TOWN OF LOS ALTOS HILLS June 10, 2004 <br /> Staff Report to the Planning Commission <br /> RE: REQUEST FOR A LOT LINE ADJUSTMENT; LANDS OF NICHOLSON AND <br /> YANG; MAGDALENA ROAD (APN# 336-42-021) AND 11639 DAWSON <br /> DRIVE; #44-04-LLA. <br /> FROM: Debbie Pedro, Associate Planner <br /> APPROVED BY: Carl Cahill, Planning Director C <br /> RECOMMENDATION: That the Planning Commission: <br /> Forward a recommendation of approval of the lot line adjustment.to the City Council, <br /> subject to the applicant's submittal of a legal description and plat map (prepared by a <br /> registered civil engineer or licensed land.surveyor) for each of the parcels and recordation <br /> of the certificates of compliance. <br /> CODE REQUIREMENTS <br /> Review authority for lot line adjustments is outlined in Section 66412(d) of the State's <br /> Subdivision Map Act, which states that: <br /> "A local agency or advisory agency shall limit its review and approval to <br /> a determination of whether or not the parcels resulting from the lot line <br /> adjustment will conform to the local general plan, any applicable coastal <br /> plan, and zoning and building ordinances. An advisory agency or local <br /> agency shall not impose conditions or exactions on its approval of a lot <br /> line adjustment except to conform to the local general plan, any <br /> applicable coastal plan, and zoning and building ordinances, to require <br /> the prepayment of real property taxes prior to the approval of the lot line <br /> adjustment, or to facilitate the relocation of existing utilities, <br /> infrastructure, or easements." <br /> Pursuant to Section 9-1.311 of the Los Altos Hills Municipal Code, the City Council shall <br /> approve conditional) approve or deny each application on for issuance of a certificate of <br /> compliance with the provisions of the Subdivision Map Act of the State of California. <br /> The lot line adjustment will be effectuated when a certificate of compliance is recorded <br /> for each parcel with the Santa Clara County Recorder's Office legitimizing the newly <br /> created lot lines. <br />
