The City Clerk read <br /> Dr. Beaver' s letter of September 4, 1963, stating the delay in <br /> completing the improvements was due to the slowness of the paving. <br /> company and weather conditions (improvements are presently com- <br /> pleted and accepted) . The City Attorney stated Dr. Beaver has no <br /> direct claim to the contractor but only to the Bonding Company. <br /> The liability is to us , but Dr. Beaver is at liberty to sue the <br /> paving company. This was related to Dr. Beaver, but the City <br /> Attorney' s office received no reply. <br /> ) <br /> ACTION: <br /> That Dr. Beaver's appeal of Bond Penalty, Tract No. 2093 , <br /> be referred to the Council 's Legal Committee for review. <br /> MOTION: Fowle; SECOND: Aiken; VOTE: Passed Unanimously. <br /> Page Mill Estates , Tract No. 3306 - Matter of Fence and Entry Gate <br /> he City Manager presented the plan submitted with the application <br /> for Building Permit showing fence and entry gates, The setbacks <br /> were satisfactory as required and the purpose was 'for identifying <br /> the property under Sign Ordinance No. 42, and not as an advertising <br /> display. <br /> Letters were submitted by the City Clerk from Messrs . Garbett , <br /> Dawson, Ewing and Jones of the Page Mill Road area, objecting to <br /> ahesize of the sign and lettering. Mr. Thomas Gamboa, developer <br /> of Page Mill Estates , asked the City Clerk to read aloud each lette7 <br /> objecting to the sign, and also for a determination between a <br /> billboard and an identifying sign. <br /> Councilman Fowle stated if it is larger than a street sign, it <br /> )ecomes a billboard.
