ORDINANCE NO. 333 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING TITLE 11 OF TITLE 10 BY ADDING A SECTION REGARDING EXPIRATION OF CONDITIONAL USE PERMITS CONDITIONAL DEVELOPMENT PERMITS, AND VARIANCES WHEREAS, the Town believes that if conditional use permits, conditional development permits, and variances are not acted upon or used within a reasonable time, they should expire so that present circumstances can be taken into account into granting or denying such permit; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Article 11 of Title 10 of the Los Altos Hills Municipal Code is hereby amended by renumbering Section 10-1. 1112 to Section 10-1. 1113. SECTION 2. AMENDMENT OF CODE. Article it of Title 10 of the Los Altos Hills Municipal Code is hereby amended by adding Section 10-1. 1112 to read as follows: Section 10-1.1112.. Expiration (a) Any conditional development permit or variance granted in accordance with this Article shall expire unless a building permit has been procured within one (1) year of the effective date of the conditional development permit or variance. Any conditional use permit granted in accordance with this Article shall expire unless the authorized use has been commenced at the site within one (1) year of the effective date of the use permit. (b) Demolition or substantial alteration of struc- tures authorized by a variance or conditional development permit ,shall void the variance or conditional develop- ment permit, unless all permits necessary to replace or repair the structures in essentially the same form as originally authorized are acquired within one (1) year of the destructive or damaging incident. (c) Cessation of activity at the site of a condi- tional use permit for more than one (1) year shall void the use permit. 1
