Baker. <br />The City Clerk read the recommendation of the Planning Commissio; <br />giving conditional approval. He stated that the map had been <br />revised to meet the conditions. He reported that the Fire Dis- <br />trict's approval was not given because of access, and that he <br />had been informed that the letter from Health Department is <br />being forwarded, stating certain requirement as conditions of <br />approval. <br />Mr. Baker reported that he discussed the matter of the Fire <br />District's disapproval with Chief Bassett, explaining that the <br />property is being subdivided solely for the purpose of selling <br />a lot. He further stated that Chief Bassett had told him that <br />he would contact the City Clerk and withdraw his objections. <br />11r. Baker requested that the tentative reap be approved subject <br />to agency approvals. <br />Councilman Clayton pointed out that approval by the Council <br />prior to all agency approvals may place the applicant in an <br />awkward position in case all agencies do not approve the map. <br />Mr. Baker stated that Mr. Miller had already sold the property <br />because he had been assured by one member of the Planning Com- <br />mission that the map would be approved. <br />Relative to road improvements, the owner will be required to <br />improve Elizabeth 11venue to Town Standards. The question of <br />which ordinance, No. 45 or No. 50 would apply to this subdivi- <br />s_}_on, Mr. Baker was instructed to check with the City .'attorney. <br />Mr, Baker stated that he or Mr. Miller had not been inforned <br />of the adoption of the new ordinance, and suggested. that the <br />Town should notify a subdivider of changes in ordinances when <br />it affects a subdivision being processed. <br />The Mayor stated that a study will be made by the Council. <br />
