Home My WebLink About496 RESOLUTION NO. 496 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING CHANGES AND MODIFICATIONS IN BOUNDARIES, PLANS AND SPECIFICATIONS AND ENGINEER'S REPORT. SEWER ASSESSMENT DISTRICT NO. 5 RESOLVED, by the City Council of the Town of Los Altos Hills , that WHEREAS, this Council did, on October 7 , 1968, adopt its Resolution of Intention No. 480 to acquire and construct public improvements in and for said City, and WHEREAS, this Council did, on November 18, 1968, adopt its Resolution No. 494 a Resolution of Intention to make changes and modifications in the boundaries , plans and speci- fications and Engineer 's report and appointing time and place of hearing in relation thereto and directing notice, and WHEREAS , notice was given of the time and place therein stated in the manner provided by law as appears from the affidavits on file in the office of the City Clerk, and WHEREAS, said matter regularly came on for hearing at the time therein fixed, and WHEREAS, all written protests and other written communi- cations were publicly read at said meeting and persons desiring to be heard were fully heard, NOW, THEREFORE, IT IS ORDERED AS FOLLOWS : 1. That protests against said proposed changes and modifications were not signed by the owners of a majority of the area of lands to be newly included within the assessment district nor of the area of the lands within the assessment district nor of the area of lands within the assessment district assessed for the costs and expenses of said work. 2 . That the changes and modifications and the plans and LAGORIO & FAISANT ATI0 RN EYS AT LAW -1- 3 00 1- 000 THIRD STREET L09 ALTOS, CALIF. 949-9200 110 specifications for the proposed improvements and the changes and modifications in the Engineer's report and in the boun- dary mapof said District, all as said changes are summarized in Exhibit "A" attached hereto and by this reference incorpo- rated herein, and as said changes more specifically appear on the amended Boundary Map and Amended Plans and Specifications and Engineer 's Report all on file in the office of the City Clerk, be and they are hereby finally adopted and approved. 3. That the Assessment Diagram finally approved by Resolution No. 491 of the City Council of the Town of Los Altos Hills, passed and adopted on November 18, 1968, be and the same is hereby amended and is hereby finally approved and confirmed as the diagram of the properties to be assessed to pay the costs and expenses, of said acquisitions and improve- ments . 4. That the assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said District in proportion to the estimated benefits to be received by said subdivisions respectively from said acquisitions and improve- ments and of the expenses incidental thereto contained in said report .be, and the same are hereby, finally approved and confirmed as the assessment to pay the costs and expenses of said acquistions and improvements . 5. That said Engineer 's Report, as amended, be, and the same is hereby finally;,adopted and approved as a whole. 6 . That the Clerk shall forthwith deliver to the Super- intendent of Streets the said amended assessment, together with said amended diagram thereto attached and made a part thereof as confirmed by this Council, with its certificate of such confirmation thereto attached and of the date thereof and LAGORIO Sc FAISANT ATTORNEYS AT LAW -2- 300 THIRD STREET LOS ALTOS, CALIF. 9'45-5200 • 1110 410 that said Superintendent of Streets shall record said amended diagram and assessment in his office in a suitable book to be kept for that purpose and append thereto his certificate of the date of such recording, and such recordation shall be, and constitute the assessment roll herein. 6. That said Superintendent of Streets upon the recording of said amended diagram and assessment shall mail to each owner of real property newly included within the assessment district :.pursuant to the amendments and changes herein pro- vided, at his last known address as the same appears on the tax rolls of the Town or on file in the office of the City Clerk of said Town, or to both addresses if said address is not the same, or to the general delivery when no address so appears, a statement containing a designation by street number or other description of the property assessed sufficient to enable the owner to identify the same, the amount of the assess- ment, the time and place ofpayment thereof, the effect'. :of failure to pay within such time, and a statement::of the fact that bonds will be issued on the unpaid assessments pursuant to the Improvement Bond Act of 1915, the last installment of which bonds shall mature not to exceed. fourteen (14) years from the second day of July next succeeding ten (10) months from their date. 7. That said Superintendent of Streets shall also give notice by publishing a copy of Notice to Pay Assessments by three (3) successive insertions in the Los Altos News, a newspaper published in Santa Clara County, there being no newspaper published in said Town, that said assessment has been recorded in his office and that all sums assessed thereon are due and payable immediately, and that the payment of said sums is to be made within thirty (30) days after the date of LAGORIO & FAISANT -3- ATTORNEYS AT LAW 300 THIRD STREET LOS ALTOS, CALIF. 948-8200 • O recording said amended assessment, which date shall be stated in. said Notice,and ofthe fact that bonds will be issued upon unpaid assessments as above provided.. 8.
