RESOLUTION PC 05-23 <br />RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF LOS ALTOS <br />HILLS MAKING A CATEGORICAL EXEMPTION DETERMINATION UNDER CEQA <br />AND APPROVING A CONDITIONAL DEVELOPMENT PERMIT, SITE <br />DEVELOPMENT PERMIT, AND VARIANCE FOR A MAJOR ADDITION AND <br />REMODEL AT 25851 ESTACADA DRIVE <br />WHEREAS, The Town of Los Altos Hills received an application for a Conditional Development <br />Permit (CDP23-0002), Site Development Permit (SD22-0066), and Variance (VAR23-0001) from <br />the property owners, Brendan and Taryn Merkley, for a major addition and remodel at 25851 <br />Estacada Drive ("Project"); and <br />WHEREAS, based on the record presented before it, the project is exempt from the provisions of <br />the California Environmental Quality Act (CEQA) pursuant to Sections 15301(e) and 15303(e) as <br />the project scope includes construction of an addition not greater than 50% of the existing structure <br />and a new swimming pool, respectively; and <br />WHEREAS, the project application. was processed in accordance with the applicable provisions <br />of the California Government Code and the Los Altos Hills Municipal Code; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the project on May <br />4, 2023, and considered all evidence, testimony, written documentation, and public comments and <br />continued the item to a date uncertain; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the project on July <br />13, 2023, and considered all evidence, testimony, written documentation, and public comments; <br />and <br />NOW, THEREFORE, based on the entirety of the record before it, the Planning Commission <br />of the Town of Los Altos Hills hereby finds that the Project is exempt from CEQA pursuant to <br />CEQA Guidelines Section 15301(e) and APPROVES the Conditional Development Permit <br />CDP23-0002, Site Development Permit SD22-0066, and Variance VAR23-0001 subject to the <br />findings and conditions attached hereto and incorporated herein as Exhibit A and Exhibit B. <br />The above and foregoing Resolution was passed and adopted by the Planning Commission of the <br />Town of Los Altos Hills at a special meeting held on the 13th day of July 2023 by the following <br />vote: <br />AYES: <br />Bredo, Couperus, Patel, Waschura <br />NOES: <br />Indaco <br />ABSTAIN: <br />None <br />ABSENT: <br />None By: - <br />Alisa Bredo, Chair <br />ATTEST: <br />_ <br />Elaine Ling, Interim Cori unity Development Director <br />Resolution PC 05-23 Page 1 <br />
