HomeMy WebLinkAbout442r r • • RESOLUTION NO. 442 - A RESOLUTION OVERRULING PROTESTS AND MAKING FINDINGS PURSUANT TO DIVISION 4 OF THE STREETS AND HIGHWAYS CODE SEWER: ASSESSMENT DISTRICT NO. 2 RESOLVED by the City Council of the Town of Los Altos Hills, California, that WHEREAS, on the 7th day of September, 1967,. said Council did adopt its Resolution No. 407 requiring submis- sion of a report pursuant to Division 4 of the Streets and Highways Code relative to certain proposed acquisitions and improvements, and WHEREAS, said Resolution No. 407 was amended by said Council by its Resolution No. 424 adopted on the 5th day of February, 1968, and WHEREAS, the Engineer of the Work duly made and filed with the City Clerk of the Town a report in writing as called for in said resolution, as amended, and under and pursuant to said act, and WHEREAS, on the 26th day of February, 1968, said Council did adopt its Resolution No. 431 preliminarily approving said report, and appointing a time and place of hearing protests in relation to said report and to the proposed acquisitions and improvements and directing notice, and WHEREAS, notice was given of the time and place therein stated in the manner provided by law, as appears from the affidavit on file in the office of the City Clerk, and WHEREAS, said matter came on regularly for hearing at the time therein fixed, and WHEREAS, all written protests and other communications were publicly read at said meeting and all persons desiring to be heard were fully heard, NOW, THEREFORE, IT IS ORDERED AS FOLLOWS : LAG:1R10 & FAISANT ATT ORN EYB AT LAW 300 THIRD STREET -1- LOS ALTOS, CALIF. 948-5200 1. That protests against the acquisitions and improve- ments described in the report were not signed by the owners of more than one-half (1/2) of the area of the property to be assessed for the acquisitions and improvements and that said protests be and each of them is hereby overrruled. 2. The City Council hereby finds and determines that the total cost including incidental expenses of the acquisi- tions °and improvements, when added to the totals of all assessments and estimated assessments as stated in such re- port, does not exceed in total amount one-half (1/2) of the total true values stated in the report of all of the lands to be assessed to pay any part of the costs of such acquisi- tion or improvement. 3. The City Council finds and determines that the estimated amount proposed to be assessed upon each parcel of land of the proposed acquisitions and improvements will not exceed one-half (1/2) of the true value of such parcel as set forth in the report. 4.
