CITY COUNCIL MEN= - November 16, 1983 <br />D. SPECIAL ORDERS: <br />1. Ordinance #282 amending Section 9-5.1110 of Chapter 5 of Title 9 of the <br />IAs Altos Hills Municipal Code (concerning procedures for variances and <br />conditional use permits) SENDID READING <br />Planning Commission Representative Lachesbruch expressed concerns on behalf <br />of the Planning Commission regarding the Ordinance as it was now before the <br />Council. It was the Commission's opinion that the following sentence should <br />be a part of the Ordinance: 'Prior to taking any action reversing the decision <br />of the Board of Planning Administration or Environmental Planning Commission, <br />the Council shall refer the matter back to the approving body for review and <br />report within thirty days from the date of the Council referral. The action of <br />the Council shall be effective immediately upon a decision.' Council discussed <br />the need for formalizing the action between the Commission and the Council and <br />concern was also expressed regarding excessive delays to the applicants involved. <br />MOTION SECONDED AMID CARRIED: Moved by Proft, seconded by Perkins and passed unani- <br />mously by all members present to continue this item to the next Council meeting <br />and to appoint Councilman Perkins and Comnissioner Lachenbruch to a subcommittee <br />to review the ordinance and the concerns of the Commission and the Council. <br />E. UNFINISHED BUSINESS: <br />1. Representatives from the Santa Clara Valley Water District (Boardmanbers <br />Audrey Fishes and James Leniban; Counsel, Albert Henley, and Engineer, William <br />Carlson) - Report on dam at Moody and Rhus Ridge Roads <br />It was noted by Councilman Proft that a field trip had taken place at 4:00 p.m. <br />on November 16, 1983 which was attended by representatives of the SCVWD and <br />CounciimmaTbers Perkins and Proft. Councilman Perkins expressed the Town's concerns <br />that a substantial dam was across a major drainage channel and was causing serious <br />drainage problems. <br />Representatives of the SCVWD discussed the matter with the Council. Mr. Henley <br />commented that the permit issued by the SCVWD allowed the dam to be repaired and <br />the sc-vm did not have the authority to get rid of the dam. Mr. Henley further <br />camnented that the neighbors involved would have to work out the problem together. <br />Mr. Carlson conented that there was a range of solutions which included the <br />expensive decision to take out the dam and reline the creek or the less expensive <br />option of building a bermm around the area in question. Mr. Dennis Ely, engineering <br />technician of the SCM enumerated projects which had been performed by the <br />SCVWD in the Town in the recent past and the approximate costs of the projects. <br />Mr. Marc Kauf man, 14100 Donelson Place, reminded the Council of the strongly <br />expressed opinion in the past that there should be m charge to any natural <br />waterways in the Town. <br />Mrs. Louise Dronkert, 24731 Black Mountain Road, asked who had paid for the <br />removal of the tree when the SCVWD had issued the permit concerning the dam. Mrs. <br />Dronkert was informed the owners, net the SCVWD, had paid for the tree. <br />`. Mrs. Mary Stutz, 25310 Elena Road, cautioned against removal of the dam in <br />�r question ani ending up with a cement structure. It was very possible, in Mrs. <br />Stutz' opinion, that the dam had prevented certain problems. <br />-2- <br />
