MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Casey <br />and passed unanimously to approve the request to host Alpha Omega <br />Shelter from June 8, 1996 through July 7, 1996 at St. Nicholas Church and <br />School, 12816 El Monte Avenue <br />6.2 Request for approval of lot line adjustment, Lands of Morrison, <br />27641 Purissima Road <br />Mr. Bill Kull, applicant's engineer, explained to the Council Mrs. Morrison's estate <br />planning and reason for the lot line request. The request was for a lot line <br />adjustment of two existing legal lots to create two buildable parcels. These two <br />buildable parcels would provide financial assistance for the subdivision. <br />The City Attorney referred to the State's Subdivision Act which states that: "A local <br />agency shall limit its review and approval to a determination of whether or not the <br />parcels resulting from the lot line adjustment will conform to local zoning and <br />building ordinances. A local agency shall not impose conditions or exactions on its <br />approval of a lot line adjustment except to conform to local zoning and building <br />ordinances." The City Attorney further commented that the Town's Codes do not <br />address lot line adjustments. <br />MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Hubbard and <br />passed by the following roll call vote to approve the request for a lot line adjustment <br />for Lands of Morrison, 27641 Purissima Road, subject to the applicant's submittal of <br />a plat map (prepared by a registered engineer or licensed surveyor) prior to the <br />Town's recordation of a certificate of compliance and subject to conditions to <br />provide appropriate access and utility easements (or declaration of easements) to <br />Parcel 1. <br />AYES: Mayor Pro Tem Hubbard and Councilmembers Casey, Dauber and Johnson <br />NOES: Mayor Siegel <br />PASSED BY CONSENSUS: To direct the City Attorney to clarify the Town's Codes <br />regarding lot line adjustments and bring this issue back to Council for discussion. <br />6.3 Initiation of review by Planning Commission of ordinances related to: <br />a) 160 foot radius building circle as a zoning code requirement <br />MOTION SECONDED AND CARRIED: Moved by Hubbard, seconded by Dauber and <br />passed by the following roll call vote to refer the 160 foot radius building circle as a <br />zoning code requirement to the Planning Commission for review with the addition <br />of the 350 foot circle as well. <br />December 6, 1995 <br />City Council Meeting <br />
