6W CITY COUNCIL MINUTES - September 3, 1975 <br />ITEMS REMOyEn FROM CONSENT CALENDAR (Cont'd): <br />b) Accepted Tentative 11ap, LANnS OF BROHH-HUBMTH2O16-75, Sandis Assoc., <br />Engineers: <br />Councilwoman Miller questioned the need for a conservation easement being <br />required on this subdivision, since the terrain precluded the building <br />of any additional structures. She also noted that Lot 1 would be paying <br />all of the costs for the installation of water lines, and wondered if <br />there could be a reimbursement agreement so that some of these costs would <br />be returned to the owner of Lot I. <br />She also thought the road in -lieu fees were punitive in that there vias no <br />access from Elena Road for the lot in question. She questioned the need <br />for a geology report in light of the Environmental Impact Report. <br />Discussion ensued between Council, Staff, and the applicant's engineer, <br />Hr. John Humber, Sandis Associates, relative to the conservation easement <br />and whether such an easement were necessary. Other alternatives were <br />discussed, including the filing of a Declaration of conditions, re- <br />strictions, and covenants pertaining to the development of Lot 2. <br />City Attorney Frank Gillio stated that Council did not have direct control <br />4Wover water requirements; that this rested with a Special District. He <br />did say that a Hater Reimbursement Agreement was possible if it were <br />approved by the Uater District. <br />Discussion continued on the water charges and road in -lieu fees, and lir. <br />Ken Pastrof stated that the geology report was required, citing a <br />typographical error In the Environmental Impact Report. <br />Councilman Cheney moved, seconded by Councilwoman Hiller to approve the <br />Tentative Man, LANDS OF BROHM-HUBB, subject to the conditions recommended <br />by the Planning Commission, but deleting the requirement for a Conservation <br />Easement and adding the condition that a Declaration of Conditions, Re- <br />Strictions and Covenants with regard to the development of Parcel 2 be <br />submitted at the time of filing the Final Hap which would be based on <br />the final determination of the Health Department concerning the building <br />elevation line. Motion carried by the following roll call vote: <br />AYE: Councilman Cheney, Councilwoman Miller, mayor Pro Tem Helgesson. <br />NO: Councilman McReynolds <br />ABSENT: Mayor Grabo,.aski <br />ABSTAIN: NONE <br />TAKEN OUT OF ORDERS AS THEY APPEAR ON THE AGENDA: <br />D.
