UNSCHEDULED ITEM NO. 1: Rhus Ridge Ranchos cont'd.: <br />4W At 9:05 P. M., Deputy Mayor Benson returned the gavel to Mayor Aiken. <br />MOTION, SECONDED AND CARRIED: Councilman Fowle moved, seconded by Helgesson, <br />and carried unanimously, that the Tentative Map of Rhus Ridge Ranchos <br />Units #2 and #3 (357-69), 12 lots, 23.8 acres, Moody Road, be approved <br />subject to the conditions of the Check List. <br />UNSCHEDULED ITEM NO. 2• <br />CONSIDERATION OF REQUEST OF PARKSIDE SUBDIVISION, UNIT #1, TO MARE IN -LIEU <br />ROAD PAYMENT FOR ALTAMONT ROAD FRONTAGE. <br />Staff requested continuance to the next meeting. Council concurred. <br />STAFF REPORTS: <br />Assistant City Manager: <br />1. Noted the next Council meeting falls on September 1st, which is Labor Day, <br />and recommended ,hat adjournment should be to Tuesday, September 2, 1969, <br />for a Regular Adjourned Meeting. Council concurred. <br />2. Submitted and reviewed proposed agreement with Charles S. McCandless & <br />Co. for engineering services, noting the monthly retainer of $350.00 <br />would remain the same. <br />Council concurred this item should be agended for the September 2nd <br />( meeting. <br />br City Attorney: <br />1. Reported that property owners adjacent to the Anacapa slide area have <br />been contacted and that cooperative efforts are underway to eliminate <br />potential slide hazards. <br />2. Reviewed claim for damages and other relief totalling $40,000 re <br />drainage problems on Magdalena Road filed against the Town by Capt. <br />Leroy E. Harris, and recommended that the claim be denied. <br />Council concurred that the claim of Capt. Harris be denied and referred <br />to the Town's insurance carrier. <br />Council instructed the City Attorney to enforce the Zoning Ordinance <br />in regard to a setback violation of a stable on Capt. Harris' property <br />and instructed the City Engineer to re -inspect and report at the <br />September 2nd meeting on the status of public drainage improvements <br />in the vicinity of the Harris property. <br />3. Recommended the Council oppose proposed State legislation, which will <br />essentially impair the tax exempt status on municipal bonds. <br />Council concurred to Agenda this item for the September 2nd meeting. <br />4. Asked for brief litigation session at the end of the meeting. Council <br />concurred. <br />( City Engineer: <br />`' 1. Presented plans for the reconstruction of Concepcion Road and for a <br />portion of Altamont Road between Moody Road and Mt. Helen Orphanage, <br />noting that bids will be called for on September 15, 1969 and presented <br />to the Council that night; no additional rights-of-way are required on <br />Concepcion and only one small strip on Altamont; drainage improvements <br />-5- <br />
