Staff Report to the Planning Commission <br />Lands of Blackman <br />13815 Barton Court <br />January 27, 2005 <br />Page 5 of I 1 <br />3) Adherence to the grading policy would not prevent the property owner from <br />constructing a swimming pool or establishing useable outdoor living space. The <br />swimming pool can be relocated and/ or redesigned and the lawn area can be reduced <br />to minimize the amount of proposed cut. Terracing is a common technique used by <br />property owners to create outdoor living space that conforms to the Grading Policy. <br />Fire Department Review <br />The Santa Clara County Fire Department has reviewed the proposal and is requiring a fire <br />truck tumamund on the property which has been incorporated into the driveway plan. <br />Additional conditions including installation of fire sprinklers throughout the building, <br />temporary driveway to access the property, and premise identification are included as <br />conditions #26-28. <br />Committee Review <br />The Pathways Committee recommends a pathway in -lieu fee which is included as <br />condition #25. <br />The Environmental Design Committee noted that the area directly west of the new home <br />needs mitigation. Recommended condition of approval #2 requires a landscape screening <br />and erosion control plan to be submitted after final framing of the new residence to <br />address view impacts to surrounding neighbors. <br />CEOA STATUS <br />The project is categorically exempt under Class 1 of the State CEQA Guidelines <br />1.
