A. Roll Call Present: Mayor Corrigan, Mayor Pro Tem Harpootlian, Councilmember Larsen, Councilmember Radford, Councilmember Waldeck Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Suzanne Avila, Public Works Director/City Engineer Richard OAW Chiu, Interim Administrative Services Director Pak Lin, Consultant Planner Steve Padovan, City Clerk Deborah Padovan B. Pledge of Allegiance The Pledge was led by Bullis Charter School Junior Girl Scout Troop No. 61259. Mayor Corrigan presented a pin and a patch to each Girl Scout. 1. AGENDA REVIEW Councilmember Larsen requested that Agenda Item 10.E be moved between Items 6 and 7. 2. PRESENTATIONS AND APPOINTMENTS A. Reappointment to the Environmental Initiatives Committee City Clerk Deborah Padovan introduced the reappointment. MOTION MADE AND SECONDED: Councilmember Larsen moved to reappoint Sheela Veering to the Environmental Initiatives Committee for a second City Council Special Meeting Minutes April 20, 2015 four-year term. The motion was seconded by Mayor Pro Tem Harpootlian. Motion Carried 5 to 0: AYES: Mayor Corrigan, Mayor Pro Tem Harpootlian, Councilmember Larsen, Councilmember Radford, Councilmember Waldeck NOES: None ABSENT: None ABSTAIN: None B. Presentation by a Representative of the Santa Clara Valley Water District Regarding the State of California's Water Project Tax (10 minutes) Jim Fiedler, Chief Operating Officer for the Santa Clara County Valley Water District, presented the County's position on the State of California's Water Project Property Tax. Councilmembers asked questions of Mr. Fiedler and received his responses. No action was taken. C. Presentation on the Governor's Drought Executive Order by Purissima Hills Water District and California Water Service (5 minutes each) Ray Collins, Administrative Manager for Purissima Hills Water District (PHWD), discussed the state water regulations. Ernie Solomon, President of PHWD and resident of Los Altos Hills, informed the Council that the District passed a resolution restricting outdoor watering. Ron Richardson, District Manager for California Water Service, stated that Cal Water customers were encouraged to start reducing water consumption in February 2014 to meet calls for restrictions. Additional restrictions are expected by early May based on the restrictions by the State. Councilmembers asked questions of Mr. Richardson and received his responses. MOTION MADE AND SECONDED: Mayor Pro Tem Harpootlian moved to direct the Environmental Initiatives Committee to work with staff to review AB 1881 with the new standards from the state; if the new standards aren't available within a reasonable time, they will look at the existing model,• additionally the committee shall review the Town's current water use and within sixty days return to the Council with suggested changes. The motion was seconded by Councilmember Waldeck. City Council Special Meeting Minutes April 20, 2015 Motion Carried 5 to 0: AYES: Mayor Corrigan,_ Mayor Pro Tem Harpootlian, Councilmember Larsen, Councilmember Radford, Councilmember Waldeck NOES: None ABSENT: None ABSTAIN: None Breene Kerr, Los Altos Hills, said that the water situation has been building for a number of years and suggested exploring bringing recycled water or "purple pipe" to town. Richard Partridge, Los Altos Hills, has observed projects coming to the Planning Commission with expansive lawns and he urged to the Council to consider conservation measures that are not "toothless." D. Annual Presentation b the Space Committee (8 minutes) Roger Spreen, Chair of the Los Altos Hills Open Space Committee, provided an annual report on the activities of the committee. Council discussion ensued. No action was taken. 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subiect not on the agenda may do so now. Please complete a Sneaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution Previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. There were no presentations from the floor. 4. PUBLIC HEARINGS A. Mandatoa Update of the Housing Element of the General Plan, Housing Element update to analyze housing needs for the community and adoptog als, policies, programs and quantified objectives to provide for those needs. State law requires each town, city, and county to update its Housing Element every eight years. The 2015-2023 Housing Element is the statutory update of the Town's Housing Element previously adopted by the Town and certified by the State on November 18, 2010. File #382-13-MISC, CEQA Review: Categorical Exemption per Section City Council Special Meeting Minutes April 20, 2015 15061(b)(3) (Staff- S. Avila) City Council Ex Parte Disclosures. None. Mayor Corrigan opened the Public Hearing. Consultant Planner Steve Padovan presented the staff report. Council discussion ensued. Seeing no one wishing to speak, Mayor Corrigan closed the Public Hearing. MOTION MADE AND SECONDED: Councilmember Larsen moved to adopt Resolution 19-15 amending the Los Altos Hills General Plan and Adopting the 2015-2023 Housing Element Update. The motion was seconded by Councilmember Waldeck. Motion Carried 5 to 0: AYES: Mayor Corrigan, Mayor Pro Tem Harpootlian, Councilmember Larsen, Councilmember Radford, Councilmember Waldeck NOES: None ABSENT: None ABSTAIN: None 5. NEW BUSINESS A. Review and Receive the 2015 Townwide Compensation Study (Staff. P. Lin) Interim Administrative Services Department Pak Lin presented the staff report. The Council asked questions of staff and received responses. Allan Epstein, Los Altos Hills, said that he had difficulty fully understanding the report. Staff responded to questions posed by Mr. Epstein. Roddy Sloss, Los Altos Hills, said that this type of a study is very useful and needed to properly administer a compensation program. He asked specific questions regarding the study. Further Council discussion ensued, including having an ad hoc committee review the study. City Council Special Meeting Minutes April 20, 2015 City Attorney Mattas reminded the Council that if a formal committee is created and it involves more than just representatives of the Council, then it needs to be publicly noticed. MOTION MADE AND SECONDED: Councilmember Larsen moved to receive the Townwide Total Compensation Study Report and form an ad hoc committee with Mayor Corrigan and Councilmember Radford and select other non -ad hoc committee members and review and return to the Council next month with a recommendation. The Motion was seconded by Councilmember Waldeck. Further Council discussion followed. City Attorney Mattas clarified what accepting the report entailed. Councilmember Larsen withdrew his motion. MOTION MADE AND SECONDED: Councilmember Larsen moved to form an ad hoc committee consisting of Mayor Corrigan and Councilmember Radford to review the resort and report back to the council by the next meeting, inviting individuals as necessary to participate The motion was seconded by Mayor Pro Tem Hargootlian. Recommendations from the Sewer Collection System Assessment Technical Memo Staff. R. Chiu) Public Works Richard Chiu presented the staff report. Council discussion ensued. Roddy Sloss, Los Altos Hills, said that he had concerns that he provided in a memo to the Council. Further discussion ensued. City Council Special Meeting Minutes April 20, 2015 Serena Giori, Los Altos Hills, asked what percentage of residents are using the sewer system. Mayor Corrigan responded with approximately 1700. B. Resolution Awarding a Contract to Acterra for Stewardship Services and Public Outreach Activities for Town Owned Open Space Preserves (Staff: R. Chiu) Director Chiu presented the staff report. Council discussion ensued. Sue Welch, Los Altos Hills, outlined all the actions Acterra had accomplished over the past year. Alex Von Feldt, Stewardship Program Director for Acterra, said they enjoyed the first year of the pilot project and hope to continue into next year. Further Council discussion ensued. MOTION MADE AND SECONDED: Mayor Pro Tem Harpootlian moved to adopt Resolution 20-15 awarding_a contract for stewardship services to Acterra in the amount of $55,000 with no contingency. The motion was seconded by Mayor Corrigan. Review of Conditional Development Permit Standards (Councilmember Larsen) Councilmember Larsen introduced the topic. Council discussion ensued. City Attorney Mattas provided information about lots. Esther John, Los Altos Hills, said that she lives in an area that was recently annexed and the neighborhood concerns are they would like to keep the neighborhood rural. Jitze Couperus, Los Altos Hills, reminded the Council that a similar discussion about lots occurred in 2001. Roger Spreen, Los Altos Hills, said something needs to change to in order to bring variances back to the real tool that they should be. Further council discussion ensued. There was Council consensus to have Councilmember Larsen return next month with his suggested guidelines and hard numbers for discussion. After the May meeting, the Council could give direction to staff to have an open, public meeting. Enrique Klein, Los Altos Hills, asked for clarification on the legal concept of a taking. REPORTS FROM COMMITTEES, SUB -COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES Mayor Corrigan reported out about the Library Summer Reading program. Councilmember Waldeck reported that Children's Health Awareness Council (CHAC) has hired a new executive director. He also reported out on the progress made by the subcommittee on communications. Councilmember Larsen stated that he had at a one-on-one meeting with the General Manager of the VTA. 9 City Council Special Meeting Minutes April 20, 2015 The Council now considered Item 10.D. D. Discussion on Community Choice Energy (CCE) Program for Silicon Valley and Consideration of Joining a Coalition of Santa Clara County Cities to Receive PG&E Energy Usage Information (Councilmembers Waldeck and Larsen) Councilmember Larsen introduced the topic. Peter Evans Member of the Los Altos Hills Environmental Initiatives Committee, presented information on the Community Choice Energy Program. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to prepare a letter to be signed by the Mayor and sent to Jim Griffin in Sunnyvale requesting the data from PG&E. The motion was seconded by Councilmember Larsen. STAFF REPORTS A. City Manager — No report. B. City Attorney — No report. C. City Clerk — No report. D. Planning Director — No report. 10 City Council Special Meeting Minutes April 20, 2015 E. Administrative Services Director — No report. F. Public Works Director - Status Update of 1) Sign Removal in Town and 2) Radar Trailer Director Chiu outlined the progress made on sign removal in Town. Council discussion ensued. Director Chiu confirmed that he would go through the list that the consultant had recommended for removal, with the exception of the no parking signs on Moody Road and no through road signs. The other signs recommended by the report will be removed right away. Other signs indicated will be evaluated and staff will return with a recommendation to the City Council. Director Chiu informed the Council that the Town's radar trailer is being repaired. Once repairs are complete, it will be returned to use on Town streets. 10. COUNCIL INITIATED ITEMS A. Discussion on Potentials Increasing the Size of the History Committee (Councilmember Waldeck) The request was withdrawn by Councilmember Waldeck. No action was taken. B. Consideration of a Letter Opposing Senate Bill 661 Based on a Request by Santa Clara County Assessor Lawrence Stone (Mayor Corrigan) Mayor Corrigan presented the topic. Council discussion ensued.
