ABSENT: Councilman Aiken MINUTES : May 11, 1961. ACTION: Adopt Minutes of May 1, 1961 as submitted. COMMUNICATIONS : 1. R. Fodesta & Associates - Request for F. M. Radio Station in Santa Clara. ' Discussion deferred to New Business. ANNOUNCEMENTS: 1. County of Santa Clara Trafficways Committee - Notice of Meeting to 5e held on May 17, 1961 at the San Jose City Hall. 2. Santa Clara County Boundary Commission - Notice of proposed an- nexation to the City of Mountain View designated as Middlefield No. 2. COMMITTEE RETORTS: 1. Dog Kennels - Councilman Henley. Councilman Henley reported that the Committee recommended adoption of Canine Control Ordinance as presented, excluding section regu- lating kennels. OLD BUSINESS: None. NEW BUSINESS: 1. Public Hearing - Ravensbury Annexation No. 1. Mayor Powle declared the Hearing open at 8:05 F. M. City Attorney Faisant reported that protests had been received from property owners representing over fifty per cent (50%) of the assessed Valuation. The Mayor asked for convents from the Floor. There being none, the Public Hearing was closed. Public Hearing cont 'd. ACTION: That there be no further proceedings with regard to Ravens- bury Annexation No. 1. MOTION: Cl' yton; SECOND : Henley; VOTE: Passed unanimously 2. Protest of Iage Mill Road Residents Against Inadequate Notice for Sewer Hearing. The Mayor read letter of protest signed by thirty-five persons, residents of the Page Mill Road aren. Mr. Preston C. Burchard, representing the residents, contented relative to the lack of notice of proposed hearing. Comments were heard frog the following residents : Mrs. I . M. Borg Mr. Roy Kepler, Mr. John S. Ewing, Mrs. Lois Harbow, and Council-- ren. The City Attorney stated that a request for opening city streets does not require notice to residents, and that there was no vio- lation on the part of the Council. No action was taken. 3. Consideration of cceptance of Improvements in Tract No. 2158 - H. F. Kertz. Letter, from City Engineer, dated May 9, 1961, stated that all requirements have been net and acceptance is recommended. The Council 's Committee on Roads was asked to recommend whether or not the berm constructed on Moody Rd. and Sc. El Monte should be removed. ACTION: That the improvements in the H. H. Kertz Subdivision, Tract No. 2158 bo accented. MOTION: Henley; SECOND: Clayton; VOTE: Iassed unanimously 4. lavensbury Annexation No. 1. Mr. Knox, Realtor, representing Mr. Foley, stated that Une. Millare one of the signers of the protest to the annexation, had asked tha' her name be withdrawn. The meeting was recessed at 8: 25 r. M. to consider whether to re- open the Public Hearing on the Ravensbury Annexation. The meeting reconvened at 8:28 P. ACTION: That the Tentative Nap No. G-58 of Vircil Ed McGee (192-61) 3 lots be approved, subject to all conditions imposed by the Planning Commission, the Check List, approval of all agencies , and specifically subject to requirement that the Final Map show a grant, for the benefit of Lots 1 and 2, of an adequate easement as shown upon M'.p i:a C-85. MOTION: Henley; SECOND : Clayton; VOTE: Passed unanimously The question of a Flatting Flan was discussed , and the Engineer was Lsked to submit a 'Ilan after the roads have been put in. 2. Schaufel, C. A. (191-61) 2 lots. Engr. Nolte. ACTION: That the Final Map of C. A. Schaufel (191-61) , Tract No. 2973, 2 lots, be approved. MOTION: Clayton; 22COTT Sherlock; VOTE: Passed unanimously New Bus. Cont 'd. 4. F. M, Radio Station - Etty of Santa Clara. ACTION: That Mr. rodesta be as:e1 to appear and explain the matter at the next Council Meeting, and that the National Broad- casting Co. be informed of the meeting. Mayor Fowle stated that the natter will be heard again at the next meeting, June 5, 1961, 6, Street A_ - Fremont Hills The City Attorney reported that the flown had been served a snr_mons relative to condemnation of the hind for proposed Street A in `'re;:.ont Hills Subdivision. ACTION; That the City Attorney be instructed to file an answer re- lative to this street on behalf of the Town as outlined by the :.ttorneye MOTION: Clayton; SECOND; Sherlock; VOTE: passed unanimous 7.
