H. PUBLIC HEARINGS: (continued) : <br /> The Planning Director referred to her staff report dated 5/12/88 which <br /> noted that in addition to recommending approval of a negative <br /> declaration and tentative map for the Lands of Oshima, the Planning <br /> Commission also voted 6 to 1 to recommend approval of a conditional <br /> exception for the requested tentative map to allow creation of a lot <br /> which did not have a 160 ' building site circle and to allow dedication <br /> of a 35 ' wide private street, not meeting the 60 ' width requirement <br /> based on the findings stated in the 5/12/88 report (on file at Town <br /> Hall) . Comment was also made on condition #11 of the tentative map <br /> which stated that a restriction shall be recorded that the height of <br /> structures on the Lands of Oshima, Lots 1 and 2 , not exceed 19 feet in <br /> height. A note describing this restriction shall be made on the Final <br /> Map. <br /> Paul Nowack, applicant ' s engineer, stated that they were in general <br /> agreement with the conditions . Of course, they would prefer to have to <br /> comply with the height restrictions imposed on the Town as a whole <br /> rather than be restricted to 19 ' and would hope a compromise between <br /> 27 ' and 19 ' could be discussed. <br /> Jim Jorgensen, 26000 Torello Lane; John Rayden, 26011 Torello Lane; <br /> and Bob Rabin, 25980 Alicante each addressed the Council stating why <br /> they favored the height restriction. They emphasized the visual impact <br /> on the neighbors and emphasized that this was a major concern at the <br /> Planning Commission hearing on this property. <br /> Mr. Oshima, applicant, commented that if he had a 19 ' restriction on <br /> the property, architecturally he would have no choice but to build an <br /> ugly house. If the height restriction was imposed, he would withdraw <br /> his application and build his own house which could be 27 ' and which <br /> would be rustic but elegant. It seemed to him that this height <br /> restriction was defeating the purpose of the Town ' s regulations. <br /> Jean Struthers , Planning Commissioner, stated that she had voted <br /> against the height restriction. In her opinion, this particular lot <br /> had six neighbors which also had an impact on the lot under <br /> discussion. Of particular importance in this case was the siting of <br /> the house. <br /> Edward Emling, Planning Commissioner, noted that the concerns <br /> expressed at the Planning Commission meeting related to size of the <br /> lot, non-conforming lots , concern of the neighbors and provisions for <br /> the uniqueness of the lots . Mr. Emling also noted that Mr. Oshima made <br /> no comments at the Planning commission Meeting regarding the 19 ' <br /> height restriction. <br /> MOTION MADE AND SECONDED: Moved by Johnson and seconded by Tryon to <br /> raise the height restriction in condition #11 from 19 ' to 23 ' . <br /> 4111, <br /> -5- 5/18/88 <br />
