09 <br />City Clerk Paulman reported to the Referendum Petition <br />Committee consisting of Councilmen Bledsoe, Fowle and <br />Rothwell reading a letter from Registrar of Voters <br />Tarleton. Also stated t1m t he could not certify the <br />names as he had not checked them personally. Mr. <br />Tarleton advised that he allowed no one but employees <br />to check the records. <br />Councilman Rothwell read sections of the Election <br />Code where it stated that it was the responsibility <br />of the City Clerk to check all names personally and <br />said that he feels it is not compulsory for the City <br />Clerk to certify the names on the petition. <br />Councilman 1'owle suggested that the Council act on <br />the petition at once and that he was not looking for <br />technicalities. <br />Councilman Bledsoo read Chapter 1.709 of the Election <br />Code and commented that the law is clear. <br />Vice Mayor Dungan suggested that they read the Code <br />to the Registrar of Voters, Mr. Tarleton, and ask <br />him to allow the City Clerk to check the referendum <br />petition against the no -ries in the affidavit books. <br />Vice Mayor Dungan asked City Clerk Paulman if he would <br />certify the validity of the names on the referendum <br />petition, but was advised that he had not seen the <br />records so he could not certify the validity of the <br />signatures. <br />It was moved by Councilman Bledsoe, seconded by <br />Councilman Fowle that the Council accept the referen- <br />dum petition against Ordinance No. 19. After con- <br />siderable discussion from the floor, Mr. Wilson, <br />quoting Chapter 1709, suggested that the petition <br />should not be filed. He also claimed that a techni- <br />cality cannot be waived and the burden should be <br />placed on the people who brought in the petition <br />rather than the Council proving it was invalid. <br />Councilman Bledsoe asked to withdraw his motion and <br />Councilman Fowle asked to withdraw his second. <br />Vice Mayor Dungan asked for authority to contact <br />Mr. Tarleton to get the City Clerk access to the <br />records. It was moved by Councilman Rothwell, <br />seconded by Councilman Bledsoe and carried by voice <br />vote granting this authority. <br />Council Minutes <br />- 2 - 10-29-56 <br />
