NEW BUSINESS <br /> 8.1 Request for Encroachment Permit for Driveway, Lands of Nissley, <br /> 12422 Robleda Road <br /> Council had before them the Director of Public Works' staff report which noted <br /> kir that the application was to construct a driveway connection from the <br /> Nissley property directly onto Elena Road and which included the <br /> recommendation that this request be denied. In part the report stated that <br /> the access, between 35 and 50 feet from the stop sign at the intersection of <br /> Robleda and Elena roads, created a potentially hazardous condition and <br /> should not be allowed and that the only movement for which the <br /> proposed driveway was functional presently existed within the existing <br /> easement. <br /> Mr. Nissley, applicant, presented new drawings to the Council and explained <br /> that he was asking for a seven foot wide encroachment permit with no <br /> paving adjacent to the street. He noted that this was the first part of a two <br /> stage process: first an encroachment permit and then an amendment to <br /> the final map. He was requesting direct access to the street to be used <br /> when it was difficult to get off his property over the easement. Mr. Nissley <br /> further stated that he would take all of the liability for the encroachment <br /> permit. <br /> Max Blasch, previous owner of easement, stated that he had been on that <br /> driveway in a two ton truck and had had no problems.
