I <br /> ARTICLE III . GENERAL PROVISIONS. <br /> Section 9-4:301 . ' 'Applicability. No division of land shall be made within <br /> the Town of Los Altos Hills except in conformity with the applicable provi- <br /> sions of this Chapter and the Subdivision Map Act of the State. <br /> Section- 9-4.302. Interpretation. Whenever anprovisions <br /> p ,y of this Chapter <br /> andanY other provision of the Cit law, whether set forth in thi <br /> s chapter <br /> r <br /> or in any other law, ordinance, or resolution of any kind imposes overlap= <br /> ping or contradictory regulations over the subdivision of land, or contains <br /> any restrictions covering any of the same subject matter, that provision <br /> which is more restrictive or imposes higher standards or requirements shall <br /> govern. <br /> Section 9-4:303. Issuance of Conflicting Permits. No building permit shall <br /> be issued for any new structure, nor shall any permit be issued by the <br /> Health Department for any new septic tank or sewage disposal system, serv- <br /> ing a new structure, -w.i;thin an area upon which a tentative subdivision map <br /> has been filed, until the Final Map thereof has been recorded. <br /> Sectioik'�-�4:304'. ' Deni-al of Permit. Permits or other approval necessary <br /> to develop any real '-property which has been divided, or which has resulted <br /> from a division, in violation of the provisions of this Chapter shall not <br /> be issued or granted if the authorized City Official finds that develop- <br /> ment of such real property is contrary to the public health or the public <br /> safety. This authority to deny such permit or approval shall apply whether <br /> applicant therefor was the owner of the real property at the time of such <br /> violation or whether the applicant therefor is the current owner of the real <br /> property wM or without actual constructive knowledge of the violation <br /> at the time of the acquisition of the applicant's interest in such real <br /> property. The City Council may authorize the issuance or granting of such <br /> permit or approval upon the imposition of such conditions as would have <br /> be'en:app-11 6abl'e;to the division of the property at the time the current <br /> owner of record acquired the property. Any decision of authorized City <br /> Officials may be appealed as provided for in Article X of this Chapter. <br /> Section 9=4:305. ` Waivers. The Commission may recommend and the Council <br /> may grant a waiver of any or all of the provisions of this Chapter and the <br /> Town Standards for any parcel which does not have an existing residence <br /> and is not to be used for such purpose. <br /> Whenever a waiver is granted pursuant to the provisions of this Section <br /> the waiver shall be upon the condition that the inS'trument creating the divi- <br /> sion of itself does not qualify as a buildable lot under the provisions of <br /> this Chapter. <br /> Section 9=4:306: ' Acts 'Prohibited: Sale of Lots. It shall be unlawful for <br /> any person to offer to sell , finance, or lease, to contract to sell , finance <br /> or lease, or to sell , finance or lease any real property which constitutes <br /> a subd.i-v ision as defined herein or any part thereof, until a Final Map or <br /> Parcel Map thereof, in full compliance with the applicable requirements im- <br /> posed under the provisions of this Chapter and the Subdivision Map Act has <br /> been duly recorded or filed in the office of the County Recorder. <br /> 'Section '9 '�4:307. \�bidability 'of Deeds or'Contracts.
