Committee might have reviewed the application differently if they had known that <br /> Palomino Court was to be a dedicated road. <br /> Nancy Ginzton, resident, concurred with Brunzell's assessment of a potential path on the <br /> site. <br /> CLOSED PUBLIC HEARING <br /> Council queried applicant James Parivash if he was amenable to voluntarily dedicate a <br /> pathway easement connector on the subdivision. He advised that as the representative of <br /> the owners,he did not have the authority to make the commitment. <br /> Council requested clarification on any potential subdivisions plans proposed for the five <br /> (5) acre parcel. Mr. Parivash responded that the parcels would be sold as estate properties <br /> and there were no plans for additional development. City Attorney Mattas noted that the <br /> legal right to subdivide the property was still viable, even though the applicant has <br /> expressed his position to not subdivide in the future. <br /> MOTION SECONDED AND CARRIED: Moved by Larsen, seconded by Warshawsky <br /> and passed by the following voice vote to adopt the Mitigated Negative Declaration and <br /> Mitigation Monitoring Program and approve the proposed Tentative Map subject to the <br /> findings and conditions of approval in the staff report as Attachment 1 and 2. <br /> AYES: Mayor Mordo, Mayor Pro Tem Warshawsky, Councilmember Larsen, and <br /> Councilmember Summit <br /> NOES: Councilmember Kerr <br /> ABSENT: None <br /> ABSTAIN: None <br /> 8. Amendment to the Site Development Ordinance to Adopt a Ministerial Review <br /> Process for Secondary Dwelling Units (Section 10-2.301) in Accordance with <br /> Government Code Section 65852.2 (Staff. D. Pedro) <br /> Planning Director Debbie Pedro introduced the item to Council. Pedro provided an <br /> overview of the proposed amendment to the Town's Municipal Code which would update <br /> the Town's review process for secondary dwelling units to comply with State Law. <br /> Government Code Section 65852.2 requires local governments with a second unit <br /> ordinance to ministerially consider second unity applications. Pedro noted that since the <br /> State Law took effect in July, 2003, the Town had been processing second unit <br /> applications ministerially. However, the Site Development Code had not been updated to <br /> reflect this procedural change. <br /> Pedro reviewed the two amended sections of the Code with Council. The Planning <br /> Commission had reviewed the proposed amendments and voted unanimously to <br /> recommend their approval to Council.
