CITY COUNCIL MINUTES - March 19, 1966 <br /> E. PUBLIC HEARINGS: Iter 2. Lands of McCandless (continual) : <br /> Mr. Gree McCandless, applicant, appeared before Council and answered questions <br /> concerning the total square footage of the house and the garage. <br /> MYPLCN SECONDED AND CARRIED: Moved by van Tamelen, seconded by Allison and passed <br /> unaniimusly by all members present to grant a special land use permit for the <br /> Lands of McCandless based on the project's conformance with the guidelines for <br /> Ordinance #295. <br /> 3. LANDS OF CHENG, 11651 Jessica, request for a special land use permit <br /> to allow construction of a project having a height in excess of fifteen <br /> feet (addition) <br /> The Staff Planner referred to her 3/14/86 staff report which included the staff's <br /> recon a dation that a syseial land use permit be granted basad on the project's <br /> conformance with the guidelines for Ordinance #295. <br /> MOTION SECONDED AND CARRIED: Moved by Fuhr an, seconded by Allison and passed <br /> unanimously by all members present to grant a special lard use permit for the <br /> Lands of Cheng based on the project's conformance with the guidelines for <br /> Ordinance #295. <br /> 4. LANDS OF UGIE, 24970 O'Keefe Lane, request for approval of negative <br /> declaration and tentative map <br /> IThe Staff Planner referred to her staff report dated 3/14/86 which noted that the <br /> 46, Planning Commission recommended approval of the tenative nap for Lards of Ugie, <br /> subject to certain conditions. In addition the 2 nmission advised Council that the <br /> Lands of Ugie were found to be archaeologically sensitive and the annission <br /> recnmerded an additional condition to assume the protection of any archaeologic <br /> artifacts. <br /> Mr. Ugie, applicant, and Mr. Nelson, the applicant's engineer, addressed the <br /> Council on this issue. Mr. Ugie referred to his letter dated 3/18/86 which requested <br /> an.ndi ants to conditions 1.B., 7.B. and 7.C. as approved by the Planning C n n.ission. <br /> Mr. Ugie specifically explained his request for relief from the conservation easement <br /> on Lot #1 and also asked that the conservation easement on Lot #2 only blanket the <br /> storm drainage easement. Mr. Nelson explained the placement of this storm drainage <br /> easement which had been discussed with the Santa Clara Valley Water District and <br /> the Town Staff. <br /> rJean Struthers, Planning Commissioner, contented on the conservation easement <br /> dedication for Lands of Ebulk and also commented on the conservation easement in <br /> connection with the preservation of the creek. <br /> Mary Stutz, Chairman - Pathways Cornittee, clarified Condition 3.A concerning <br /> thwChairman and explained why a Type IIB path was requested. <br /> MOTION SECONDED AND CnBRTFD: Moved by van Tamelen, seconded by Allison and pncsed <br /> unanimously by all members present to approve the negative declaration for Lands of <br /> Ugie, File TM #5-85. <br /> PASSED BY CONSENSUS: All references to the lord 'should' in the conditions of <br /> approval for Lands of Ugie (and all future conditions of approval) shall be changed <br /> to 'shall'. <br /> -3- <br />
