Instead she takes her garbage to her son's <br /> home. <br /> Mr. Mak, 11614 Dawson Drive, (service level: universal; amount due $852.60) stated that <br /> he did not use the garbage services and therefore did not think he should have to pay. <br /> Mark Jensen, 26225 Purissima Road, (service level: universal; amount due$1,042.05) <br /> referred to a letter from his attorney, Kristen Thall Peters from the law firm of Cooper, <br /> White and Cooper. In this letter several cases were referred to which Mr. Jensen believed <br /> supported his belief that these charges were unfair. He did not use the garbage services, <br /> had never asked for them and believed they were an unfair taxation. <br /> Mr. and Mrs. Jenkins, 13053 Cumbra Vista Court, (service level: 1 can; amount due <br /> $204.94)had sent a letter to the Council explaining that they had not paid because their <br /> home had been unoccupied for certain periods of time. <br /> Stephanie Munoz, 13460 Robleda Road, (service level: universal; amount due $1,028.05) <br /> distributed a letter to Council as well as copies of previous correspondence. She did not <br /> agree that these were fair charges. It was a service she had never used nor asked for. <br /> Mrs. Munoz believed the Town had arbitrarily signed her up for garbage services without <br /> her authority or permission. <br /> Mr. Munoz, 13460 Robleda Road, concurred with his wife's comments. They lived in a <br /> wonderful,relaxed country community. However,he did not think that the Council had <br /> • facilitated a common solution to this garbage problem. He too did not think it was right <br /> to be charged for services they never asked for, did not use and did not think were <br /> appropriate. In his opinion it was taxation without representation. <br /> Council had received no communication from the following: Dwight Miller, 2210 Gerth <br /> Lane (service level: universal; amount due$756.90),Mr. and Mrs. Tan, 12903 <br /> LaBarranca(service level: 1 can; amount due $1,504.56) and Robert Clifford, 25240 <br /> Cantata Way(service level: 1 can; amount due $1,270.23). <br /> Since Finn had arrived after the public comment, he was unable to vote on the issue. <br /> Casey stated that she had voted to eliminate mandatory garbage in 1995 but not recycling. <br /> At this time she believed she had to uphold this ordinance in good faith. Dauber <br /> concurred with Casey stating that the Town had to enforce the ordinance to satisfy State <br /> mandates. <br /> MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Siegel and <br /> passed by the following roll call vote to put the following universal delinquent Los Altos <br /> Garbage Company accounts on the next tax roll with an administrative charge: Prudence <br /> ($709.05), Miller ($756.90), Kaizuka($1,044.00), Mak($852.60), Jensen($1,042.05), <br /> Stephanie Munoz($1,028.05). <br /> AYES: Mayor Dauber and Councilmembers Casey, Johnson and Siegel <br /> NOES None <br /> ABSTAIN: Mayor Pro Tem Finn <br /> July 15, 1999 <br /> Special City Council Meeting <br /> 2 <br />
