RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS
ACCEPTING GRANT OF A PATHWAY EASEMENT
(Lands of Legates)
WHEREAS, Bryan A. Legates and Regina C. Legates, husband and wife, as Joint
Tenants, ("Owners"), are the owners of the property commonly known as 11308 Magdalena
Road, Los Altos Hills, California; and
WHEREAS, Owners have offered to grant to the Town an easement for the construction,
operation and maintenance of existing and future pathway facilities, for pedestrian, bicycle and
equestrian use ("Pathway Easement"); and
WHEREAS, the City Council has determined it is necessary and proper and in the public
interest to accept the grant of the Pathway Easement;
NOW, THEREFORE, the City Council of the Town of Los Altos Hills does
RESOLVE as follows:
Section 1. The Town hereby accepts on behalf of the public, and for the purposes
therein described, the Grant of Pathway Easement attached to this Resolution as Attachment A.
Section 2. The Town shall accept, and the Mayor is hereby authorized and directed to
execute, the Grant of Pathway Easement.

GRANT OF PATHWAY EASEMENT
TO THE TOWN OF LOS ALTOS HILLS
(Lands of Legates)
THIS GRANT OF EASEMENT is made this day of tit , 2007, by
Bryan A. Legates and Regina C. Legates,husband and wife as Joint 4 ants, ("Owners"),
owners of the property commonly known as 11308 Magdalena Road, os Altos Hills,
California, to and for the benefit of the Town of Los Altos Hills, a municipal corporation
("Town").
Section 1. Owners do hereby offer to grant to Town a perpetual right and
nonexclusive easement for the construction, operation and maintenance of existing and
future pathway facilities, for pedestrian, bicycle and equestrian use, together with right of
access thereto, on, under, over, along and through the real property situated in the Town
of Los Altos Hills, County of Santa Clara, State of California as described and depicted
in Exhibit A attached hereto ("Easement").
Section 2. Owners shall not allow the placement or construction of any
structures or improvements on the Easement property.
Section 3. The Town hereby accepts the grant of the Easement.

All that certain real property in Los Altos, County of Santa Clara, State of California, being a
portion of that certain parcel described in the Grant Deed from Douglas Diggs and Gail Harada
Diggs,Trustees of the Diggs Family Trust of 1998 to Bryan A. Legates and Regina C. Legates,
husband and wife as joint tenants recorded August 11, 2006 as Document No. 19057243 Santa
Clara County Records, more particularly described as follows.
A 10-foot wide strip, over that 1.09 acre parcel of land filed for record on February 23, 1955, in
Book 52 of maps at page 46, Santa Clara County Records, further described as follows.
Beginning at a point on the southerly line of Magdalena Road(formerly Magdalena Avenue), said
point also being the Northwest corner of said 1.09 acres lot;
Thence along the southerly line of Magdalena Road N80°15'E 324.15 feet to the northeasterly
corner of said lot;
Thence leaving the southerly line of Magdalena Road, S9°45'E 10.00 feet;
Thence S80°15'W parallel with and equidistant therefrom 324.15 feet to the westerly boundary of
said 1.09 acres parcel of land;
Thence along said westerly boundary N9°45'W 10.00 feet to the Point of Beginning.
Containing 3242 square feet,more or less, as shown on the plat attached hereto and made a part
hereof.
The bearings for this description are the same as those shown on thatmap filed for record in Book
52 of maps at page 46, Santa Clara County, State of California.
