A. Richard Jones, Planning Commission Chairman, commented that he <br /> personally found it very difficult to make the variance findings for Lands <br /> of Wong as there were arguments on both sides of the issue. He believed <br /> they should have worked harder on the findings. <br /> Hubbard noted that the Rebuilding/Building Out Subcommittee had <br /> considered telling people they could build only to 90% of the development <br /> area but believed it was an intrusion to tell people they could not build to <br /> the maximum development area. <br /> Casey stated that she did not believe granting this variance would be sending <br /> out a negative message. None of the neighbors objected to the variance <br /> and it was clearly not easy to get a variance in the Town. <br /> MOTION FAILED DUE TO LACK OF A SECOND: Moved by Hubbard to not <br /> approve a variance to the maximum development area for a 547 square <br /> foot addition for Lands of Wong. <br /> MOTION SECONDED AND CARRIED: Moved by Tryon, seconded by Siegel and <br /> passed by the following roll call to approve the variance to the maximum <br /> development area for a 547 square foot addition for Lands of Wong, 11675 Dawson, <br /> based on the following variance findings which will be prepared by the City <br /> Attorney and agendized for the next Council meeting for final approval: the unique <br /> `, properties of the lot and the practical difficulties on the lot with the steepness of the <br /> driveway which allows for extra footage for the deck. In addition a special notice <br /> shall be placed on the property records that no further development will be allowed <br /> on the property. <br /> AYES: Mayor Siegel and Councilmembers Casey and Tryon <br /> NOES: Mayor Pro Tem Hubbard <br /> ABSENT: Councilmember Johnson <br /> Hubbard stated that the message was important and the Council should take a hard <br /> look at these decisions. They should not keep bending the rules and making <br /> allowances but should support the Town's ordinances. In this case the Wongs were <br /> aware of the development limitations on the lot. <br /> 7. UNFINISHED BUSINESS <br /> 7.1 Ordinance Amending Chapter 1 (Zoning) of Title 10 (Zoning and Site <br /> Development) to clarify Article 4 (nonconforming uses and structures) <br /> (SECOND READING) <br /> The ordinance before Council for second reading addressed nonconforming <br /> structures; nonconforming uses: continuation; and nonconforming uses: <br /> `. maintenance.
