y Y <br /> lir <br /> The cash deposit shall be collected prior to final inspection. <br /> If the landscaping is not installed prior to the expiration of <br /> a one (1) year period following the date of final inspection, <br /> the Town will place the cash deposit in a landscape in lieu <br /> fund. The landscape in lieu fund will be used to plant and <br /> maintain landscaping within the Town to soften the impact of new <br /> buildings , swimming pools , tennis courts or driveways and arti= <br /> ficial cuts and. fills. <br /> The landscaping in lieu fund may be used to plant and <br /> maintain landscaping on public property, or, where appropriate <br /> agreements with property owners are obtained for right of entry, <br /> private property. <br /> If required landscaping is installed prior to the expira- <br /> tion of a one (1) year period, 50% of the cash deposit shall be <br /> returned to the depositor following inspection of the landscaping <br /> by the Town. Th:e =remaining 50% of the deposit shall be retained <br /> for an additional one (1) year period following the date of the <br /> inspection to insure adequate maintenance. At the end of the <br /> one (1) year period, an inspection will be Performed by the _Town and <br /> if the required landscaping is healthy, the remaining 50% of <br /> the deposit will be returned to the depositor. If, however, <br /> the Town determines that the condition of the required landscaping <br /> is unsatisfactory the remaining 50% of the deposit will be placed <br /> in the landscape in lieu fund. <br /> REGULARLY passed and adopted this 15th day of April, 1987 . <br /> B Y: ! <br /> MAYOR <br /> ATTEST: <br /> CITY LERK <br />
