I, Side, I, 001-352 <br />Mayor Dronkert called the Special Meeting to order at 4:10 p.m. in the Council <br />Chambers at Town Hall. <br />A. MLL CALL: <br />Present: Mayor Dronkert and Councid+embers Fuhxman, Rydell and van Tamelen <br />Absent: CcunciLTEmber Allison <br />Staff: City Manager George Scarborough, City Attorney Frank Gillio, City <br />Engineer Michael Enright and City Clerk Pat Daud <br />Press: Andrea Behr, San Jose Mercury; Mike McDevitt, Ios Altos Town Crier; <br />Mary Fortney, Peninsula Times <br />•�s•• •a 1 r a1•s <br />The City Manages reported that as of 11/1/85 the Town did not have liability <br />coverage; however, one proposal for such insurance had been received. <br />Gary Sherrer, Flamer and Company, noted that the proposal received from Alliance <br />Insurance Company had a limit o $400,000 for any one occurrence or aggregate of <br />occurrences in oneyear and a $100,000 deductible. They also required an inde- <br />pendent claims servicing organization, a letter of credit in the amount of <br />$100,000 and the right to agree to determination of legal representation. Mr. <br />Shexrer also commented that it was very difficult to get excessive coverage, at <br />least until after the first of the year. <br />The City Attorney noted that with the proposal for insurance before them, the Town <br />would have less insurance and more fiscal responsibility for insurance matters. <br />In response to requests fon the Council, the City Attorney prepared an opinion <br />dated 10/31/85 (on file at Town Hall) on the subject of Council Governmental <br />Iumunity. <br />Ryrdell questioned the amount of reserves that would be necessary in view of the <br />new policy and its requirements. The City Manages suggested that this be part <br />of the mid -year budget review but did rote that the cost of the actuary and the <br />premium would be covered in the current budgeted figure. Dronkert stated that <br />she strongly felt the State Legislature should be involved in solving this issue <br />of insurance or lack thereof. <br />Mr. Warren louse, 12580 Mira Lwna Way, connen ted that he had been in the insurance <br />bu <br />sines or forty years, was a concerned resident and was willing to help in any <br />way he could. He did question an earlier decision to go with Great Global Insurance <br />in that they had experienced financial difficulty and were forced out of business. <br />
