A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS
ALTOS HILLS AMENDING RESOLUTION NO. 458 REGARDING SEWER
POLICY
RESOLVED by the City Council of the Town of Los Altos
Hills that Resolution No. 458 adopted by said Council on
June 3, 1968, be and the same is hereby amended by adding
to Section A thereof, a new subsection 3 to read as follows :
913. It is the policy of this Town to assure those
members of new districts that future connectees will not
receive similar benefits at a lesser cost than that paid
by the original participants in a district. Further, this
Town intends to use funds received from future connectees
to the benefit of all members of the district as originally
formed as well as to the benefit of those connecting at a
later time. 1i
AND BE IT FURTHER RESOLVED that except as hereby amended
said Resolution No. 458 shall continue in full force and effect.
I HEREBY CERTIFY that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the
City Council of the Town of Los Atlos Hills , California, at
a meeting thereof held on the 1st day of August, 1968, by
the following roll call vote:

RESOLUTION NO. 458
A RESOLUTION OF THE TOWN OF LOS ALTOS HILLS
REGARDING SEWER POLICY
WHEREAS, it is the desire of this Council not to force sewers on areas
not needing or desiring same, and
WHEREAS, it is also the desire of this Council to allow those wanting
sewers to have them providing others are not forced to participateand
WHEREAS, this Council recognizes that the County Health Department policy
is to require sewers for new construction when sewers are available and
feasible, and
WHEREAS, it is desirable, but sometimes impossible, to draw District
boundaries to exclude all those not needing or wanting sewers,
NOW THEREFORE, the Council hereby resolves as follows:
A. FOR 'TEE ENTIRE TOWN:
1. It is the policy of this Town to restrict new districts only
to those who want or need to be included wherever this is
possible.
2. In the special case where a resident is not on a boundary and
thus cannot legally be excluded, it is the policy of the
Town to establish units of benefit so that such a resident
will be assessed a lesser amount than those connecting.
This lesser amount shall consist of two parts as follows:
a. The amount required to reserve treatment rights in the
treatment plant and facilities of either the City of
Los Altos or the City of Palo Alto.
b. An amount commensurate with the value of having a trunk
or collector line nearby. If and when future connections
are made, a fair value, not less than the difference
between the amount paid by the original connectees and the
amount paid by the later connectees, must be paid.
B. FOR THAT PORTION OF THE TOWN IN THE PALO ALTO DRAINAGE BASIN:
It is the policy of this Town to reduce the impact of the Palo
Alto Contract by the adherence to the following policies:
1. To actively encourage new subdivisions without investments
in existing septic systems to connect to sewers wherever
feasible. The treatment rights fee received is to be used
to spread the cost of the Palo Alto Contract.
2. To accept voluntary connection to sewers whenever feasible
in order to lessen the cost to all in the Palo Alto basin.
3. To periodically review the provisions of the Palo Alto
Contract with the hope of reducing any and all costs which
may legally be adjusted.
4. To annuallyreview the yearly service fee with the hope of
reducing same.

The City Council of Los Altos Hills respectfully submits for your action .
thefollowing list of property owners in the area designated LAH1, who have
filed written protests with the Board of Supervisors against inclusion in the
Los Altos Sanitary Sewers and Capacity Acquisition District.
To conform to the conditions of Resolutions Nos. 478 and 479, Granting
Extra-Territorial Jurisdiction to Santa Clara County for sanitary sewer improve-
ments within Los Altos Hills, it is necessary that the Board of Supervisors
direct that the following 'changes and modifications be made in the Los Altos
Sanitary Sewers and Capacity Acquisition District:
1. Delete the following sewer lines, thereby reducing the corresponding
assessments to $235.00 per unit of benefit (for capacity acquisition
charges):
a) Delete the sewer line designated as "Easement No. 34", thereby
reducing the following assessments:

The above properties, all located on the periphery of the proposed district,
represent 37.175 acres of the total 55.511 acres protesting in Los Altos Hillsl.
Action by the Board of Supervisors to delete the two sewer lines designated above
will reduce the official protest in LAH1 from 30.378% to 10.034%.

Written confirmation from the City of Los Altos has been received, stating
that they have no objections to the changes noted above, and that these changes
will have absolutely no effect on the contract between Los Altos and Santa Clara
County relating to sewage collection and treatment.
Execution by the Board of Supervisors of the modifications designated in
items Nos. 1 and 2 above is required at the earliest possible date in order to
comply with the conditions of granting extra-territorial jurisdiction to the
County. We trus-t these modifications will receive your prompt consideration
and implementation.
