's sewer collection system. Sergio Ramirez, West Bay Sanitary District, continued the presentation. Council asked questions of the consultants and received their responses. As the item was informational, no action was taken. J. Council Liaison Appointments to Fill the Vacancies from Rich Larsen's Resignation Council discussion ensued. MOTION MADE AND SECONDED: Mayor Corrigan moved to appoint Councilmember Spreen to the vacated seats as follows: the alternate liaison to the Environmental Initiatives Committee and as liaison to History Committee and Traffic Safety Committee effective immediately. The motion was seconded by Councilmember Waldeck. Report on Traffic Safetyon n Page Mill Road by the Santa Clara County Sheriffs Office - added with Revision No. 1 Santa Clara County Sheriffs Office Captain Sung reported on traffic safety on Page Mill Road. Council discussion ensued. Captain Sung stated that the Sheriffs Office would increase enforcement on Page Mill Road and Altamont Road for the next four to five weeks and would return at a later date with the results of that enforcement. 4. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Eileen Gibbons, Los Altos Hills Pathways Committee Member, provided an update on the progress of the Pathways Mapping Project. Dru Anderson, Los Altos Hills, spoke about the traffic in town. 5. PUBLIC HEARINGS A. Conduct a Public Hearing and Adopt a Resolution Approving the Issuance of Notes in an Aggregate Amount Not to Exceed $150,000,000 by the California Public Finance Authority (Ca1PFA) on Behalf of the Daughters of Charity Health System and Authorize Membership in Ca1PFA as an Additional Member (Staff: C. Cahill) - wording corrected with Revision No. 1 Mayor Corrigan opened the Public Hearing. City Manager Carl Cahill introduced the representatives from the Daughters of Charity Health System. Mike LaPierre, California Public Financing Authority, provided information on the benefits of joining the JPA and requested the Town authorize the issuance of up to $150,000,000 of tax exempt, working capital notes, issued by the California Public Finance Authority. City Council Special Meeting Minutes October 14, 2015 John Meyers, Bond Counsel with Orrick, Herrington & Sutcliffe, LLP, stated to the bonds are issued by Ca1PFA, and the Town is not involved beyond tonight. He further stated that the Town has no liability on the bonds. Council discussion ensued. Seeing no one wishing to speak, Mayor Corrigan closed the Public Hearing. MOTION MADE AND SECONDED: Mayor Corrigan moved to authorize the Town to Join the Joint Powers Authority Related to the California Public Finance Authority as an Additional Member. The motion was seconded by Councilmember Radford. Motion Carried 5 to 0: AYES: Councilmember Radford Councilmember Spreen, Councilmember Waldeck Mayor Pro Tem Harpootlian, Mayor Corrigan NOES: None ABSENT: None ABSTAIN: None MOTION MADE AND SECONDED: Mayor Pro Tem Harpootlian moved to adopt Resolution 55-15 approving a tax exempt bond financing be issued by the California Public Finance Authority to benefit Daughters of Charity Health Systems and certain affiliates and related action. The motion was seconded by Councilmember Waldeck. COUNCIL INITIATED ITEMS City Council Special Meeting Minutes October 14, 2015 19 A. Discussion and Possible Direction to Reduce the Size of the Finance and Investment Committee and Remove Councilmembers as Voting Members (Councilmember Waldeck) Councilmember Waldeck introduced the item. Council discussion ensued. Discussion ensued regarding the size of the committee. Allan Epstein, Los Altos Hills, stated that there are currently 11 members; 9 are non-councilmembers and there is one opening at this time. MOTION MADE AND SECONDED: Councilmember Waldeck moved to reduce the size of the Finance and Investment committee by the two Councilmembers, convert the two Councilmembers back to council liaisons with the Mayor and Vice Mayor continue to serve as non-voting_ liaisons and the committee membership stays at nine (9) The motion was seconded by Mayor Pro Tem Harpootlian. Motion Carried 4-1: AYES: Councilmember Spreen Councilmember Waldeck, Mayor Pro Tem Harpootlian, Mayor Corrigan NOES: Councilmember Radford ABSENT: None ABSTAIN: None B. Discussion and Possible Direction to Create an Emergency Preparedness Committee (Councilmember Waldeck) Councilmember Waldeck presented the item. Bruce Martin, Los Altos Hills, stated that he is actively involved in the CERT program and he also recently spent time at the Lake County fire and expressed his thoughts on emergency preparedness. Council discussion ensued. Karen Lemes, Los Altos Hills, said she previously worked for Foothill College and regretted that there wasn't more contact between the Town and the college. She asked if Foothill College was involved in emergency preparedness plans. City Council Special Meeting Minutes October 14, 2015 Dru Anderson, Los Altos Hills, said there are a number of individuals who are crossed -trained and interested in serving the community in an emergency preparedness fashion. Bruce Martin, Los Altos Hills, said that gap analysis is needed. Direction: The City Manager will return at a later date with a proposed plan and reporting structure for a committee. C. Discussion and Possible Action on the Order of Agenda Items on City Council Agendas (Councilmember Waldeck) Councilmember Waldeck presented the report. Council discussion ensued. There was consensus to leave the order of the agenda to the Mayor's prerogative. 7. ONGOING BUSINESS A. Election of Vice Mayor for 2016 (Mayor Corrigan) Mayor Pro Tem Harpootlian presented the item. MOTION MADE AND SECONDED: Mayor Pro Tem Harpootlian moved to nominate Gary Waldeck for Vice Mayor in 2016. The motion was seconded by Councilmember Radford. Motion Carried 4-0-1: AYES: Councilmember Radford Councilmember Spreen, Mayor Pro Tem Harpootlian, Mayor Corrigan NOES: None ABSENT: None ABSTAIN: Councilmember Waldeck B. Update on the Community Center and Request for a Resolution Authorizing the City Manager to Enter Into a Contract with Godbe Research for a Survey of Town Residents (Staff: C. Cahill) City Manager Carl Cahill presented the staff report. Council discussion ensued. City Council Special Meeting Minutes October 14, 2015 Allan Epstein, Los Altos Hills, said that the intent of the survey was not clear. Dru Anderson, Los Altos Hills, said a scientific survey is an excellent idea. MOTION MADE AND SECONDED: Mayor Corrigan moved to adopt Resolution 56-15 authorizing the City Manager to enter into a professional services agreement with Godbe Research in an amount not to exceed $30,000 for a community survey. The motion was seconded by Councilmember Waldeck. Request from Los Altos School District Regarding Student Safety Issues on the Street or Streets Near the Entrance to Gardner Bullis School City Manager Cahill presented the item. Vladimir Ivanovic, Los Altos School District Board Member, stated that the crosswalk is a long standing issue that still needs to be solved. He asked that the Council take action based on the results of the current study. Council discussion ensued. Heather Rose, Los Altos Hills, said that we need a controlled stop. Divya Valmiki, Los Altos Hills, has three children at Gardner Bullis School and described how she almost hit a child. MOTION MADE AND SECONDED: Mayor Corrigan moved to request that staff take immediate and appropriate action when they receive the traffic and engineer's report rather than waiting to bring it back to the Los Altos Hills City Council; if the recommendation is to remove the crosswalk, it may be removed immediately. The motion was seconded by Councilmember Radford. REPORTS FROM COMMITTEES, SUB -COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES A. Proposal from the Open Space Committee Requesting that Bike Access be Prohibited in Byrne Preserve and on the Artemas Ginzton Pathway George Clifford, Co -Chair of the Los Altos Hills Open Space Committee, requested that bike access be prohibited in Byrne Preserve. Council discussion ensued. Captain Rick Sung explained how enforcement would be handled. MOTION MADE AND SECONDED: Councilmember Radford moved to extend the meeting past 10.00 p.m. to no later than 11:00 p.m. The motion was seconded by Councilmember Waldeck. Motion Carried 5 to 0: AYES: Councilmember Radford Councilmember Spreen, Councilmember Waldeck Mayr Pro Tem Harpootlian, Mayor Corrigan NOES: None ABSENT: None ABSTAIN: None Scott Vanderlip, Los Altos Hills, said that some places use logs to show that bikes are not encouraged and that a physical barrier would be good for enforcement. City Manager Cahill said the direction that should be given to staff is to prepare an ordinance to prohibit bicycling in Byrne Preserve and provide direction on notice to the public. Update on the Palo Alto Unified School District (PAUSD) Special Meeting held on October 5 2015 (Councilmember Radford) Councilmember Radford provided a report on the October 5th Palo Alto Unified School District (PAUSD) meeting. Heather Rose, Los Altos Hills, introduced PAUSD School Board Member Heidi Emberling. Heidi Emberling, Vice President, Palo Alto Unified School District, said the October 5th study session was the first time they have heard the work that has been done by the committee. This item was provided for informational purposes. No action was taken. Heather Rose, Los Altos Hills, reported on progress since the October 5th PAUSD meeting. C. Appointment to the City Council Subcommittee on the Proposed Multi -Purpose Building (Mayor Corrigan) Councilmember Radford resigned from the subcommittee and Mayor Corrigan asked for a volunteer to take his place. Council discussion ensued. Mayor Corrigan stated that the current objective of the subcommittee is to complete the survey. Allan Epstein, Los Altos Hills, suggested that the name of the committee is a hindrance and recommended changing the name of the subcommittee. 12 City Council Special Meeting Minutes October 14, 2015 MOTION MADE AND SECONDED: Councilmember Radford moved to nominate Councilmember Spreen to the vet to be named subcommittee conducting the survey of residents in the Town of Los Altos Hills. D. Resolution of the City Council Authorizing the December 2015 Town Holiday Closure (Staff: P. Lin) Administrative Services Director Pak Lin presented the staff report. E. Proclamation for the National Friends of the Library Week October 18-24, 2015 (Staff. D. Padovan) City Clerk Padovan explained that the Friends of the Library Proclamation was requested by Suzanne Epstein who serves on the NCLA. MOTION MADE AND SECONDED: Councilmember Waldeck moved to adopt Resolution 60-15 Authorizing the Closure of Town Hall for the Winter Holiday Period Beginning December 24 2015 through Friday January 1, 2016 and the Proclamation for the National Friends of the Library Week October 18-24, 2015. The motion was seconded by Councilmember Spreen.
