r, <br />-3- <br />Report from Gardner Pulli.s, Town kttorney Letter <br />submitted by7 Attorney Ru.L is regarding petition for <br />twenty-two residents .for a Three -Ton Limit on <br />Magdalena, represented by Attorney James C. Wilson. <br />This petition was presented to the Council meeting <br />of May 13, 1957• <br />In Mr. Bullis' opinion the Council is restrained - <br />from instituting such a petition under the Injunction <br />Order in the case of Neary vs Town of Los Altos Hills <br />,r from any ordinance placing a 3 -ton limit for trucks <br />on Magdalena. However, if the Road Commission <br />determines damage is immediately being done, the <br />Town can petition the Superior Court for relief under <br />this restraining order and the enactment of such an <br />ordinance. This will require time, effort, expense, <br />and obtaining maps and affadavits by witnesses and <br />residents. <br />Councilman Bledsoe brought up the fact that if truck <br />traffic were limited. on Magdalena, Stonebrook would <br />have to carry this traffic. <br />The Road Commissioner stated Stonebrook was in <br />better condition to handle this extra load. <br />ACTION: <br />Instruct Town Attorney, Gardner Bullis, to petition <br />the Superior Court for a relief under the Restraining <br />Order to limit traffic on Magdalena to a 3 -ton limit. <br />Motion: Hoefler; Second: Bledsoe; Vote: Passed. <br />W.R. Aiken,'Magdalena, pointed out the urgency of <br />doing something about this road, as trucks go on the <br />wrong side to get around. a bad portion, which is a <br />blind corner.-,_lso, flying pieves of the surface <br />has damaged cars parched on Magdalena. <br />Don Hibner, Road Commissioner, explained Magdalena <br />has not been repaired because the sub -grade has not <br />dried out and any repair would not hold. <br />Mr. James Wilson, Magdalena, suggested that DANGER <br />signs be erected to notify motorists that the road <br />is in bad condition. <br />Mr. Gutt, Summerhill, suggested that the Town should <br />be willing to spend a few hundred dollars to fix the <br />bad holes temporarily.- <br />4W <br />emporarily. <br />4W _3_ <br />
