RESOLUTION NO, 115
A RESOLUTION OF THE TOWN OF LOS ALTOS HILLS AUTHORIZING
THE EXCHANGE OF CERTAIN REAL ESTATE BELONGING TO SAID
TOWN FOR CERTAIN REAL ESTATE PRESENTLY OWNED BY THE
COUNTY OF SANTA CLARA
WHEREAS, the Town of Los Altos Hills is now the record owner
of certain real property within said Town, a true description of which
is attached hereto, labeled Exhibit "One" and by this reference
incorporated herein, and which said parcel is hereinafter referred
to as Parcel One; and
WHEREAS, the County of Santa Clara is presently the record owner
of certain real property within the Town of Los. Altos Hills, the legal
description of which is attached hereto, labeled Exhibit "Two", and
by this reference incorporated herein, and which said property is
hereinafter referred to as Parcel Two; and
WHEREAS, it is deemed in the public interest that the Town of
Los Altos Hills exchange said Parcel One for said Parcel Two; and
WHEREAS, the County of Santa Clara has expressed an interest
in and willingness to consummate said exchange;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town
of Los Altos Hills that the Mayor of the Town of Los Altos Hills is
hereby authorized to sign a deed conveying all of the interest of the
Town of Los Altos Hills in the said Parcel One to the County of Santa
Clara, and that said Mayor is further authorized to deposit said deed
with any authorized escrow agent, together with instructions permitting
said deed to be recorded when said agent can record a deed duly
conveying all of the right, title and interest of the County of Santa
Clara in Parcel Two to the Town of Los Altos Hills.
PASSED AND ADOPTED this l st day of February, 1960 by the
following vote:
AYES: Clayton, Henley, Sherlock, Mayor Fowle
NOES: None
ABSENT: Bledsoe

its usual form,as of the date of this report, containing its standard exceptions and conditions, showing
title as herein set forth.
This report is issued without liability pending recording, final dosing and issuance of Policy in
accordance with instructions, and payment of premium.

due or payable, including personal property tax, if any.
Second : Any Municipal Assessments and/or Bonds of the. City of Town .
of Los Altos Hills .
Third: Right of the public to use as a roadway so much of Parcel
2 as lies within the boundary lines of "Fremont Road". r
Fourth: Covenants, Conditions, Restrictions and Reservations contained
in the Deed from Arthur E. Fowle to County of Santa Clara
dated October 4, 1955, recorded October 20, 195.5 in Book
�,. 3309 'Official Records , page 314, as - follows :
This conveyance is made upon the condition that a fire station `
be built upon the property within a period of ten (10) years
from the date of recording this deed. If the property is notii

developed for use as a fire station within the ten (10) year
period, title to the property shall revert to John M. Fowle.
A •further condition to this conveyance shall be in the event the site
is ever abandoned as a fire station location, title to the property
shall revert to John M. Fowle.
No training tower shall be erected on the property.
Grantor retains possession of the above described premises and will
continue to cultivate the property and take for his own use the
fruit crop produced,until such time as the fire station . is built
as provided above. (Affects Parcel 2)
Fifth: Drainage easement over the Northwesterly 10 feet of parcel 2 as
shown upon that.certain Map entitled, "Tract No. 2056 Esperanza
Hills, Unit No. 2", recorded March 24; 1958 in the office of
Recorder of the County of Santa Clara, State of California in
Book 92 of Maps, pages 2 and 3.
Note 1: Premises were not assessed for County and City Taxes for the
fiscal year 1958-59.
