ORDINANCE NO. 54 AN ORDINANCE GRANTING PERMISSION TO THE CITY OF PALO AI:TO TO CONSTRUCT AND MAINTAIN WATER MAINS AND APPURTENANCES IN PAGE MILL ROAD A5D ARASTRADERO ROAD IN THE T07M OF LOS ALTOS HILLS THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILTS DOES ORDAIN AS FOLLOWS: SECTION I. Permission is hereby granted to the City of Palo Alto to construct and maintain water mains and appurtenant facilities in Page Mill Road and Arastradero Road for their entire lengths in the City Limits of the Town of Los Altos Hills. SECTION II. The granting of such permission is hereby made condititional upon the submission, prior to commencement of any work pursuant hereto, by the City of Palo Alto of a covenant whereby said City indemnifies and agrees to hold the Town of Los Altos Hills, its officials, employees, and agents harmless from any liability arising from the installation, maintenance, use or removal of utilities or appurtenant facilities pursuant to the grant of permission contained in this Ordinance. Said grant of permission is further made conditional upon agreement by the City of Palo Alto to pay to the Town of Los Altos Hills all reasonable engineering fees necessarily incurred by said Town for inspections and other engineering services in connect- ion with construction accomplished pursuant to the grant of permission contained in this Ordinance. SECTION III. All work pertaining to said project shall be done under the direction of the Engineer of the City of Palo Alto and to the satisfaction of the City Engineer of this Town and in conformity with good engineering practice. Said City En- gineer shall require of the contractor that all of the provi- sions of the specifications are complied with to the end that no greater amount of ditches are open at any time than is necessary, that they shall be adequately lighted and barricaded, that they shall be backfilled and surfaced in accordance with existing Town of Los Altos Hills Engineering Specifications.
