Presentations from the Floor: <br />Mr. Kaplan Purchaser of Lot 25, Tract #6112, stated that, when he had contracted to <br />purchase a home to be constructed on this lot, he was not advised of a swale across the <br />front of the property and asked if a pipe might be substituted. <br />Councllmembers discussed with Mr. Kaplan the history of drainage in this area, the <br />aesthetic openness achieved by the placement of the swale and the communication problem <br />that would have to be resolved between Mr. Kaplan and the developer. Council consensus <br />was against the substitution of a pipe across Lot 25, Tract #6112. <br />D. STAFF - REPORTS CORRESPONDENCE 8 ANNOUNCEMENTS: <br />I. City Manager: <br />Mr. Crowe Introduced a claim from Pacific Telephone for damages to their aerial cable <br />at Page Mill Road and Arastradero on August 30, 1978, and advised denial. <br />MOTION SECONDED AND CARRIED: Moved by Councilman McReynolds, seconded by Councilman <br />Proft and carried unanimously to deny the claim from Pacific Telephone. <br />E. SPECIAL ORDERS: <br />Due to the absence of a court report, It was determined to take the following Item out <br />of order and hear the first two Items when the court reporter arrived. <br />& 2. Public Hearings <br />b) Request for Tentative Map Approval, LANDS OF HIGHTOWER, File TM #2089-78, 8 Lots. <br />(Continued from 9/20/78 Meeting - Negative Declaration adopted at that time.) <br />Councilman McReynolds introduced correspondence advising of the possibility of archeo- <br />logical finds on the subject property and questioned the Town's legal liability. Council - <br />members then discussed with the City Manager the steps Staff had followed at the time of <br />preparing an Environmental Impact Checklist for this application and the negative findings. <br />Mr. Nowack Engineer for the Applicant, stated that an additional archeological Investiga- <br />tion had been made with no conclusive findings. <br />Mr. Hill. Developer, outlined for Council the team approach they utilized in addressing <br />I; <br />sues such as; archeology, soils, geology and noise. He Introduced a proposed landscape <br />plan which, combined with house placement, would provide adequate noise mitigating measures <br />as called for In the Pack Report. <br />Mr. Shoo Landscape Architect, supplied detailed Information on plantings to be used, <br />their locations and hoped for noise reduction levels. <br />Mr Gregorwich Chairman/Noise Abatement Committee, praised the effort put Into resolving <br />the noise problems inherent to this property and recommended a broad leaf tree In place of <br />pines. <br />MOTION SECONDED AND CARRIED: Moved by Councilman McReynolds, seconded by Mayor Hillestad <br />and passed unanimously to add as new condition 11. (c): Houses shall be sited to be out- <br />side the 60 db area as defined by the proposed landscape plan. <br />to Councilman Perkins requested that the proposed landscape plan (now referenced in the <br />conditions) be numbered, dated and placed in the file In order to facilitate adherence <br />to conditions at time of Site Development. <br />-2- <br />
