O R D I N A N C E N 0. 47 AN ORDINANCE OF THE TO'!N OF LOS ALTOS HILLS AMENDING ORDINANCE NO. 45 OF SAID TOWN OF LOS ALTOS HILLS AND PROVIDING COND- ITIONS UPON WHICH DEPOSITS OF C;LSH OR BOND UNDER PREVIOUS ORDINANCE RELATING TO OFF SITE IMPROVEMENTS AND DRAINAGE RWcUIREMENTS MAY BE WITHDRAWN. THE CITY COUNCIL OF THF TO11F OF LOS ALTOS HILLS DOES ORDAIN AS FOLLOWS: SECTION I. Section VII of Ordinance No. 45 of the Town of Los Altos Hills is amended to read as follows: SECTION VII. Ordinance No. 39 and Ordinance No, 41 are hereby repealed. Any person or entity from whom a bond or cash deposit has been received for off site drainage or improvements under the requirements of any ordinance prior to Ordinance No. 45, may withdraw such deposit or bond upon the following conditions. A written election therefor shall be filed with the City Clerk within thirty (30) days after the effective date of this Ordinance. The deposit or bond shall then be returned when (1) a contract in form approved by the City Attorney and in substance by the City Engineer has been entered into under authority of the City Council for com- pletion of off site improvement or drainage construction in a manner deemed adequate by the City Engineer and the City Council for ob- taining the improvement and drainage facilities required. Such contract must be supported by a performance and maintenance bond approved as to form by the City Attorney and as to sufficiency by the City Engineers or (2) the terms of Ordinance No. 45 have been complied with. SECTION II. This Ordinance shall be posted in three (3) public places in the Town of Los Altos Hills and shall become effect- ive thirty (30) days after adoption.
