The applicant is seeking approval of a variance to allow the new <br />residence and parking areas to encroach within the front and both side yard setbacks. <br />As required by Section 10-1.1104 of the Zoning Code, this application for a new <br />residence has been forwarded to the Planning Commission for review and approval. A <br />Conditional Development Permit is required any time a proposed project is located on a <br />property with a Lot Unit Factor (LUF) of 0.50 or less. <br />Pursuant to Section 10-1.1107(3) of the Zoning Ordinance, the Planning Commission, in <br />reviewing a Conditional Development Permit application, determines whether the <br />proposed development meet the objectives and standards of the Town. The evaluation of <br />the Conditional Development Permit should include consideration of the size and design <br />of the project with respect to the size, shape and topography of the site. CDP lots are not <br />automatically entitled to MDA and MFA numbers and may be subject to conditions that <br />include reductions to the allowable MDA and MFA. (LAFIMC 10-1.1107(3).b) <br />In addition, the Zoning and Site Development sections of the Municipal Code are used to <br />evaluate the proposal including building siting, floor and development area limitations, <br />grading, drainage, height, setbacks, visibility, and parking requirements. <br />The evaluation of the proposed variance should include many of the same items, <br />concurrently evaluating the physical site conditions which result in an undue hardship on <br />the property. Recommended findings for the Conditional Development Permit and <br />Variance are included in this staff report.
