SCHEDULED ITEM NO. 1:
<br />PUBLIC HEARING: SEWER ASSESSMENT DISTRICT NO. 4.
<br />At 8:00 P. M., Mayor Aiken announced that this was the time and place of
<br />hearing on the Engineer's Report prepared pursuant to Division 4 of the
<br />Steets and Highways Code, The Engineer read the report, except as to the
<br />map, plat, or diagram, assessed valuations, direct valuations and estimated
<br />assessments upon each parcel of land. All written protests were read by
<br />the Clerk, considered by the City Council and ordered filed. The following
<br />participated in Floor discussion: Jules Eshner, 26410 Altamont Road; J. G.
<br />Inness, 27593 Altamont Road; Don McCauley, 26498 Ravensbury Avenue; J. H.
<br />Cox, 630 Milverton Road, Los Altos; G. Ferrari, 25800 Altamont Road; Mrs. Mark
<br />Hinton, 11571 Buena Vista Drive; and Mrs. Florence Fava, 26691 Foody Road.
<br />After all those wishing to speak were given the opportunity, Council consid.
<br />enation and discussion ensued.
<br />Bonding Attorney reported on the five bids received for sale of bonds,
<br />recommending the lowest bid submitted by Kirchner, Moore & Co., with a net
<br />effective interest rate of 7.095%, be considered favorably. Bonding Attorney
<br />stated the lox bid contained a 4% bond discount, which was less than that
<br />estimated and recommended that if the project were to proceed, the project
<br />cost be reduced and the assessment be reduced.
<br />The Engineer reported on the protests, stating 28.1% of the total acreage
<br />included in the assessment district boundary had protested.
<br />MOTION, SECONDED AND CARRIED: Councilman Helgesson moved, seconded by
<br />Benson and carried by roll call vote, that the City Council order the changes
<br />requested by the letters of protest considered by the Council.
<br />At 10:24 P. M., everyone desiring to speak having been heard, Mayor Aiken
<br />declared the Public Hearing closed.
<br />Resolution No. 558, a Resolution of Determination, Under Division 4 of the
<br />Streets and Highways Code, to Proceed with Proceedings for Acquisitions, was
<br />read. On motion of Councilman Helgesson, seconded by Councilman Benson and
<br />unanimously carried, said Resolution was adopted.
<br />Resolution No. 559, a Resolution Overruling Protests on Resolution of
<br />Intention No. 549, was read. On motion of Councilman Helgesson, seconded
<br />by Councilman Benson and unanimously carried, said Resolution was adopted.
<br />Resolution No. 560, a Resolution Ordering Reduction of Assessments, was
<br />read. On motion of Councilman Benson, seconded by Councilman Helgesson and
<br />unanimously carried, said Resolution was adopted.
<br />Resolution No. 561, a Resolution and Order Adopting Engineer's Report,
<br />Confirming the Assessment and Ordering the Acquisitions, was read. On
<br />motion of Councilman Helgesson, seconded by Councilman Benson and unanimously
<br />carried, said Resolution was adopted.
<br />Resolution No. 562, a Resolution Designating Collection Officer, was read.

<br />4W Resolution No. 5633 a Resolution Awarding Sale of Bonds, was read. On
<br />motion of Councilman Helgesson, seconded by Councilman Benson and unanimously
<br />carried, said Resolution was adopted.
