RESOLUTION NO. 397
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS
FOR THE ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITH-
OUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS
CODE.
SEWER ASSESSMENT DISTRICT NO. 3
RESOLVED, by the City Council of the Town of Los Altos
Hills, County of Santa Clara, California, that
WHEREAS, this Council has received from the Director
of Public Health of the County of Santa Clara, being the
County Health Officer of said County and the Ex Officio
Health Officer of the Town of Los Altos Hills, a letter
recommending as necessary as a health measure that the Town
of Los Altos Hills undertake proceedings pursuant to appro-
priate special assessment and assessment bond acts of this
state or other appropriate proceedings for the construction
of certain sewer improvements and for the assessing dr taxing
a_n
the properties to be benefited thereby, said improvements to
consist in general of the following:
(a) The construction and installation of sanitary sewer
mains, standard manholes with standard manhole frames and covers
and rodholes, together with necessary wye branches, laterals
and appurtenances, in those certain streets, easements and ways
and in those general areas more particularly described in Ex-
hibit A attached hereto and by this reference incorporated
herein.

(b) The acquisition of disposal rights and rights
of service and use in existing sanitary sewerage and
sewage disposal facilities of the Cities of Los Altos.
and/or Palo Alto;
(c) The acquisition of all facilities, lands, ease-
ments, property . and works and performing of all qwork
auxiliary to any of the above which may be necessary to
complete the same; and
WHEREAS, the costs and expenses of said contemplated
acquisitions and improvements are to be chargeableupon an
assessment district, the exterior boundaries of which are
the co-terminus exterior boundaries of the composite and
consolidated areas shown on a map thereof, onfile in the .
office of the City Clerk, and,
WHEREAS, the public interests and convenience will be
servedby the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
ORDERED, pursuant to Section 2808 of the Streets and Highways. . .
Code of the State of California, that the said recommendation
cf the Health Office r shall be spread upon the minutes of the
City Council and the City Council of the Town of Los. Altos
Hills hereby finds and determines that the undertaking of the
proceedings hereinabove referred to is necessary as a health
measure, and
IT IS FURTHER FOUND, DETERMINED AND ORDERED, that said
proceedings for the construction of said improvements shall
be had pursuant to the Municipal Improvement Act of 1913 and ..

the bonds upon the unpaid assessments thereof shall be
issued pursuant to the Improvement Bond Act of 1915,
and
IT IS FURTHER FOUND, DETERMINED AND ORDERED, that
the provisions of Division 4 of the Streets and Highways
Code be and they are hereby dispensed with.
I hereby certify that the foregoing is a full, true and
correct copy of a resolution duly passed and adopted by the
City Council of the Town of Los Altos Hills, California, by
the following roll call vote; at a regular meeting held June
19, 1967.

A. The construction of sanitary sewers, manholes, house laterals, and
appurtenances in the area defined as follows:
In La Palbma Road from 550 feet south of Alta Tierra Road to 500 feet
northerly of Dry Creek in an easement parallel to and 250 feet east of Alta •
Tierra Road 400 feet southerly from La Paloma Road; in West Wind Way from
La Paloma Road to Cul de Sac to Tract No. 3247; Cul de Sac from West Wind
Road to Tract No. 3247 in its entirety; Bridge Drive in its entirety; an ease-
ment from Bridge Drive along the northerly line of Lot 5 and the easterly line .
of Lot 7 of Tract No. 2979; Todd Lane in its entirety; an easement from La
Paloma Road along the northerly line of Lot 8 and the easterly lines of Lots 8
and 9 of Linndale Knolls; an easement westerly from La Paloma Road approxi-
mately 80 feet north of said northerly line of Lot 8 West 350 feet; thence
North 900 feet to Fremont Road;. Fremont Road from the end of said easement
to Concepcion Road;, an easement along the easterly line of Tract No. 3983;
Alta Verde Lane in its entirety; an easement westerly from the southwest corner
of Lot 9 of Linndale Knolls to the easterly line of Block L, Fremont Hills; thence
southeasterly thereon to the southerly line thereof; in Concepcion Road from
250 feet east of Purissima Road to Arastradero Road; Laurel Lane in its entirety;
Birch Hill Road in its entirety; an easement from Concepcion Road to the southerly
end of Viscaino Court; thence easterly therefrom to the easterly line of Lot 32,

easterly thereon to Concepcion Road; an easement from the intersection of
Viscaino Road and Viscaino Court westerly to the easterly lines of Lots 25,
