HomeMy WebLinkAbout52-16 RESOLUTION 52-16 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ORDERING THE REORGANIZATION OF TERRITORY DESIGNATED AS "MORA GLEN DRIVE NOX' WITHOUT ELECTION WHEREAS, a petition for the annexation of certain territory to the Town of Los Altos Hills ("Town") and detachment of said territory from Santa Clara County consisting of 8.48 acres on Mora Glen Drive and Mora Drive (Assessor Parcel Numbers 331-14-017, 331-15-027, 331-15- 028, 331-15-029, 331-15-041 and 331-15-042) has been filed by Stephen Burch and Carolyn Bostick, residents within the annexation area; and WHEREAS, on August 2, 2001 the City Council adopted Ordinance 415 amending the Zoning Map to pre-zone the San Antonio Hills Area (which includes the Mora Glen Drive No. 1 annexation area) to R-A, Residential-Agricultural; and WHEREAS, on June 16, 2016, the City Council adopted Resolution No. 35-16 initiating proceedings for annexation of the area designated as "Mora Glen Drive No. 1"; and WHEREAS, said territory is inhabited and all owners of land included in proposal have not consented to this annexation; and WHEREAS, the Town, following a properly noticed public hearing, adopted Resolution No. 45- 16 making findings and approving the reorganization consisting of annexation to the Town of Los Altos Hills and concurrent detachment from Santa Clara County as described in Exhibits "A" and `B,"consistent with Government Code Section 56757; and WHEREAS, pursuant to Government Code Section 56757, the City Council is the conducting authority for the protest proceedings for the annexation of the "Mora Glen Drive No. 1" area under Government Code Section 57000 et seq., and the City Council set August 18, 2016 as the date to conduct said protest hearing; and WHEREAS, in accordance with Government Code Section 57025 and Section 57026, the City Clerk of the Town of Los Altos Hills has provided mailed notice of the protest hearing on the reorganization, with instructions on how to prepare a valid, written protest; and WHEREAS, the Town of Los Altos Hills on August 18, 2016 conducted a protest hearing on the reorganization in accordance with Section 57050 of the Government Code; and WHEREAS, the Town of Los Altos Hills at the close of the protest hearing, determined the value of the written protest in order to take the appropriate action on the reorganization as required by Government Code Section 57052. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills, as follows: Resolution 52-16 Page I The following findings are made by the City Council of the Town of Los Altos Hills pursuant to Government Code section 56757: 1.1 That the unincorporated territory is within the urban service area of the Town as adopted by Santa Clara County LAFCO; and 1.2 That the County surveyor has determined the boundaries of the proposal to be definite and certain, and in compliance with the road annexation policies of the Town; and 1.3 That the proposal does not split lines of assessment or ownership; and 1.4 That the proposal does not create islands or areas in which it would be difficult to provide municipal services; and 1.5 That the proposal is consistent with the adopted general plan of the Town; and 1.6 That the territory is contiguous to existing Town limits; and 1.7 That the Town has complied with all conditions imposed by the commission for inclusion of the territory in the urban service area of the Town. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the Town of Los Altos Hills, as follows: 1. That three (3) valid written protest(s) to the reorganization proceedings were received and the value of those protest(s) submitted prior to the close of the protest hearing constitute 21% of the registered voters and 17% of property owners owning six (6) percent of the assessed value in the affected territory. 2. That said reorganization is hereby ordered without election pursuant to Government Code Section 57075.
