PRESENTATIONS FROM THE FLOOR: (continued) <br />A/ Mr. Scarborough informed Council the Site Development ccrt ittee has established <br />policy that the landscape plan must be approved by the Cacmittee prior to final <br />inspection on residences. Ms. Scarborough indicated the applicant made this <br />request to the Site Developnent Comnittee yesterday afternoon, noting the Committee <br />passed by consensus the applicant should present their situation to Council as the <br />Om ttee could not approve temporary occupancy based on reasons given. Mr. <br />Scarborough noted as this is an appeal of decision made by the Site Development <br />Cannittee there is a formal procedure in ordinances for this request, noting <br />this should be addressed by the Planning Cmmission. <br />Councilwoman Dronkert asked for an opinion from the City Attorney on the City <br />Council's capability to make scue acconodation on this request. <br />Mr. Gillio informed Council the City Manager has outlined the procedures per <br />municipal code, however, the Council could determine if in making an exception <br />that a conditional approval be given upon acceptance of landscape plans which <br />are in conformance with zoning ordinances, and that the applicant post a cash <br />deposit with the Town. <br />MOTION SECONDED AND CARRIED: Moved by Rydell, seconded by Fuhm. and passed <br />by the following roll call vote to conditionally approve Mr. & Mrs. Araj's <br />request for occupancy, subject to landscape plans being approved by the Site <br />Development Co ttee, and a bond in the amount of $10,000.00 be posted in cash <br />with the man. The City Attorney was directed to prepare a contract. <br />[ ROLL CALL: <br />AYES:.' Council Members Dronkert, Fuhrman and Rydell <br />NOES: Councilwoman van Tamelen and Mayor Allison <br />2. Mr. Marc Kaufman, 14100 Donelson Place, addressed Council with concerns <br />over the pathway spraying currently being done with non-esiergent, noting <br />ice plants along Fremont Road were sprayed and have died, noting it was <br />requested by the Town that these ice plants be planted in that location. <br />Mr. Scarborough and Mr. Enright informed Council spraying being conducted <br />is being done with a pre- ergent/noting all spraying is within road right <br />of way or pathway. and contact herbicides (AMENDED BY COUNCIL 1/16/85) <br />D. SPECIAL ORDERS: <br />1. Resolution # approving and authorizing execution of an agreement between <br />the City of the 'Town of Los Altos Hills and Eduardo O. Coli <br />Mr. Scarborough requested this item be continued to January 16, 1985 Agenda. <br />2. Resolution #101-84 approving Supplement #5 to Master A.grea t for Federal <br />Aid Projects, and authorizing execution thereof <br />MOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by Fuhxman <br />and passed unanimously to adopt Resolution #101-84 approving Supplement #5 to <br />Master Agreement for Federal Aid Projects, and authorizing execution thereof. <br />
